Miskif taking an epic court fail as

0:04

Asmongold gets a giant W. We're going

0:06

into it today on The Legal Mindset we

0:08

teach you to be your own judge. Of

0:10

course, I'm Andrew Esquire, American

0:12

attorney.

0:12

>> How about that?

0:13

>> Now, this is something I've been

0:14

following for a while because this is a

0:16

fascinating case involving many

0:18

streamers, their corporations, and

0:20

really it has ramifications for

0:23

defamation and also a certain type of

0:26

claim out there. And we're already

0:28

setting some precedent here in what's

0:31

been going down. So, I'm going to get

0:33

into today the nitty-gritty of exactly

0:36

what went down in the latest filing in

0:39

the Miskif case. So, anytime you see the

0:41

language that says plaintiff, just put

0:44

Miskif's name in there. He's the guy who

0:47

has brought this claim against the

0:50

plethora of people that he thinks have

0:52

wronged him. Now, of course, amongst

0:54

those, of course, the prime defendant

0:56

here is Emiru, who is not off the hook,

0:59

but even with Emiru, her chances of

1:03

winning seem to be going up based on the

1:06

latest filing and what happened. And of

1:08

course, we have the Roach King over here

1:10

in his glorious rainbow shirt. He was a

1:12

defendant in this case, but now things

1:15

have changed in his favor. So, what

1:17

exactly happened? What exactly went

1:19

down? Well, first we need to get into

1:21

this law called the Ending Forced

1:24

Arbitration of Assault and Harassment.

1:28

>> This is dude, this was so [ __ ]

1:30

[ __ ]

1:31

>> Act, right? So, uh it is

1:34

it is a specific act involving a

1:36

specific type of, once again, legally,

1:39

right? We're talking about legal

1:41

definitions here, of SA or SH. And this

1:45

was meant to keep people who signed

1:48

pre-dispute arbitration agreements from

1:51

being forced into silence. This is meant

1:54

to keep victims from being essentially

1:57

bullied by these agreements, which they

1:59

may have signed without really thinking

2:02

about it, or maybe even under duress, or

2:04

saying, "Hey, you're not going to get

2:06

this job or position, or we're not going

2:08

to enter into this agreement with you

2:09

unless you sign this." So, essentially,

2:12

this is to stop people, victims, from

2:14

being bullied and forced into these

2:16

secretive agreements that might go down

2:19

during an arbitration, because

2:20

arbitration has its benefits, but one of

2:23

the things is it isn't as transparent.

2:25

People don't get to see what goes on in

2:27

that arbitration. So, that's one of the

2:29

key things here. And in this case,

2:32

>> Yeah, and and keep in mind, it's meant

2:34

so this law is meant to protect victims.

2:40

To protect people that are victims of

2:42

bad behavior and uh you know, uh

2:45

harassment and stuff like that.

2:48

This is for victims.

2:50

>> have to focus on, and the judge

2:52

specifically focuses on the fact that

2:55

this was meant to keep victims,

2:57

underlining that, victims, from being

3:00

forced into a secretive arbitration. So,

3:03

what went down in this latest ruling

3:05

from the judge in this case? Well, let's

3:07

look at the exact text here, and this is

3:10

fascinating. So, they go on to say, the

3:13

judge says, "Plaintiff, that's Miss

3:15

Gift, claims that the word involving in

3:17

an essay dispute definition is so broad

3:20

as to make the EFA's treatment of SH and

3:23

SA entirely different." He's trying to

3:25

break those things out for his own

3:27

benefit to make his case. However, both

3:30

definitions contain broad language

3:32

involving, related to, but neither sweep

3:35

so broadly as to mean the person

3:38

alleging conduct constituting an SH

3:41

dispute or SA dispute.

3:43

I.e., the person who may elect to avoid

3:46

arbitration is in fact the person

3:48

accused of or denying either SA or SH.

3:52

Now, this is huge. What this is saying

3:55

is is that the perpetrator, right? The

3:58

person who may who is being

4:00

>> He was the one that was accused of this

4:02

bad behavior.

4:05

And he's trying to use a law that

4:07

protects victims of the bad behavior.

4:11

That's the precedent that he was trying

4:13

to use.

4:15

It's crazy.

4:19

>> accused of perpetrating. The person who

4:21

is not the victim here, but the person

4:24

who is the person who is alleged, right?

4:26

There's an allegation here out there.

4:28

That person can use it to their benefit.

4:32

The law was constructed to help the

4:34

victim, not the perpetrator. But the

4:37

construction that Mizkif wants, he wants

4:40

this arbitration prevention to work for

4:44

him as a person who was, once again,

4:46

allegedly by Amouranth in her

4:48

quote-unquote emotional truth, the

4:50

perpetrator.

4:51

>> Mhm.

4:52

>> And the judge did not buy that at all

4:55

whatsoever. In fact, they go out to say

4:58

that we're going to reject that argument

5:00

and take up the recommendation of the

5:03

magistrate judge. The magistrate judge

5:05

Susan

5:05

>> What a [ __ ] surprise that using a law

5:08

that's meant to protect victims, when

5:10

you're the one who was being accused,

5:12

didn't work.

5:15

What a [ __ ] weasel.

5:17

What a little rat.

5:19

>> Hightower, who gave her recommendations

5:22

earlier this month.

5:23

>> Uh-huh.

5:24

>> Uh so, if you look into this, it says

5:26

that they adopt the recommendations. So,

5:28

it's ordered that OTK, Mythic, King,

5:31

they their motion to compel arbitration

5:33

is granted. So, they win. So, Mythic,

5:36

OTK, and King, they're getting what they

5:38

want, which is arbitration. So, they're

5:40

taking a win there. Next, it says

5:43

litigation of counts one and three of

5:45

their uh complaint is stayed. So, that's

5:47

the the accounts that related to OTK,

5:50

Mythic, King. So, those are stayed

5:52

pending the arbitration. So, now it's

5:54

got to go to arbitration as to OTK,

5:56

Mythic, and King. Cuz, once again,

5:58

MissKif can't use this to get out of

6:02

arbitration. It also says, and here's

6:05

the catch, that defendant Shonk, that's

6:08

Emiru's motion to dismiss is denied. So,

6:11

Emiru does take an L here, and MissKif

6:15

does get a tiny W, but there's a butt.

6:17

And you've always got to read the butt.

6:20

But, plaintiff Misriah that's MissKif,

6:23

shall submit a more definite statement

6:25

on or before August 10th. So, we're

6:27

going to have, in just a week or two or

6:30

two weeks route at this point, we're

6:32

going to have

6:33

him coming forward with this.

6:36

Identifying each statement that Emiru

6:39

said, which alleges to be defamatory.

6:42

So, he's going to have to go and pick

6:43

out every single specific statement,

6:46

including exact quotes from her live

6:49

stream. So, before MissKif was being

6:51

vague, saying that oh, I've been

6:53

defamed, etc. But, he wasn't saying this

6:56

exactly is the thing. And the judge is

6:58

agreeing with what we actually said

7:00

previously on this stream, what others

7:02

have said, what Asmon said as well,

7:04

which is what exactly did you these

7:08

people say, Asmon, Emiru, etc. What did

7:10

they say that is defamatory? Now, Asmon,

7:13

as we're going to see, is out of this,

7:15

but even as to Emiru, do they need the

7:17

judge needs more than what MissKif has

7:19

given so far. Then he

7:21

>> That's right.

7:22

That's right.

7:24

Vindicated, let's go. I know.

7:26

>> It's got to say how is it

7:28

>> too bad, right?

7:29

>> Because if a statement is true, then

7:31

well, it can't be defamatory. And the

7:33

last part is how it harms him. So, even

7:37

if he's able to say, okay, here's a

7:40

quote.

7:41

This is not true,

7:42

but if it has no harm, then it's not

7:46

>> prove I'm lying.

7:48

>> actionable, right? So, now he's got to

7:49

jump through all of these hurdles even

7:52

with Emery. So, while he gets that W,

7:54

he's got to put in work, him and his

7:56

lawyers, to go through with each

7:58

statement and say exactly how that harms

8:00

him. And that's going to be a little bit

8:02

of a challenge for him, and let's see

8:04

how his lawyers and him come up with

8:06

that response. The other thing here is

8:09

that Asmongold gets the win. It's

8:11

finally ordered that defendant Hoit's

8:13

amended motion to dismiss count is

8:15

granted. So, boom. Asmongold gets the W.

8:18

However, uh it's dismissed without

8:21

prejudice. And that's signed July 10th

8:23

by Robert Pitman, US District Judge. So,

8:26

just a

8:27

>> Aw, jeez, guys.

8:31

Aw, man.

8:35

It looks like suing somebody after that

8:37

person comes out and says that there are

8:40

other people that want to accuse you of

8:42

something, and I'd be willing to fund

8:44

their legal bills so they'd be able to

8:45

do it with a degree of security,

8:50

it turns out that suing a person so they

8:52

can't do that,

8:54

aw, man.

8:55

Maybe it didn't work out too well.

9:00

That's too bad.

9:03

How about that?

9:05

>> In case you guys don't know, and this is

9:07

very important for you guys to

9:08

understand with any legal case, there's

9:11

with prejudice and without prejudice.

9:13

>> Mhm.

9:13

>> In the legal context, without prejudice

9:15

really means without loss or waiver or

9:18

any of any right or privileges.

9:20

>> Yeah.

9:20

>> So, in this case, that means that it is

9:23

possible,

9:24

>> Mhm.

9:24

>> theoretically,

9:26

theoretically,

9:26

>> Mhm.

9:27

>> hypothetically, it is possible that Miss

9:30

Kiff could refile later against

9:32

Asmongold. So, while Asmongold's

9:34

>> He can lose twice.

9:37

>> is is dismissed. It is possible if there

9:40

were some new facts or something else

9:42

came out or there was some disco-

9:43

>> the way, like

9:45

the fact that like you like getting the

9:48

[ __ ] dismissed is like that's it it

9:50

didn't even get past the first stage.

9:52

>> that came out. It is possible

9:56

that he could come back and try to swing

9:58

against Asmongold again. Now, I don't

10:00

think that's a wise choice. I don't

10:02

think that's going to be a winning

10:03

strategy, but of course we don't know

10:05

yet. There may be more discovery. We're

10:07

all trying to find a fact and come

10:09

against Asmongold again. So, let's turn

10:11

over to my judgment here. So, in

10:13

judgment, Asmongold has been completely

10:15

cleared at this point, right? Until we

10:18

get until and unless there's more secret

10:21

facts out there. There's something we

10:22

don't know. Asmongold's off the hook.

10:25

OTK, Mizkif, King, they get a W with

10:28

compelling arbitration. And then Mizkif

10:30

now needs to specifically go through, do

10:33

the work with his lawyers, and explain

10:35

how each statement was defamatory, how

10:37

it was false, and how it harms him.

10:39

That's going to be a significant hurdle

10:41

for Mizkif. And then Mizkif still has a

10:44

chance. So, I don't want to say at this

10:46

point, once again, you never know with

10:49

cases. They can take wild and crazy

10:51

turns. So, I want to be conservative

10:54

here in my in my assessment saying, yes,

10:57

it is possible that Mizkif could find

11:00

some facts and come against Asmongold

11:02

again. It's possible he could prevail

11:04

against Amouranth. But at this point,

11:06

his window for vic-

11:08

>> It's not what I would bet on.

11:13

So far.

11:14

It's not what I would bet on.

11:17

>> tory is narrowing. It's becoming harder

11:20

and harder for Mizkif. And this is the

11:22

point at which I would say to Mizkif,

11:25

are you really committed to taking this

11:27

all the way or would a settlement really

11:29

make you happy, bro? Would you be okay

11:32

with some form of settlement? Maybe

11:35

maybe an Emiru apology saying, "Hey, I

11:37

framed this in a bad way. I

11:39

>> It's not going to happen.

11:41

>> shouldn't have said this this way. Maybe

11:43

I should have framed this in a different

11:44

way, right? Maybe it shouldn't have been

11:46

my emotional truth. Maybe I should have

11:48

framed this in a more objective and

11:50

neutral way. Maybe something like that,

11:52

a settlement, maybe a payment, who

11:54

knows? Is that an option that might be

11:56

better for you or better for all

11:58

parties? I would say, "Look, Miss Keff,

12:00

your your window is closing. Asmongold

12:03

has already gotten that W over you. How

12:06

far are you willing to take this?" But,

12:07

I want to know what you guys think in

12:09

the comments below, and I will catch you

12:11

on the next one.

12:12

>> How's it narrowing if the judge approved

12:13

it to the next step? Isn't that the

12:15

opposite?

12:16

>> Um it's because he basically didn't

12:18

define it correctly, and the judge wants

12:20

to have a more definitive like that's

12:23

part of Emmy's case and not mine. So,

12:25

like I'm not going to really make a lot

12:26

of comments on that. I'm only really

12:28

going to talk about like my my

12:30

situation. And my situation was actually

12:34

really really simple. And to the extent

12:37

that anything else comes out, I think

12:39

that it will only further

12:43

entrench this problem. Like there's a

12:45

lot of things like right now, um you

12:47

know, again, I have respect for other

12:49

people's privacy. There are a lot of

12:51

things that are not uh public, but when

12:54

they are made public, I think they'll be

12:55

very revealing.

12:58

I think they will be just like the other

12:59

things have been revealing. Like for

13:01

example, the Discord DMs were revealing.

13:03

Um

13:04

you know, things like for example, like

13:06

some of the stuff in the other court

13:07

filings were also revealing.

13:09

And so, there's been a a whole lot of

13:11

this.

13:12

And uh that's really about it.

13:15

And so, uh checking the claims now since

13:16

it'll be worse if the judge caught the

13:18

silence attempt. Yeah, tried and failed,

13:20

exactly. So, [snorts] uh let me look at

13:22

here. Wrath of the Roach King, the

13:23

thumbnail goes hard. Exactly, right? And

13:26

uh yeah, there it is here. So, I'm going

13:27

illegal video can't use the word sexual

13:28

harassment and sexual assault. I mean, I

13:30

that's for YouTube, right? That's the

13:32

reason why.

13:33

And, uh step one, do [ __ ] up [ __ ]

13:35

Step two, attempt to punish anyone who

13:37

mentions it. Yeah, and it's not going to

13:39

work out, and it already hasn't. I think

13:42

that's very clearly what's happened. So,

13:44

uh the judge uh wants clear evidence. I

13:46

think that the in order to file a

13:48

lawsuit, you have to have a very

13:50

definitive and a defined mode of like

13:54

problematic behavior, right? And so, you

13:57

can't just go off of a vibe. You have to

14:00

like whenever you're talking about

14:01

something like defamation, for example,

14:04

you have to have a bunch of different

14:05

standards to meet. Like the actual like

14:08

cuz again, not getting the case

14:10

dismissed is like a super super early

14:14

like that's like if you don't if you get

14:15

the case dismissed, it's like it's

14:17

basically just [ __ ] right? So,

14:19

there are multiple other levels that a

14:21

case has to go through in order to reach

14:24

a trial, and then actually then winning

14:27

the trial is another one. So, it's like

14:29

kind of you have a lot more to go

14:31

through than just like one specific

14:33

thing. Um there's a long Yeah, it's a

14:35

very very long process, and something

14:38

not getting thrown out immediately is

14:40

like not really that big of a deal. What

14:42

do you think will happen in the Amaru

14:43

case? Uh I'm not going to I mean, out of

14:44

respect for her and everything, and I'm

14:46

not going to make comments on that. So,

14:49

yeah, that's it.

14:50

And, uh does Mizkif have to pay your

14:52

lawyer fees or nope? No, he doesn't. Uh

14:54

and uh well, he like he might be able to

14:57

or might have to, but at the current

14:59

point in time, according to like my

15:01

legal counsel, they said that um uh I

15:05

was I was not going to be able to uh

15:07

recoup the fees, and so I'm going to

15:09

have to pay those myself.

15:11

And so, that's really about it. I mean,

15:13

like and and to me, like it's not

15:14

something that I he has to I don't know

15:16

about that.

15:18

And, uh do not say. Um so,

15:21

And, uh judge will sentence him to the

15:23

same world server. Yeah, I guess so. You

15:24

might get reimbursement in 5 or 10

15:26

years. I have no idea if I will. I'm not

15:28

expecting to and I don't regret anything

15:31

that I did. I think that I acted and I

15:33

did the right thing at the right time

15:35

and this might be something that people

15:37

would be confused about because it's not

15:39

something that you'd expect to hear from

15:41

me, but I do genuinely try to do the

15:44

right thing.

15:45

I do. Like in a lot of cases, I try to

15:48

actually do the right thing even if it's

15:50

something that is unpopular, even if

15:53

it's something that is not that you

15:54

know, beneficial to me. And you know,

15:57

just for I mean total transparency sake,

16:00

the case cost me over under a you know,

16:02

I think it was over $100,000. I I still

16:05

need to pay I think one or two of the

16:06

bills. So like you know, cuz there's a

16:08

finalization of it very recently. So I I

16:12

really I do that with no

16:14

with no reservation. I don't even I

16:17

don't even think about it, right? That's

16:19

a lot. Yeah, it's a lot of money. Like

16:20

that's the way it is. But the reality is

16:23

that that is the price of doing

16:25

business. I

16:27

I'm you know, I obviously have a big

16:28

channel and I talk about a lot of

16:30

current events and

16:32

you know, this is just what happens. And

16:35

so I don't really look at it as like a

16:37

horrible thing that happened to me or

16:39

anything like that. I think to myself

16:41

how how lucky I am, the fact that I'm

16:43

able to pay for something like that and

16:44

it's no big deal. And I think also like

16:47

it just doesn't really matter at all

16:48

about any of this. Like I mean

16:51

at the end of the day, I am going to

16:53

always do what I think the right thing

16:55

to do is. And whether that is something

16:57

that's not beneficial to somebody else

16:59

or whatever,

17:01

it doesn't really matter. What really

17:03

matters is doing what I think is the

17:05

right thing to do.

17:06

Does that make sense?

17:09

Does Mizkif pay same amount in fees? I

17:11

think he's probably making he's probably

17:13

spending more than that because there's

17:15

like multiple cases that he's fighting,

17:17

right?

17:22

It's money well spent. Yeah, and so I

17:24

have no like and there's no reason to

17:27

for me

17:28

>> [snorts]

17:28

>> to act like a victim of of any of this

17:30

or anything like that. I I have no issue

17:33

and no problem at all with any of this.

17:35

And that's just the way it is.
