Summary

The Harrisburg Zoning Hearing Board approved Capitol Academy's variance request for reduced parking to allow classroom expansion, but denied a place of worship's parking variance without prejudice due to a lack of formal property agreement documentation.

This meeting highlights the practical application of zoning relief, illustrating how environmental constraints like floodways shape school expansions and emphasizing the absolute necessity of documented property rights when utilizing shared municipal parking.

Section summaries

0:00-7:00

Call to Order & Board Introductions

optional

The meeting is officially called to order by Chair Cla. The solicitor, planning director, and board members are introduced, and the quasi-judicial nature and appeal processes of the board are explained for the record.

This is standard administrative protocol and introduction, which is useful context but not critical for understanding specific cases.

7:00-12:00

Case 2620: 1414 North Cameron Street Introduction

watch

The board reviews the case exhibits (B1 through B9) for Specialized Education/Capitol Academy's application. Attorney Ash McCobi and applicant representative Josh Gray introduce themselves and are sworn in to present their proposal.

This sets up the evidentiary record and introduces the key parties for the first major case.

12:00-16:00

Planning Bureau Assessment & Environmental Constraints

watch

Planning Director Geoffrey Knight presents the case report. He highlights that Capitol Academy is expanding its enrollment and staff, creating a parking demand deficit of 17 spaces, but explains that environmental floodways prevent rear expansions.

This contains critical technical information about floodway constraints and the planning commission's specific zoning recommendations.

16:00-23:00

Capitol Academy Discussion & Unanimous Approval

watch

The board, applicant, and planning director discuss transit access, student drop-off metrics, and headlight glare screening on Cameron Street. The board votes unanimously to approve application 2620 with standard planning commission conditions.

It captures the complete debate, the resolution of landscaping conditions, and the official vote to approve the project.

23:00-29:00

Procedural Discussion on Absent Applicant (Case 2617)

optional

The board discusses Case 2617 (1100 North 17th Street), noting the applicant did not attend. They debate the mechanics of a continuance versus a denial without prejudice and discuss fee-waiver policies for potential refiling.

The section details administrative internal debate about scheduling and fees, which is useful background but not the final ruling.

29:00-33:00

Case 2617: Summary and Denial Without Prejudice

watch

The board officially opens Case 2617. Due to the lack of necessary off-site parking deeds or contracts and the applicant's failure to appear, the board votes unanimously to deny the application without prejudice so they can refile properly in the future.

This section explains the formal rejection of the place of worship's variance due to lack of property ownership evidence.

Key points

  • Natural Floodway Constraints Limit Physical School Infill — Capitol Academy was forced to place its new modular classrooms within its existing parking lot because the building is bordered by a designated floodway to the west. This environmental constraint severely limits traditional structural expansion options on the property.
  • Empirical Parking Studies Outperform Code Standards — Capitol Academy successfully obtained a variance for a 17-space parking deficit because their specialized study proved actual daily peak demand is around 39 spaces, far below the standard zoning code requirement of 89 spaces. The lower usage is driven by extensive student busing and public transit use by staff.
  • Administrative Denials Without Prejudice Protect Applicant Rights — The board denied Abdul Larry's place of worship parking variance because he lacked written, legally binding usage agreements for his proposed off-site parking lots. The denial was made without prejudice, allowing him to refile without a permanent rejection on his record.
we're a quasi judicial board which means that we have a we have a stenographer because again uh any any statements anything made uh your appeal process is up through common police court. Cla (Chair)
the floodway runs right to the west of where uh these trailers these modular classrooms will be located. So, uh it would have significantly complicated uh any proposal to either expand the building on site Geoffrey Knight

6:09

Good evening everyone. Uh time is uh

6:14

606. This is the November meeting of the

6:17

Harrisburg zoning board. Okay. To my uh

6:21

to my right, Mr. James Hob, vice chair.

6:24

Um to my left Michael Con, our solicitor

6:29

and to his left is

6:31

>> Patton

6:33

solicitor and representing the city is

6:37

the director of planning and some of

6:40

Jeff Knight and Miss Cameron. She's

6:44

representing the city law department.

6:46

Okay. Um myself, I'm the chair cla

6:50

this is and I said this in front of city

6:53

council. We're a quasi judicial board

6:56

which means that we have a we have a

6:59

stenographer

7:01

because again uh any any statements

7:04

anything made uh your appeal process is

7:06

up through common police court. Okay. So

7:09

we have to have something that's a court

7:10

of record for that appeal process.

7:14

Okay. Um there's no visitors here but

7:17

anybody who has any to speak uh they'll

7:19

step to the to the mic virtual mic there

7:22

and they will make their announcements.

7:24

Okay. And the rules governing that is

7:27

that they must be in some close

7:29

proximity to the prop to the property or

7:31

the issue that's in front of us. Okay.

7:34

So I'm going turn this over to Michael

7:37

and ready to go.

7:38

>> Okay. So, um before we begin, so the uh

7:43

um court reporter here uh to my left

7:46

taking everything down. So, let's avoid

7:48

not talking over one another. Uh uh-huh.

7:51

Uh-uh. You know, just so it's clear so

7:53

the court reporter can take everything

7:54

down. Um also, as this is on the record

7:58

and it's a hearing, then we swear in

8:00

witnesses. So, uh Mr. Knight, could you

8:02

please raise your right hand? Do you

8:03

swear or affirm to tell the truth, the

8:05

whole truth, and nothing but the truth?

8:06

>> I do.

8:07

>> Okay.

8:08

And the case is uh 2620

8:12

uh 1414 North Cameron Street. Um and

8:17

I'll read in the exhibits and then we'll

8:19

have uh the applicant and his council

8:23

identify themselves and then we'll swear

8:24

in the applicant. Okay. Uh all right. So

8:27

we have exhibit uh B1, the proof of

8:30

publication in the Patriot News,

8:31

November 2 and November 9, 2025. B2 is

8:36

the uh letter uh sent from the planning

8:39

director to the applicant notifying of

8:40

the hearing tonight. B3 is a hearing

8:43

notice uh posted on the property. Um B4

8:47

notification letter sent to uh the

8:49

required neighbors and a certificate of

8:51

mailing. B5 is the application packet

8:54

and with that was an attached narrative

8:57

uh photos of the existing conditions on

8:59

the property uh site plan for the

9:01

proposal and the uh parking study and

9:04

analysis.

9:05

Uh B6 is a letter from Specialized

9:08

Education, the parent company of uh

9:10

Capital Academy, providing information

9:12

of the students using the property uh to

9:15

park to attend school. Uh B7 is the deed

9:18

to the property establishing applicant

9:20

standing to pursue the requested zoning

9:22

relief. B8 planning bureau case report

9:25

and B9 is the uh city of Harrisburg

9:28

planning commission resolution. So it's

9:30

B1 through B9 and I'll have uh start

9:34

with council. Go ahead.

9:36

>> Thank you. Good evening. My name is Ash

9:38

McCobi. I'm an attorney with

9:41

100

9:43

Pennsylvania. Sitting to my right is

9:45

Josh Gray, a GNRP

9:48

applicant

9:50

property.

9:52

>> Let me just then swear in and then you

9:54

can run with it. Okay.

9:56

>> Uh Mr. Gray, do you swear affirm to tell

9:58

the truth, the whole truth, and nothing

9:59

but the truth?

9:59

>> I do.

10:00

>> Okay. Proceed.

10:02

>> I'll give a brief overview and

10:04

introduction and then Mr. Gray will

10:06

testify on a couple points. We only have

10:08

one exhibit for this evening, so I hope

10:13

property

10:19

houses.

10:39

There is sufficient public

10:41

transportation in the area nearly

10:44

drive

10:46

back. We had a parking analysis

10:53

maxi

10:55

day with the addition of students.

11:06

However, as

11:08

reports out,

11:22

as I said, I have just one

11:27

question.

11:28

>> Hold on one second. As we usually do,

11:30

and I just turned it over to you, uh,

11:33

Mr. tonight. Why don't you go through

11:35

then then your report and then attorney

11:37

McCome will get right to you. Okay.

11:38

>> That was my chance to defer everything.

11:43

>> Well, I'm glad it wasn't continuing.

11:44

Then I might have cut, you know, just

11:46

like you know what. Okay.

11:48

>> Uh yeah. So, uh as the applicant noted,

11:51

um the issue at hand here is uh the uh

11:55

relief um from the off- streetet parking

11:57

requirements for a school public or

11:59

private, primary or secondary use. uh on

12:02

the existing use on site, the Capitol

12:04

Academy. Uh the student population is

12:07

increasing from 115 students to 147

12:09

students and the staffing will increase

12:11

from 40 staff to 52 staff, which will

12:14

increase the all street parking

12:15

requirements from 69 spaces to 89

12:18

spaces. As the applicant notes, there

12:20

will only be 72 spaces on site after

12:22

installation of the modular classrooms

12:24

in the parking lot and reconfiguration

12:26

of a portion of the parking lot in the

12:28

northeastern corner. Um zoning hearing

12:30

board approval of the special exception

12:32

is required for relief from 17 off all

12:34

street parking spaces. Um as the

12:37

applicants generally speaking as the

12:39

applicants noted um you know they had a

12:42

parking study done for their use which

12:44

is you know certainly a more robust self

12:47

analysis than uh we often get for

12:49

similar requests. Um and um as they

12:52

noted, most of their um students are bus

12:55

or uh dropped off and u many of their uh

12:59

faculty uh take mass transit to the site

13:02

uh such that um they uh only require

13:06

somewhere in like the neighborhood of 35

13:09

spaces currently and 39 spaces uh under

13:12

the proposed conditions. So there's

13:14

certainly sufficient um parking on site

13:16

to accommodate this uh uh request. Um,

13:20

not only does the uh applicant meet uh

13:23

the conditions of, you know, having uh

13:26

access to mass transit routes, but

13:28

they've also done the comprehensive

13:29

study demonstrating um that uh the

13:32

requirements in the zoning code are um

13:34

in excess of what they are uh they they

13:37

do require and they will require going

13:39

forward. It should also be noted that um

13:41

the applicants uh need to expand the

13:44

facility uh basically requires them to

13:47

locate in the uh front of the property

13:50

uh where the park which is almost

13:52

entirely occupied by the accessory

13:54

parking lot on site. Uh the floodway

13:57

runs right to the west of where uh these

14:00

trailers these modular classrooms will

14:02

be located. So, uh it would have

14:04

significantly complicated uh any

14:05

proposal to either expand the building

14:08

on site or build um additional classroom

14:11

space in the back of the building uh

14:13

where the applicants do have space uh

14:15

just because of the flood plane and more

14:16

specifically the flood way uh

14:18

designations. Um so with all that being

14:21

said, uh the planning commission uh

14:24

recommended that the zoning hearing

14:25

board approved the request for the with

14:27

the following conditions.

14:29

The applicant must coordinate with

14:30

Capital Region Water regarding the site

14:32

disturbance and proposed reconfiguration

14:33

of the parking lot to ascertain what

14:35

storm water mitigation efforts will be

14:37

necessary. And while I don't think

14:39

they're increasing the impervious

14:40

surface on site, I don't know. Um I'm

14:42

not an expert in CRW's regulations and

14:46

anytime you do any sort of earth

14:47

disturbance, they may require some sort

14:49

of um may require the site to be brought

14:51

into compliance with their current

14:52

regulations. Uh and then as the proposed

14:55

parking configuration will have vehicles

14:57

facing the residential properties across

14:58

Cameron Street, uh the BL plan Bureau is

15:01

recommending that the applicant relocate

15:02

the parking lot several feet to the west

15:04

and install landscape screening along at

15:06

least the eastern frontage of the

15:08

proposed um reconfigured lot area. And

15:12

just for aesthetics sake, we'd probably

15:14

recommend that the the landscaping be

15:16

extended uh to the entire Cameron Street

15:19

frontage of the property. And uh the

15:22

planning commission recommends that

15:23

zoning hearing board approve the request

15:25

for the following reasons. The applicant

15:28

has met the criteria necessary for

15:29

approval of a special exception and that

15:31

the proposal should have a negligible

15:33

impact on the surrounding neighborhood.

15:35

Uh because the use is already operating

15:36

on site, approval of the proposal will

15:38

not alter the essential character of the

15:39

neighborhood, will provide benefits such

15:41

as the ability to enroll new students.

15:44

Um, as previously noted, although not in

15:46

the uh case report of the uh resolution,

15:49

um the applicants cannot locate a the

15:52

modular trailers at the rear of the

15:54

property. Uh so they do have to occupy

15:56

uh some portion of the parking lot. And

15:58

then finally, if the conditions of

15:59

approval are adopted, the project will

16:01

result in the property overall being

16:03

brought into better conformance with the

16:04

zoning code.

16:11

>> Just just offer to the make things more

16:14

efficient given support we have from

16:17

city planning department

16:26

I'd be okay with giving you over

16:33

>> No that's good yeah go ahead

16:35

>> I will hand out I

16:41

A1

16:45

as we continue to work through the

16:47

project

16:49

office

17:05

did receive

17:06

approval on the building permit for

17:08

those. So, I'm giving you that only

17:10

because the only change on there are the

17:12

numbers raising it 18 in. Nothing else

17:15

has changed.

17:18

As Jeff pointed out, the building itself

17:20

is in the floodway.

17:26

So, there's no real way for us to expand

17:28

the building. Certainly

17:31

build options.

17:35

um learn from from the school that they

17:38

they need to expand or they need

17:41

options

17:43

like to keep them. I think it's a great

17:46

property and a great

17:51

menting

18:15

And then we do have

18:17

two bus stops, public transportation

18:20

stops.

18:25

With all that kind of being said, I

18:27

think we're comfortable with both

18:29

conditions. At the planning commission

18:31

meeting, I mentioned planning

18:33

commission. I want to talk to my client

18:34

a little

18:41

certainly.

18:45

That's really all all we had. Those are

18:47

kind of the highlights. So, if you have

18:49

any questions, happy to answer them.

18:51

>> And uh to uh Mr. Gray, you've heard what

18:56

uh your attorney has mentioned. Um would

18:59

you adopt that as you know any of the

19:01

factual statements he made as your

19:03

testimony that it was accurate and all

19:05

that?

19:05

>> Yes.

19:06

>> Okay. Okay.

19:09

I I can add

19:11

Josh. Have you reviewed the narrative

19:14

application?

19:15

>> Yes.

19:16

>> To the extent

19:18

or adopt the comments?

19:21

>> Perfect.

19:30

just was going to ask, I mean, is there

19:31

any um conditions related to the school

19:34

that you would think would uh cause an

19:36

immediate increase in the need for

19:38

parking compared to the 35 I think that

19:42

or 39 that you all mentioned?

19:44

>> Um I I don't I don't think so. Um

19:47

basically the audience of student that

19:50

they go with is academically behavioral

19:55

challenging they bring in and a lot of

19:57

times uh they're robust dropped off. So

20:00

even if there was growth you know

20:02

typically speaking they're not the type

20:04

of students.

20:06

>> Gotcha. So and they serve central

20:08

Pennsylvania and 29 school districts but

20:12

um they are growing and

20:16

I can't think of anything that would you

20:18

know I think even say 40 would still be

20:20

32 spots there

20:22

>> and I can't think of anything we've

20:25

really spent a lot of time on that

20:28

>> and

20:32

athletic event

20:35

>> yeah one of the nice things with the

20:37

school is that

20:41

>> right

20:43

>> they serve a need for the public schools

20:45

and

20:49

the capital academy

20:52

for the students at the regular school.

20:57

>> That's right. Right. Thank you.

21:02

>> Look at I don't I don't have any

21:05

questions. Mr.

21:10

>> But I I will I one of the in the report

21:13

it basically said you're going to maybe

21:16

uh put some type of fencing or something

21:18

up to cut down on the glare. And I I

21:22

don't know how I'm going to say this.

21:24

There's no houses there. So what are you

21:26

what are you cutting down the glare

21:27

from? It's just empty on one side. It's

21:30

empty. Just an empty lot. What was what

21:33

was the need for that? I think the idea

21:35

is across Cameron Street there's an

21:37

apartment.

21:38

So I don't know fence but some sort of

21:41

bush something.

21:43

>> Okay. Further down.

21:44

>> I think they were looking for some form

21:45

of landscaping to create a barrier

21:47

between the sidewalk and kind of our

21:50

campus. If anything it' be more

21:51

beneficial for us.

21:56

>> I think our tenant would enjoy it more

21:58

than anybody because it's going to give

22:00

them a little bit more privacy for them.

22:03

So I think it's a good aesthetic request

22:06

that Jeff had and I think if anyone's

22:07

>> gonna

22:12

thank you.

22:16

Okay. So,

22:22

>> so I'd like to make a motion that for

22:29

God, I get the numbers right. For

22:31

application 2620,

22:34

we

22:36

accept the U applica or we approve we

22:39

approve the application based off of the

22:42

recommendations from the planning

22:43

bureau. the uh All right. So, right, you

22:47

make a motion to approve application

22:49

2620 with the conditions sent by the set

22:53

by the planning commission. Correct.

22:55

Okay, that's the motion. Mr. Hobs,

22:57

>> second.

22:59

>> All in favor?

23:00

>> I

23:00

>> I

23:01

>> Okay, it's approved and obviously the

23:04

written decision then will be uh sent

23:06

out within the 45 days. Okay.

23:08

>> All right.

23:10

>> Thank you.

23:12

like this.

23:16

Okay,

23:18

>> you okay with any questions?

23:21

We should pass you

23:49

Um, I mean, I would I would ask uh that

23:53

it continued to be granted being that I

23:55

think the I think the issue at least

23:58

from my perspective of um uh from the

24:01

board was less maybe the substance of

24:04

the request than it was uh the

24:07

technicality of whether they had

24:08

ownership or approval to use uh the

24:11

property at 1625 Cumberland Street uh to

24:14

ensure that they had the required off-

24:16

streetet parking. Um so I I I mean

24:19

speaking on behalf of the the

24:21

applicants, you know, I would request

24:23

that uh continuence be granted perhaps

24:27

to the January uh meeting. We don't have

24:29

the dates for that uh just yet. Um but

24:33

uh and then I would solicit a formal

24:35

continuence request from them after this

24:38

meeting.

24:39

Right.

25:08

Request it.

25:20

Okay.

25:30

because our concerns were

25:38

>> right.

25:40

>> He has right

25:48

>> and also you know

25:55

Yeah.

25:56

>> Why a question? What what has been the

25:59

recent communication with the applicant?

26:01

>> Um, you know, there was I think a little

26:05

I think there was an email immediately

26:07

after um the last meeting and then I

26:10

believe I copied uh uh BCC to Mr.

26:13

Okconor, Mr. Posh this morning when I

26:16

apprised them of exactly what we were

26:18

looking for and I said, you know, you

26:19

can either bring that to tonight's

26:20

meeting or you can either drop it off in

26:23

the planning bureau beforehand or email

26:25

it to us. Um, so we did we did apprise

26:27

them that they were expected to show up

26:29

to tonight's meeting. Um, and what exact

26:32

documentation um, the board was looking

26:34

for,

26:35

>> but did they give a direct response?

26:38

>> I don't I don't think I got a response

26:40

from them today. No. But also right, you

26:44

requested right after the last meeting

26:46

to just tell them

26:48

>> again, you know, you know what it what

26:50

it was. The only

26:53

is that usually then where you get that

26:55

written request, which you know, we've

26:57

done tons of times, but it's just like

26:58

we need that written and we always say

27:00

we we do need it.

27:01

>> Yeah.

27:01

>> You don't then need to show up. We just

27:03

need that written request so then you

27:05

can grant because it's not

27:06

>> you can't just say we request it you

27:09

know and unfortunately

27:11

>> and unfortunately you know Mr. You know

27:13

Mr. Knight could even though with good

27:15

intentions

27:16

>> you know what I mean and that's just the

27:18

that's just a concern

27:20

>> to do it

27:22

>> they can reapply or is there any cost

27:24

associated with that relication? Um, I

27:28

mean, normally we kind of review every

27:30

new application as being a distinct

27:32

submission, but I mean, in a case like

27:34

this, especially it's in a bit of a

27:37

unique scenario where we're at the end

27:39

of the year, so this is pushed back a

27:40

little further than it would normally

27:41

be. Um, so um, you know, it may be, uh,

27:46

that we would be willing to wave the fee

27:48

because I think it'd be relatively

27:49

prefuncter to go back through the

27:50

process again, certainly to the planning

27:52

commission to get back to here,

27:55

>> you know. So, so I wouldn't I wouldn't

27:57

foresee us having to develop a lot of

27:59

new documentation. For example, the case

28:02

documentation would all be the same. It

28:04

would just be, you know,

28:05

>> just redocket.

28:06

>> Yeah. Yeah. And it would all be like the

28:08

same and and then the question would

28:10

just come in be a lot easier than if he

28:12

even just had it,

28:14

>> you know, then be a few questions in in

28:16

January, February, whatever

28:18

>> time it is. Yeah.

28:20

>> You know what I mean? So,

28:22

>> and who knows, you know, if there's

28:25

something else going on, you know, with

28:27

it because I know what the agreement

28:29

said that within 60 days, which was the

28:32

last meeting, that he had to have so

28:34

much in cash

28:35

>> to get the deed

28:38

>> and if not, then he wasn't going to get

28:39

the deed. It would still continue on

28:41

that he could come up with it. But, you

28:43

know, not knowing any of that I either,

28:46

it might just be,

28:49

>> you know, the better practice just to do

28:51

that. And if it does then come in then

28:54

perfectly fine and everything can go

28:56

smoothly at that time. Yeah. So

29:02

why don't you go on?

29:03

>> I'm I'm ready to get this

29:04

>> here. Why don't you go on? Yeah. Just

29:06

say

29:06

>> I am. Okay. So I u

29:08

>> hold on. So this is then for application

29:11

2617.

29:13

It was continued from the October 20 uh

29:16

meeting

29:18

um when applicant uh was here. It was uh

29:21

uh Mr. Larry.

29:23

>> Yes. Correct.

29:24

>> Was his first name?

29:25

>> Abdul Larry, I believe.

29:26

>> Okay. Abdul Larry. Um and he was advised

29:28

that it would be continued to the

29:30

current uh date, November 17. Um and Mr.

29:35

Knight, I understand that then uh also

29:37

an email was then sent this morning

29:39

reminding of what documentation

29:42

uh Mr. Lair needed and that he could

29:45

bring it to tonight's meeting and so on.

29:48

Correct.

29:48

>> Uh that's correct. Yeah.

29:49

>> Okay.

29:50

Um and we waited what time is it?

29:53

>> 6:30.

29:55

>> 6:30. Okay. And and nobody has appeared

29:59

on behalf of um applicant. What we were

30:03

uh uh requiring from the last meeting

30:05

was um some sort of agreement or uh as

30:10

part of the sales agreement um um

30:12

authorizing

30:14

um applicant to use the 1616 her street

30:18

or and and 1625 Cumberland Street

30:22

parking lots for parking for the place

30:24

of worship at 1100 North 17th Street

30:28

which didn't have any available the no

30:30

space or anything for off streetet

30:32

parking. Um so that documentation hasn't

30:35

been received. Um and then with that so

30:38

the record would be closed

30:40

>> and then a motion can then be made from

30:44

from there.

30:45

>> Okay. So,

30:46

>> and just sorry, one more point before I

30:48

and I don't know if this needs to be um

30:51

explicitly stated, but I know in the

30:53

past uh there have been denials without

30:54

prejudice uh that it was basically on a

30:57

procedural aspect such as this or a

30:59

technicality, I think, as opposed to

31:01

saying like we disagree with the

31:04

proposal that's going out there. So, I

31:05

don't I don't know if that needs to be

31:07

stated separately when going through

31:09

this for the process. I I can probably

31:13

say right in the decisions that all I

31:15

would say is why it would be denied is

31:18

just that those agreements were not

31:21

being provided really that's exactly you

31:24

know what u the basis for it so almost

31:27

even letting applicant know okay that's

31:30

then what I need

31:31

>> okay

31:32

>> because I'll go through all the fact you

31:33

know what I mean I'll go through all the

31:34

facts and all all that type of thing and

31:36

just really point that that is the that

31:38

would be then then the issue that and

31:41

the board that would sign,

31:42

>> right? Denial is based off the fact that

31:45

um ownership of the lots that he's

31:47

proposing to use in support of his

31:50

support of the project.

31:51

>> Yeah.

31:51

>> Okay. And that's all I mean again and

31:53

we've we've asked to bring that

31:56

information in front of us. Okay. It's

31:58

more protection for him. He has proper

32:00

ownership. He has proper ownership or

32:03

usage rights. Okay. Now, we're asking

32:05

for us to see that documentation.

32:07

>> Yeah. And I and I just I had recalled

32:09

that that terminology had been used

32:11

before. I didn't know if that was

32:13

prudent to use in the current situation

32:15

or not.

32:16

>> So um

32:20

so I'm I'm making a motion for for

32:23

application 2617.

32:26

We denied the request.

32:29

>> Okay.

32:29

>> Right. Deny the application.

32:30

>> We deny the application. And

32:33

>> that's it.

32:34

>> Second.

32:36

move and properly second. Uh all in

32:39

favor any questions?

32:41

>> All in favor?

32:42

>> I

32:42

>> I

32:44

deny and he can refile again.

32:47

>> And all this is on anybody. You can

32:51

>> So there's no hardship with that. That's

32:53

that was my concern was that would a

32:55

refile force of hardship? I don't think

32:57

so.

32:58

>> No,

32:59

>> we're getting some time protecting his

33:01

right. We're protecting his rights.

33:03

Okay. Because if we granted All of a

33:05

sudden there's a legal issue.

33:06

>> Yeah.

33:07

>> Um it's going to cost some more to

33:09

resolve that.

33:10

>> Sure.

33:11

>> Okay. So here

33:13

>> um we have another cases in front of us

33:15

tonight. Um as you said we do not have a

33:17

meeting in December, right? We have it

33:19

in January.

33:20

>> That is correct.

33:20

>> So okay. So everybody I'll make a motion

33:23

to adjurnn.

33:25

>> Second.

33:25

>> Okay. Move properly second. Uh all in

33:28

favor? I. Okay. I see you January.
