Summary

The Harrisburg Zoning Hearing Board approved four major applications, highlighting the successful adaptive reuse of long-blighted properties on State Street and 13th Street into multifamily housing, alongside an administrative correction that simplified a riverfront zoning approval.

This session illustrates the mechanics of Pennsylvania municipal zoning, demonstrating how strategic property consolidation and zoning corrections can eliminate structural barriers to private redevelopment without requiring public funding.

Section summaries

0:00-1:36

Meeting Preamble and Oaths

optional

Board Chairman Claude Fipps opens the meeting, noting that the agenda consists of continued cases from January due to weather cancellations. Zoning Hearing Board Solicitor Michael O'Connor reads the procedural preamble and swears in Planning Director Jeff Knight.

This is standard meeting procedure and administrative setup without project details.

1:36-8:00

Case 2622: HACC Fence Variance Presentation

watch

Planning Director Jeff Knight presents a variance request by Harrisburg Area Community College for an 8-foot fence to secure a deep retention pond near Paxton Creek at the fire training facility. The proposal includes a shorter 4-foot section to allow fire academy staff to perform training drills.

It explains the dual safety and operational motivations behind the fence height variance.

8:00-12:48

HACC Testimony and Approval

optional

Mike Deeporta of HACC explains that public greenbelt trail users wandering near the pond create liability concerns. The board queries pest control on the standing water, learns the water is circulated daily by drills, and unanimously approves the variance.

It confirms the safety details and ends with a swift, predictable vote.

12:48-19:12

Case 2621: 100 North 13th Street Introduction

watch

Jeff Knight introduces an adaptive reuse project converting a blighted, 20-year vacant printing press into 12 apartment units. Thanks to the consolidation of adjacent vacant lots on Linden Street, the developer has resolved previous density and parking variance requirements.

Provides critical details on how consolidating land solved persistent zoning roadblocks.

19:12-27:12

100 North 13th Street Testimony and Approval

watch

Developer Jared Neil and Attorney Ash McComi detail the private financing of the project and confirm that environmental reviews revealed no chemical contamination. Board members discuss neighborhood affordability and urge coordination with the school district regarding a nearby bus stop.

Covers environmental safety, community-level pricing, and public safety issues.

27:12-33:36

Case 2623: 1512 State Street Presentation

watch

Jeff Knight outlines a proposal to convert a severely deteriorated, 25-year vacant duplex into a 3-unit multifamily building. Due to a partial roof and wall collapse, the structure is at risk of complete failure if zoning relief is not granted.

Explains the high-stakes structural decay and the architectural preservation recommendations.

33:36-46:24

1512 State Street Testimony and Approval

watch

Jared Neil explains that gutting the building to the joists is required to save the historic shell and stairs. He highlights that a single-family restoration is economically non-viable. The board discusses mini-splits, floor plans, and approves the variances.

Important discussion on the economics of urban blight remediation and historic preservation tradeoffs.

46:24-54:24

Case 2624: 2140 North Second Street Zoning Correction

watch

Jeff Knight corrects an administrative error, clarifying that the property sits in the Riverfront district where there is no density regulation. This change eliminates the variance requirement, leaving only a special exception request for multifamily conversion and off-site leased parking spaces.

Demonstrates how zoning district classifications dramatically impact the required relief.

54:24-1:02:24

2140 North Second Street Testimony and Adjournment

optional

Steven Tulle presents letters of support from neighbors and commits to providing one legally affordable unit. Tulle details his lease for four adjacent off-site parking spaces and his familiarity with local floodplain rules before the board approves the special exception and adjourns.

Finalizes the Second Street case and concludes standard meeting business.

Key points

  • Land Consolidation Eliminates Regulatory Obstacles — By acquiring and consolidating adjacent vacant lots on Linden Street, the developer for 100 North 13th Street legally met density and parking requirements by right, eliminating two previous zoning variance requests.
  • Single-Family Rehabilitation is Economically Unviable for Severe Blight — Restoring 1512 State Street as a single-family home was financially impossible due to extreme structural rot since 1998, leaving a multi-family conversion as the only way to secure bank financing.
  • Zoning District Corrections Can Simplify Development Paths — An initial Planning Bureau oversight classified 2140 North Second Street under a residential medium density zone, but correcting it to the Riverfront zone eliminated a difficult density variance request.
the proposal involves fully enclos enclosing a um not too large uh uh retention pond on the east side of the uh uh training academy uh between the academy and Paxton Creek. Um however the uh f the retention plan itself is fairly deep. Jeff Knight
there is just a massive amount of work that needs to be done to bring this up to where it can where we can really work on it. Jared Neil

0:00

in January because it was just too much

0:03

snow. Okay. And I was praying we was

0:05

going to have one this month, but it

0:07

didn't work that way. So, but yes, and

0:10

the cases we're going to hear tonight

0:11

are continuations

0:13

from the January time frame since we we

0:16

didn't have that meeting. So, I'm going

0:18

to introduce to my right, Mr. James

0:22

Hobs. Okay. Myself, Claude Fipps. And

0:26

I'm going to turn it over to our Well,

0:28

>> go ahead. That's fine.

0:30

and our director of planning is Miss

0:33

Knight

0:35

and Miss Cameron. She's in for the

0:37

solicitor's office. Okay. Paris

0:39

solicitor. Okay. So, I'm going to turn

0:41

it over to our solicitor and he'll go to

0:43

our normal preamble and again.

0:47

>> Okay. Um Michael O' Conor um the

0:51

solicitor uh for the zoning hearing

0:52

board. Um so we're here tonight. We have

0:55

uh four uh cases. They were nothing new

0:59

for this month. They were all

1:00

continuations from uh January. Um as

1:05

this is a uh tonight there are hearings.

1:08

So uh all testimony will be taken under

1:12

oath. Uh witnesses will be sworn in. Uh

1:15

applicants any other witnesses and

1:17

obviously uh Mr. Knight who we will do

1:20

now. Um if the stenographer can please

1:23

swear in Mr. Knight.

1:28

I do. Okay. And obviously we have a

1:31

stenographer here to my left. Um he is

1:34

taking everything down. So uh only one

1:36

person speak at a time to make his job

1:38

easier. Um and Mr. Knight, you will

1:41

obviously be considered sworn in for

1:43

each of the applications. Okay. All

1:46

right. Uh we are going to take these out

1:49

of order as cases 2621, 2623, and 2624.

1:56

um are being handled by the same

1:58

council. So, uh we figure we will handle

2:00

those in order. Uh but first, we will do

2:04

case 2622.

2:06

Um it is a variance for 3,300 North

2:10

Cameron Street if the applicant wants to

2:13

um come up for that. And I will start

2:16

off though at least reading in um the

2:19

exhibits and then u we'll turn it over

2:23

to obviously Mr. night to give a summary

2:26

of the case and then um have the

2:29

applicant sworn in and go from there. So

2:31

we have B1, the proof of publication,

2:34

Patriot news um and B2 uh letter uh that

2:39

was sent uh from the planning director

2:41

to applicant notifying uh of the

2:44

hearing. B3 hearing notice posted on the

2:47

property. B4 notification letters sent

2:50

to the required neighbors. Uh B5 is the

2:54

application packet with the attached

2:56

narrative, photos of the existing

2:58

condition on uh conditions on the

3:00

property, aerial photos of location of

3:03

the project, and a site plan for the

3:05

project. B6 is the deed to the property

3:08

establishing applicant standing to

3:10

pursue the requested zoning relief. B7

3:13

is the planning bureau case report and

3:15

B8 is the city of Harrisburg Planning

3:18

Commission resolution. Um also um adding

3:22

on to those those are typically uh uh

3:24

the board exhibits. Uh as I mentioned

3:27

the last me uh hearing was continued. So

3:29

B9 is the email dated January 26, 2026

3:33

from the applicant requesting the

3:35

continuence till until tonight's u

3:38

hearing February 23, 2026.

3:42

And then uh the proof of publication of

3:44

tonight's um uh hearing in Patriot News

3:48

February 8, 2026 and February 15, 2026.

3:53

Um also the when I did the B1 that was

3:55

for the January uh meeting. So with

3:59

that, uh why don't we turn it over to

4:00

Mr. Knight and he can give a uh summary

4:03

of the case um and then we'll have

4:06

applicants sworn in and go from there.

4:08

>> Uh sure. Uh so good evening. Um the uh

4:12

request for case number 2622

4:15

is uh a variance application

4:19

uh to for the property at 3300 North

4:22

Cameron Street uh which is the Hack

4:25

campus. Um, and the proposal is to

4:27

install an 8-ft high fence with a short

4:30

uh 4ft high section enclosing a

4:32

retention pond associated with the fire

4:34

training facility on site which requires

4:36

on hearing board approval of a variance

4:38

application for a fence exceeding the

4:39

maximum 6 ft in height in the INS

4:41

district. Um as uh shown in the photos

4:46

uh provided by both the planning bureau

4:48

and the um applicants and as noted in

4:50

the discussion uh the proposal involves

4:53

fully enclos enclosing a um not too

4:56

large uh uh retention pond on the east

5:00

side of the uh uh training academy uh

5:03

between the academy and Paxton Creek. Um

5:06

however the uh f the retention plan

5:09

itself is fairly deep. Um and so there

5:11

certainly is justification uh for uh

5:14

ensuring that um for liability reasons

5:17

and safety reasons that people can't

5:18

access um the uh retention pond. Uh as

5:22

noted in the case report, there is an

5:24

existing section of 8ft high fence along

5:26

the eastern and southern edge uh of this

5:29

retention pond. So the project uh just

5:32

proposes to finally enclose uh the

5:35

northern and eastern edges of the pond.

5:37

Um the reason that there is a short 4

5:40

foot high section is because that was

5:41

requested by um staff at the fire

5:43

training academy uh which I guess was

5:46

necessary for them to uh discharge their

5:48

hoses. So they put it over the fence. Um

5:50

so it's not like something where if you

5:52

had like a little gate or something in

5:54

the fence you could kind of like feed

5:55

the hose through. it seems like it's

5:57

kind of an operational necessity uh for

5:59

what they do at the training academy. Um

6:01

and so uh for that reason uh that was

6:04

the only um condition of approval that

6:07

was uh included in the city in the

6:10

planning bureau's case report. Uh and uh

6:13

the condition was adopted uh by the

6:16

planning commission. But uh I would say

6:19

that um the discussion at the meeting um

6:22

kind of

6:24

led to just the incorporation of that um

6:28

uh condition in the case in the

6:30

resolution. But I don't think there was

6:32

necessarily a strong feeling by the

6:33

planning commissioners that it was you

6:34

know necessary to retain that condition

6:36

to to keep the uh fence 8 foot high all

6:39

the way around the uh retention pond. Um

6:42

so although that is included as a

6:44

condition you know I think both the

6:45

planning bureau and the planning

6:46

commission understand uh that that's

6:49

might be uh create issues from an

6:51

operational perspective uh for the

6:52

training academy and so for that reason

6:55

uh would be okay if that were not

6:57

included in an eventual uh resolution or

7:00

decision of the zoning hearing board. Uh

7:01

with that all being said the planning

7:03

commission recommended the zoning

7:05

hearing board approved the request for

7:06

the following conditions. Uh the

7:07

applicant does not clarify in their

7:08

submission why there is a 4 foot high

7:10

portion of the fence and given the

7:11

reasonable safety and liability

7:12

justifications necessitating an 8 foot

7:15

high fence. The planning bureau

7:16

recommends the applicant install an 8

7:17

foot high install 8ft high fencing

7:20

around the entire perimeter of the

7:21

retention pond. And again uh due to

7:23

those reasons we discussed um we are

7:25

okay if the board chooses not to retain

7:27

that uh condition. Uh the planning

7:29

commission recommends the zoning hearing

7:31

board approve the request for the

7:32

following reasons. There is sufficient

7:34

justification for the installation of a

7:35

fence taller than permitted by right

7:37

given that it is intended to ensure

7:39

safety and reduce liability by

7:41

preventing unauthorized access to a

7:43

retention pond associated with the

7:44

adjacent fire training facility.

7:46

Additionally, the size of the property

7:47

and accommodation of training facilities

7:49

create unique site conditions that

7:51

support the request. Uh there are

7:53

existing stretches of 8ft high fences

7:55

along the eastern and southern frontages

7:57

of the retention pond and thus the

7:58

proposed fence will match non-conforming

8:00

fences that have existed for several

8:02

decades. And finally, the project

8:04

location is minimally is minimally

8:06

visible from the public right ofway and

8:08

will thus have a negligible impact on

8:09

the surrounding built environment. Uh

8:11

which it should also be noted um most of

8:14

the uh adjacent properties on the west

8:16

side of uh industrial road are

8:18

industrially zoned which does permit

8:20

fences up to 8 ft in height. So it would

8:22

not detract from the character of the

8:23

neighborhood.

8:27

>> Okay. Um All right. Um, and who is here

8:32

for the applicant?

8:33

>> My name is Mike Deeporta. I'm the

8:35

director of construction early for

8:37

Harrisburg Area Community College.

8:39

>> Okay. Um, could you swear them in?

8:45

>> I do.

8:46

>> Okay.

8:48

Um, so why don't you um tell the board

8:51

why uh they should grant your u

8:54

application,

8:56

the variance application. Go ahead. Uh

8:59

we part of the issue and the thinking

9:02

here is that we have the green trail

9:03

that runs through the front of the the

9:08

west side of the lot. So we have a lot

9:10

of bike riders and small families that

9:15

walk through the campus and we want to

9:17

avoid the potential liability of you

9:20

know anyone fishing in the pond but a

9:23

child coming through and getting

9:26

anywhere near the pond. So to match the

9:29

uh existing fence line that exists uh

9:31

for aesthetics, we'd like to install as

9:34

much 8ft fence as we can, but we do have

9:36

some operational needs in the front of

9:38

the pond fencing area where we will be

9:42

required to put a 4ft fence in if

9:44

possible

9:46

>> and that's necessary as Mr. Knight was

9:49

saying operationally for the hoses

9:51

easier to get over those fences. just

9:53

said,

9:54

>> "Yeah, it was a request by the director

9:55

of the firefighting academy uh for

9:57

draining and they do a few drills where

9:59

they line up in parallel. So there's a

10:01

concrete pad in front of the pond. So

10:03

they line teams up in parallel. So they

10:06

do some do some drills in that area. 8ft

10:08

fence would make it virtually impossible

10:10

to do any of those things.

10:11

>> Okay.

10:14

Board can ask questions.

10:26

I don't have to ask any questions, but I

10:27

for you. Um,

10:30

primarily this is for safety purposes to

10:33

basically keep people out of the pond

10:35

area. Correct. Correct. Okay. It's

10:37

basically reduce your liability cost.

10:41

You do have standing water there. So, in

10:44

the summer when it gets warmer in the

10:46

summer, how are you going to handle pest

10:48

control? Because the standing water

10:50

mosquito

10:52

mosquito mosquito being place because

10:55

again some of the creeks some of the

10:57

ponds in this area they have to go out

10:59

and spray every so often to cut down on

11:02

the flying pest.

11:05

>> Well the so the pond water is in motion

11:08

almost daily through the firefighting

11:10

operation. Uh when we designed the fence

11:13

line we designed it in a manner with

11:15

fences and set back from the the front

11:18

edge of the pond where uh

11:21

where our internal teams could get in

11:23

and clear any overgrowth and rush out

11:25

fairly easily.

11:27

>> That was, you know, question was

11:29

standing water.

11:32

>> That's the only questions I have. Thank

11:33

you.

11:38

>> Okay.

11:39

>> Okay. Is there anybody here from the

11:41

public that wants to make any comment um

11:44

on this application?

11:46

Okay. Seeing none. And um applicant,

11:50

anything else to add?

11:53

>> No.

11:53

>> Okay.

11:54

>> So, I'll make a motion that um we grant

11:59

the variance for the 8 foot high fence

12:03

for this property.

12:05

>> Okay. Is there a second?

12:08

>> Second.

12:09

>> Okay. All in favor?

12:11

>> I

12:11

>> Okay. And that's approved. So, there'll

12:13

be a written decision that will then be

12:16

uh sent to you. um within 45 days. It'll

12:19

be probably sooner than that. Okay.

12:22

>> Thanks.

12:22

>> Excellent.

12:23

>> Thank you.

12:45

Okay.

13:03

Okay. So,

13:05

the next application

13:08

is 2621

13:10

100 North 13th Street.

13:16

Okay.

13:18

And I will read in the exhibits then uh

13:22

turn it over to Mr. Knight um for a

13:25

summary and then we'll go to uh

13:28

applicant and council for applicant. So

13:32

we have exhibit B1 proof of publication

13:35

in Patriot News January 11 January 18

13:38

2026. B2 is a letter sent from the

13:42

planning director to applicant notifying

13:44

of the hearing. B3 hearing notice posted

13:46

on a property. B4 notification letter

13:49

sent to u uh required neighbors. B5 is

13:54

the application packet with attached

13:56

narrative photos of existing conditions

13:58

on the property site plan and floor

14:01

plans for the proposal. Uh B6 is the

14:04

deed to the property establishing

14:06

applicant standing to pursue the

14:08

requested zoning relief. B7 is the

14:11

planning bureau case report. B8 city of

14:14

Harrisburg planning commission

14:16

resolution. B9 is the email dated uh

14:21

January 26, 2026 from applicant

14:24

requesting continuence to tonight's u

14:28

hearing. B10 is the proof of publication

14:30

of tonight's hearing. It's published in

14:32

the Patriot News February 8 and February

14:35

15, 2026.

14:39

So with that, then I will turn it over

14:42

to Mr. Knight.

14:43

>> Uh yes, thank you. Uh so for case number

14:46

2621, uh involves uh the proposal of an

14:49

adaptive reuse for 100 North 13th

14:52

Street. Um

14:54

the proposal uh is to convert the

14:57

property into a 12-unit multif family

14:59

dwelling uh in the primary parcel at 100

15:02

North 13th Street uh with the uh

15:04

construction of an accessory parking lot

15:07

uh in vacant parcels immediately to the

15:10

west of that lot at uh along the 100

15:12

block of uh Lynen Street. Uh the

15:15

planning uh zoning hearing board members

15:17

may recall uh this project. It came

15:19

through in a previous iteration. Um the

15:22

zoning relief came through in uh April

15:24

of 2021 uh with the land development

15:27

plan um coming thereafter in March of

15:29

2022 for a very similar project. Uh it

15:32

was 12 units uh in the principal

15:34

building uh but they only had a um

15:38

believe a 12 space uh parking lot that

15:41

was only um accessible from Lynen

15:43

Street. Um and so that project required

15:47

um the zoning the special exception for

15:49

the use uh variance for the density and

15:52

then a special exception for relief from

15:53

the off- streetet parking. Uh in the

15:55

current iteration of the project uh the

15:57

applicant has secured um ownership of

16:00

all of the vacant lots along uh Lynen

16:03

Street and so what that means is it both

16:06

results in an overall large enough

16:08

parcel once consolidated uh to

16:10

accommodate the 12 units by right. Um so

16:13

a variance is not required for the

16:15

density and it also allows them to build

16:17

a 15 space parking lot which is large

16:19

enough to accommodate uh the required

16:21

off- streetet parking um for the 12

16:23

units and therefore that obviates the

16:26

special exception request for uh relief

16:28

from the off- streetet parking. Um and

16:31

so uh the current proposal is

16:33

essentially the same as the last one,

16:34

but due to the those um changes uh

16:37

recommended or those changes uh from

16:40

that previous iteration, uh the project

16:42

has two less zoning relief requests and

16:44

therefore uh we believe that this

16:46

project is uh more in conformance with

16:48

the zoning code and therefore um has

16:51

more justification for uh the request

16:53

that it is asking. Um the building

16:56

itself has been vacant. I believe we

16:59

looked for over 20 years. Uh it was

17:01

formerly a printing press company and I

17:03

believe it has some spent some of its

17:06

life as just incidental storage in it.

17:09

Um and so finding um an applicant who

17:13

can has a viable adaptive reuse for the

17:16

property uh will not only um address a

17:19

blighting influence on the neighborhood

17:21

and particularly at a fairly uh

17:22

prominent corner uh but will add

17:25

additional um housing units to the

17:27

inventory for the neighborhood

17:28

specifically and the uh city generally.

17:31

Uh therefore for that reason uh the

17:33

planning commission is recommending that

17:37

the zoning hearing board approve the

17:38

request with the following conditions.

17:40

Uh if granted approval for the requested

17:42

zoning relief, the applicant will

17:43

subsequently file a law consolidation of

17:45

land development plan and receive

17:46

approval from the planning commission

17:48

and city council. Uh and just to clarify

17:50

also the reason uh why uh the previous

17:53

land development plan is not still

17:55

active is because that plan was never

17:57

the final plan set was never recorded

17:58

with the North County Report of Deeds.

18:00

So that's why they couldn't just do it

18:02

by right. Um the applicant will submit a

18:05

certificate of appropriateness

18:06

application and receive approval from

18:07

HARB for the proposed parking area which

18:09

is located in the summit architectural

18:11

conservation overlay district. Uh the

18:14

properties along Lyndon Street are in

18:16

the AOD. Um but although the subject uh

18:18

the principal uh lot is not um and the

18:21

previous application uh similarly went

18:24

through HARB for approval for the

18:26

parking area. Uh the applicant will

18:28

coordinate with the Department of Public

18:29

Works and Capital Region Water to

18:31

confirm the appropriate size and

18:32

location of refuge collection on site,

18:34

update the building counts to reflect

18:36

the new use, and ensure that the

18:37

proposed site disturbance is reviewed

18:39

against requisite storm water management

18:41

regulations. Uh the planning bureau

18:42

recommends the applicant consider

18:44

installing fencing and closing the

18:45

proposed parking area in addition to the

18:47

required vegetative screening to provide

18:49

more security and access control to

18:52

reduce the headlight spillover from cars

18:54

into the lots across Lynen Street and

18:56

and to enhance the aesthetic impact of

18:58

the project. Bureau also notes that if

19:00

the required trees are not planted on

19:02

site, they can be planted in tree pits

19:03

in the surrounding rights way. And

19:05

finally, the planning bureau recommends

19:06

the applicant install the requisite bike

19:08

racks near the proposed entrance from

19:09

Walnut Street if possible. The bureau

19:11

would recommend the applicant consider a

19:13

secure indoor bike storage area that

19:16

near that entrance and access stairwell

19:18

since the building will not be equipped

19:20

with elevators. The planning commission

19:22

recommends the Harrisburg zoning hearing

19:24

board approved the request for the

19:25

following reasons. Subject property is a

19:27

unique industrial structure which has

19:28

been vacant for a few decades and has

19:30

experienced significant blight over that

19:32

time as well as small lots which have

19:34

been vacant for at least a decade. Any

19:36

project that can productively reuse the

19:38

property will provide a significant

19:39

aesthetic improvement for the

19:40

neighborhood. The applicant has

19:42

expressed an intention to provide 12

19:43

affordable apartment units. More quality

19:46

affordable housing units are pressing

19:47

need not only in the neighborhood but

19:49

throughout the city in general. And the

19:50

provision of more housing units will

19:52

help to combat rising housing costs. And

19:54

finally, if the conditions of approval

19:56

are adopted, the project will result in

19:57

the property being brought into better

19:58

conformance with the zoning code and

20:00

providing a more attractive development

20:01

for residents of the surrounding

20:03

community.

20:06

Okay. Uh then for applicant, if council

20:09

and applicant can introduce themselves.

20:12

>> Good evening. My name is Ash Mccomi. I'm

20:14

an attorney with Mcnes Wallace and Nurk,

20:16

100 Pine Street, Harrisburg,

20:18

Pennsylvania.

20:19

>> Jared Neil with Halton Horizons Group.

20:21

Uh 227 State Street, Harrisburg, P.

20:25

>> Okay. If you could swear an applicant.

20:33

Okay,

20:34

>> great. Thank you. Uh, I think Jeff did a

20:37

great job summarizing everything for us

20:39

this evening. I think the the

20:40

application's pretty thorough and gives

20:42

you a good idea. So, we're going to be

20:44

real real quick. Uh, Jared, what's your

20:46

role with Halden Horizons?

20:48

>> Uh, owner owner of Halden Horizons as

20:50

well as I oversee uh the development and

20:53

entitlement division. Does Halden own

20:56

the properties that are the subject of

20:57

the application?

20:58

>> Yes. Have you reviewed the application

21:00

and the narrative included with it?

21:02

>> I have.

21:02

>> And to the extent applicable, do you

21:04

adopt the comments made there and as

21:06

your own?

21:06

>> I do.

21:07

>> We're happy to answer any questions that

21:09

the that the board might have.

21:11

>> Okay.

21:13

>> Either one.

21:17

>> I can.

21:19

Okay. Hello. Uh, good evening,

21:21

gentlemen. Um, I had a couple of

21:23

questions. Um, because I remembered a

21:26

place 20 years ago was a print shop.

21:29

Have you gone through remediating that

21:31

ground in any which way? I know print

21:32

shops have

21:35

used chemicals that are carogenic. Um

21:39

has de looked at the ground to make sure

21:41

that nothing is leached through and it's

21:43

the ground is not you'd say poisonous.

21:46

>> Yeah. So as as part of our uh due

21:48

diligence, we did um hire a consultant.

21:51

uh they have completed a phase one um

21:53

and they're they're at this point just

21:55

um I think there was a a tank that they

21:56

wanted to uh remediate so that will be

21:59

pulled out but as far as any

22:01

contaminants nothing was noted.

22:03

>> Okay. My second question and I observed

22:05

this as I drive through Alter down to

22:08

the capitol um that corner is used by

22:13

Harrisburg school district as a pickup

22:16

and discharge for our school for

22:18

children. Okay. going to the middle uh

22:22

middle school and and the high school. I

22:24

understand the high school they can be a

22:25

little more safety conscious, but the

22:27

elementary school and the middle school,

22:30

they're using that ter that area for

22:33

pickup. I saw the recommendation was to

22:36

basically the parking areas, fence them

22:38

in or put some type of

22:41

fencing. Okay, maybe to stop intrusion,

22:44

stop, you know, mischief, unnecessary

22:46

mischief. So, have you considered that

22:48

at all?

22:50

Real quick, um, is are you talking about

22:53

the intersection of 13th and Walnut?

22:55

>> 13th and Walnut. Yes.

22:56

>> Yeah. They use that to drop pick kids up

22:59

and drop them off. Two different age

23:02

groups.

23:03

>> Yeah. So, the the parking is the

23:05

opposite side of the the block from

23:07

that. It's going to be back along Lynen

23:09

and Kalamus Street, but go ahead and

23:12

>> Correct. Correct. So, as as part of the

23:14

land development, um we will be laying

23:16

out the parking lot as as indicated and

23:19

shown. Um there will be some screening

23:21

and fencing shown along Lynen in

23:24

Calamus. Um as far as what what occurs

23:27

on 13th was really just going to be

23:29

landscaping and and clean it up a little

23:31

bit, replacing sidewalk where is needed.

23:33

That's what was contained in the scope.

23:36

>> Yeah, I was my next suggestion is maybe

23:39

reaching out to the school district,

23:40

letting them know that be aware that

23:43

This is granted where it's going to be

23:46

housing or it's going to be an apartment

23:48

there and for the kids if you're still

23:50

going to use it or maybe need to

23:52

relocate that their pick up and drop off

23:54

to maybe across the street or maybe walk

23:57

up so it's a little more safer for both

24:00

for for the residents and for the

24:02

children.

24:04

>> Yeah, I have no objection of reaching

24:05

out to the school district uh just

24:07

inform them of the project and make sure

24:10

there aren't any concerns. If there are,

24:12

I don't any reason we wouldn't be able

24:13

to work through it.

24:14

>> Okay.

24:15

>> Thank you.

24:16

>> Sure.

24:16

>> Thank you very much.

24:20

>> Good evening. Uh Mr. Neil, I don't have

24:22

necessarily a question. I was just

24:24

wondering if you could uh just describe

24:26

your vision for the the 12 units. I

24:27

didn't know if these are like um market

24:30

rate units or if you were planning for

24:31

like affordable housing, senior housing,

24:34

anything of that nature.

24:35

>> Yeah, absolutely. So, um, we looked at a

24:38

variety of different ways as we were

24:40

developing this project and, um, what I

24:42

would say is, uh, there the units aren't

24:45

going to be affordable by the definition

24:48

of the city,

24:49

>> but they will be set at a level that's

24:51

affordable to this area of the city. Um

24:54

we looked we did speak with um few

24:57

different groups and right around where

24:59

we believe that rate to be is right in

25:01

line with what what they said within you

25:03

know generally what you'd expect from a

25:05

market analysis here.

25:06

>> Gotcha.

25:07

>> Okay. Thank you.

25:09

>> Sure.

25:12

>> Thank you for asking that question.

25:14

Again he said it'll be affordable based

25:17

off of the fair market value of the area

25:20

or what of Parisburg are you? the entire

25:23

city or of Allison Hill

25:26

>> because again it's the the pricing can

25:28

be very different based off of where

25:30

you're located.

25:31

>> Yeah, I would I would say of the

25:33

neighborhood uh not specific to a

25:35

certain um maybe the city as a whole,

25:38

but but that general neighborhood.

25:41

>> And I know I shouldn't ask this

25:43

question, but I'm going to do it.

25:45

If you're going to do this, which when

25:47

do and you make this investment, what do

25:49

you expect for as a payback for my

25:53

>> um payback in in terms of

25:56

>> you're I don't think you want to find

25:57

this out of your pocket. If you do, I

25:58

need to come see you and hit the

26:00

lottery, too.

26:01

>> Okay. But okay, you know, you're

26:03

investing. What's that investment time

26:04

frame for this? 10 years, 20 years, 30

26:06

years.

26:07

>> Yeah. I mean, I I think I think that's

26:09

um that's fairly accurate. I mean, we

26:11

have, you know, obviously this will be

26:12

covered uh by by loan, right? A lot of

26:15

this will be done as a construction

26:16

loan. Um the entitlement will largely be

26:18

covered by ourselves. Um but yeah, there

26:20

is a there is a lengthy duration of of

26:23

payback. Um and we intend to um own this

26:26

long term and manage it as well.

26:28

>> So private investment

26:31

>> absolutely

26:32

also government federal and state are

26:36

they backing are they providing some

26:38

readies for this some funding grants?

26:40

>> We are not pursuing any grant money.

26:42

>> Okay. So this is all private.

26:43

>> It's all private.

26:47

Thank you.

26:54

>> Anybody from uh from the public have any

26:57

comment?

27:00

Okay. Anything else?

27:02

>> Nope.

27:03

>> By applicant. Okay.

27:06

in the board.

27:10

>> I will make a motion to approve

27:13

application 2621

27:16

uh 400 North 13th Street uh with the

27:19

conditions set forth by the planning

27:21

commission.

27:24

>> Second.

27:24

>> I second.

27:25

>> Okay. All in favor?

27:27

>> I.

27:28

>> Okay.

27:29

>> All right. Yep. So, we'll get that

27:31

written decision to you within 45 days.

27:34

And I guess everybody's staying in their

27:36

seats, so we'll move it on. Yes.

27:40

>> Thank you very much.

27:46

>> Thank you, sir.

27:47

>> All right.

27:50

Okay. So, now we are to application

27:53

2623,

27:55

which is 1512 State Street.

27:59

And um the exhibits, I'll read them in.

28:03

B1, proof of publication in Patriot

28:05

News, January 11, 2026, January 18,

28:08

2026. B2, letter sent from the planning

28:12

director to applicant notifying of the

28:13

hearing. B3, hearing notice posted on

28:15

the property. B4, notification letter

28:18

sent to required neighbors. B5,

28:20

application packet with attached

28:22

narrative, photos of existing conditions

28:24

on the property, location map of the

28:26

property, and floor plans for the

28:28

project.

28:29

B6 is the deed to the property

28:31

establishing applicants standing to

28:33

pursue the requested zoning relief. B7,

28:36

the planning bureau case report. B8,

28:38

city of Harrisburg planning commission

28:40

resolution. B9, email dated January 26,

28:44

2026, uh, requesting a continuence to

28:47

February 23, 2026. B10, proof of

28:50

publication, Patriot News, February 8

28:53

and February 15, 2026.

28:56

Okay. And before I turn it over to Mr.

28:58

tonight. Uh it is the same applicant and

29:01

councel. So um applicant, you uh

29:05

understand that you're still under oath

29:08

um from the last application. Okay. All

29:10

right. All right. So uh Mr. Knight. Yep.

29:14

So uh the uh request for case 2623 uh

29:18

for 1512 State Street involves um two

29:21

variances and two special exceptions. Uh

29:24

the proposal is to convert the existing

29:27

single family dwelling into a three-unit

29:29

multif family dwelling which requires

29:31

zoning hearing board approval of special

29:32

exceptions for the proposed use and

29:34

relief from the off street parking

29:36

requirements per section 7-305.7

29:39

and 7-327.6

29:41

of the zoning code respectively and

29:43

variances for relief from the density

29:45

regulations and specific criteria in

29:47

sections 7-307.3

29:49

and 7-309.2V

29:51

to V of the zoning code respectively. Uh

29:54

so as you can see in the um uh photos

29:58

that accompany the application and the

30:00

case report, uh the property itself uh

30:04

is significantly deteriorated. Um in

30:07

looking back through uh the uh city's

30:11

records, it appears that there are some

30:14

early condemnations going back as far as

30:16

1998. uh noting that um a window at the

30:20

rear of the property was open and

30:21

allowing access to like uh some kids

30:23

were getting in there and stuff like

30:25

that. And so it's been um in a vacant

30:28

condition uh or state for about at least

30:31

25 years. Um and then during that time,

30:34

as you can see from the photos, uh a

30:36

portion of the side wall and roof have

30:39

collapsed. Um it appears that it might

30:43

have been under construction at some

30:45

point because there are no longer

30:46

floorboards at least on the first floor

30:47

as you could see in through the window.

30:49

Um and then the uh again affformentioned

30:53

uh deterioration on the sidewall and um

30:56

and roof which uh has left the property

30:59

open to the elements. Um so the property

31:03

or the structure itself uh is in a

31:07

fairly precarious position where it's

31:09

likely that um if a productive reuse

31:13

cannot be found for the property uh

31:15

either um a natural collapse or maybe a

31:20

city uh demolition would need to occur

31:23

uh without the granting of the zoning

31:25

relief. Um the other aspect uh is the

31:28

off- streetet parking. Um the rear yard

31:30

is currently a dirt lot. Uh there's some

31:34

um old uh you know debris from shore

31:37

past construction, maybe some illegal

31:38

dumping that has occurred there. Uh it

31:40

is wide enough to accommodate two of the

31:43

required off street of the four required

31:45

off- streetet parking uh spaces. Um and

31:48

the bureau uh believes that the um

31:51

surrounding

31:52

uh streets uh can accommodate uh demand

31:57

uh for those other two off- streetet

31:58

parking spaces that would be required

32:00

for a three-unit um multif family

32:03

dwelling. Uh so with that that all being

32:06

said, the planning commission uh

32:09

recommends that the that the zoning

32:12

hearing board approve the request uh

32:15

with the following conditions. If

32:16

granted zoning approval to move forward

32:18

with the project as proposed, the

32:19

applicant shall allow the codes bureau

32:21

to perform a comprehensive inspection to

32:23

identify any outstanding code violations

32:25

and will and will receive approval for

32:27

all necessary permits prior to receiving

32:29

a certificate of occupancy. Uh the

32:31

applicant must provide a detailed site

32:33

plan developed by a professional

32:34

demonstrating how the rear yard will be

32:36

developed as off- streetet parking and

32:37

whether any such development is in

32:39

conformance with the applicable zoning

32:41

regulations. And finally, the planning

32:42

bureau recommends the applicant recreate

32:44

historic and architectural features of

32:46

the property such as the oral windows

32:48

and wooden front porch elements to

32:49

ensure the property retains and enhances

32:51

its contribution to the aesthetics of

32:53

the block. Uh that final condition is

32:55

more of a recommendation uh because the

32:57

property is uh you know half of a duplex

33:00

and is reflective of the architecture

33:01

along the block. Um we certainly don't

33:04

expect the applicant to be uh held to

33:06

historic preservation standards with

33:08

like you know they could using vinyl

33:10

windows but there are definitely some

33:12

unique architectural features there that

33:14

you know the planning bureau would would

33:15

recommend uh be retained in any

33:17

reconstruction of the property. Uh the

33:20

planning commission recommends the

33:21

zoning hearing board approve the request

33:22

for the following reasons. The property

33:25

has experienced extended vacancy over

33:27

the past 25 plus years resulting in

33:29

significant deterioration that threatens

33:30

the physical stability of the attached

33:32

duplex and the overall character of

33:34

State Street. As such, there is

33:36

justification for the allowance of more

33:37

units than would be permitted by Wright.

33:39

Uh the project will reconstruct a

33:41

blighting influence and attractive

33:43

nuisance into new units that will

33:44

contribute to the housing inventory in

33:46

the city generally and the neighborhood

33:48

specifically and rehabilitate an

33:50

historically and architecturally

33:51

significant building and represents a

33:53

significant improvement over the

33:54

potential alternatives of demolition or

33:56

collapse.

33:58

And finally, the project advances the

34:00

purpose of the RM zoning district provi

34:01

provided in chapter 7-305.4C 4C of the

34:05

code as it provides development at

34:07

medium densities that will not adversely

34:08

affect the stability of the area and

34:10

advances chapter 7-301.27

34:13

of the zoning code by protecting the

34:15

residential neighborhood and providing

34:16

diverse housing opportunities.

34:22

Okay. And then with that, I'll turn it

34:25

over to Attorney McMumb.

34:28

>> Thank you. Uh again, no need to belabor

34:30

the point. Sometimes Jeff and I are are

34:33

seeing eye to eye on these things. So

34:35

just a few quick questions for Mr. Neil

34:37

who's already been sworn in. Does Halden

34:40

own 1512 State Street which is the

34:42

property that is the subject of this

34:43

application?

34:44

>> Yes. Um how will the units be priced? Um

34:49

again um it'll very similar to the last

34:51

um the last um case where essentially it

34:55

won't meet the definition of affordable

34:57

from the city's perspective but it will

34:59

be it will be affordable um based on the

35:02

neighborhood um and the prices will be

35:04

set accordingly.

35:05

>> So it won't be uh affordable based on

35:07

the city's definition of affordability.

35:08

>> That that's correct. Yes.

35:10

>> Uh is the building approximately 2443

35:14

square ft?

35:14

>> Yes. Is the property approximately 2,178

35:18

square feet?

35:19

>> Yes.

35:19

>> So, what's your hardship then that

35:21

requires you to exceed the density

35:23

limits of the ordinance?

35:24

>> Yeah, as shown in the in the

35:25

application. Um, and as as as Mr. Knight

35:28

had indicated, like there's substantial

35:31

um deterioration to the building, not

35:33

only from the roof, but the exterior

35:34

side. Um, and really what that's causing

35:38

us to do is not only just do some

35:40

repairs, but really go in and do a full

35:42

gut of um of the of the of the building

35:45

and start as far as replacing

35:47

floorboards. Um, there's just a massive

35:50

amount of work that needs to be done to

35:51

bring this up to where it can where we

35:54

can really work on it.

35:56

>> Do you concur with Mr. Knight's uh

35:58

comments that the alternative is either

36:00

is a natural collapse or demolition?

36:02

>> 100%. When did Halden acquire the

36:04

property? uh within the last uh six

36:06

months.

36:07

>> So you did not create this hardship or

36:09

this current uh status of the property.

36:11

>> That is correct. We bought it in this

36:13

condition.

36:13

>> Is it your opinion that the requested

36:15

relief is the minimum necessary to

36:17

afford relief because of those cost of

36:19

renovations that you mentioned?

36:20

>> I do.

36:21

>> Have you reviewed the application and

36:22

the narrative included with it?

36:24

>> Yes, I have.

36:24

>> And to the extent applicable, do you

36:26

adopt the comments made therein as your

36:28

own?

36:28

>> I do. Thank you. That's all I have.

36:32

>> Okay.

36:41

Good evening again. I don't have a lot

36:43

of questions. I think this application

36:44

is very similar to others that we've

36:46

seen in this uh state street corridor in

36:49

terms of the multif family dwelling

36:51

request as well as things like the

36:53

variance request for the or dimensional

36:55

variance request for like the lot size

36:57

as well as the parking requirements. Um

37:01

my one

37:03

question, Mr. Knight, do you have any

37:05

examples? I can't remember if we've

37:08

specifically passed ones um before where

37:10

they actually

37:13

where the actual property was lower than

37:15

the required square feet. Do you have

37:17

any specific examples

37:20

in mind where we've actually approved

37:22

that request type of request for a

37:25

similar property? Do you mean the lot

37:27

area or the building area?

37:29

>> The actual building area for this one is

37:31

the 2500 2500 square ft. Um compared to

37:35

I think the current size which is the

37:37

2443.

37:39

>> Uh yeah. So I believe a recent one we

37:42

had

37:46

street

37:48

duplex

37:50

and we made a similar request

37:57

in the back.

38:02

Um we've had others along second street

38:10

so you know I would say that uh the

38:14

property is not necessarily in that

38:17

sense.

38:31

>> Okay. Thank you. And and since this one

38:33

is very similar, I don't want to uh

38:36

overlook anything. So, I was just going

38:37

to ask, are there any factors to this

38:39

application um that you feel maybe

38:42

should be scrutinized a little bit more?

38:44

Maybe anything that's unique to this

38:46

particular application as as opposed to

38:48

others that were similar.

38:50

>> Yeah. Again, I think one would be the

38:53

extended vacancy. you have a property

38:56

that's vacant for as long as I clearly

39:01

know some other

39:04

use as a single family

39:20

that's natural

39:22

snow event like

39:26

whe

39:32

they contact the city.

39:35

So I would say this is further along.

39:53

>> Got you. Thank you.

39:58

>> Good evening. Okay. So want to follow up

40:02

on a few things.

40:04

Single

40:06

uh

40:10

that's when the cost of rehab is

40:12

restored as a single family. Have you

40:14

looked at Have you looked at that price

40:16

point?

40:17

>> Yes, I have. We have.

40:18

>> Okay. Because again with the

40:20

deterioration

40:23

you're the only way you can make this

40:25

make make break is that make it a multi

40:27

family.

40:28

>> Yeah. I mean there's just really no way

40:30

for for us to if we were to leave it as

40:32

a signal family. Um it's likely not

40:35

going to cash flow and then our banks

40:37

are not going to want to be um part of

40:40

this this project. So um it really

40:43

prevents us from being able to move

40:45

forward and and repair this and make it

40:47

something useful for the city without

40:50

you know without leaving it as the same

40:52

use.

40:52

>> So this question I answer too will

40:55

address the finances but also address

40:58

the

41:00

the various for the for the spacing

41:03

you're asking for three units fin two.

41:07

You're getting closer to what's

41:09

allowable. You're still not there yet,

41:11

but it's not a 60 something% over 66%

41:16

over. It's it's really closer. No,

41:19

you're you're 100% right. And and really

41:21

the request is is to what um

41:24

attorney had asked me, was this really

41:27

the minimum? And really what happens is

41:29

when you're replacing replacing the

41:31

entire roof, you're going through you're

41:32

pulling like we literally gutting

41:34

gutting this down to the the the joists

41:37

and even some of those need to be

41:39

repaired. And then we're redoing the

41:40

exterior um wall because it's really

41:43

just not even there anymore. It's been

41:45

covered by tarps for about a decade. So,

41:47

we're to the point where we are using I

41:50

can't even say we're using the entire

41:51

shell because part of it is gone. Um,

41:54

but it really will take all three units

41:56

in order for us to show something that

41:57

cash flows positively and and allow our

42:00

our um financial partners to to want to

42:02

be part of this project.

42:04

>> Let's ask the materials you're going to

42:05

use to rehab this with because I'm going

42:08

to get myself in trouble again, but I

42:10

know the building a little bit. I know

42:11

people

42:13

some of them they were hard they were

42:15

hardwood floors on on the first floor.

42:18

Are they that's all going to be torn

42:19

out? Correct.

42:20

>> Yeah, unfortunately because a lot of

42:21

those have been damaged. flooring is

42:23

gone. Um, what I will say is, um, if you

42:26

have been in there, the the interior

42:28

stairwells are are just gorgeous. So,

42:31

there's one in the front part of the

42:32

building that goes up. I mean, the

42:33

architecture with it is beautiful. We

42:35

are doing everything we can to save

42:37

that. Um, so we want to we want to try

42:39

to to save a little bit of those things,

42:41

but so this the floors are all going to

42:43

be gone. The um the shared wall that

42:46

will uh that'll be retained. Um,

42:50

everything else is pretty much going to

42:51

be gutted from the exterior wall. Um,

42:53

and then yeah, there's then a new roof

42:56

as well.

42:57

>> You're probably going to put a new

42:57

highback system in here, too. That's

42:59

probably

43:02

rotted out.

43:04

>> Yeah.

43:04

>> Okay. Um,

43:07

configuration. You're just going to

43:09

these are one bed be one bedroom per

43:11

floor.

43:12

>> Um, so they're they're going to be it

43:14

depends which floor will be on. So the

43:16

first first floor is going to have two

43:18

bedrooms and this is subject to change.

43:20

Um this is the way that we feel it's

43:21

laid out best now. Um and obviously

43:26

would change if the approval didn't go

43:27

through but uh the first floor uh two

43:29

bedrooms, second floor will be a

43:31

onebedroom and then two bedrooms on I

43:33

think it's two bedrooms on the third.

43:34

Sorry I'm draw.

43:35

>> So you five bedrooms that'll be added to

43:39

this part this property. I don't know if

43:42

I'd say added because this is a three

43:43

story.

43:46

>> Okay. Um,

43:49

another question I want to ask. Um,

43:51

let's talk about the highback system.

43:52

The the heating itself. I believe this

43:55

was no, this is probably oil heat at one

43:58

time. Are you going to do something for

44:00

with the price of gas and the price of

44:03

electric?

44:04

>> Okay. Is there something you can do? So,

44:06

when you get people in there, it'll help

44:08

ease the

44:10

the paying pitch.

44:12

>> Absolutely. No, the the oil system is

44:14

completely gone. So, um it'll all be

44:16

mini splits. Uh so, the three units are

44:18

granted. It will be mini split on each

44:20

floor. So, they will have air

44:21

conditioning and heating.

44:29

>> Okay. So, that's

44:34

multi

44:36

children. this building with children

44:38

friendly because you got elementary

44:40

school right across the street.

44:41

>> Yep. Absolutely.

44:44

>> Finish. Thank you.

44:48

>> Okay. Anybody from the public have any

44:50

comment on this?

44:56

>> Okay. You want to step out or

45:06

So yes,

45:08

>> you want to make a motion.

45:09

>> I'll make a motion to approve of this of

45:13

the request with the specifications

45:15

>> the conditions

45:18

stated by the planning report

45:20

>> by the planning commission.

45:21

>> Planning commission.

45:23

>> Okay. So, there's a a motion to approve

45:25

the special exceptions and variances

45:29

uh for application 2623

45:32

subject to the planning commission uh

45:35

conditions. Is there a second?

45:36

>> Second.

45:37

>> Okay. All in favor?

45:39

>> I.

45:39

>> Okay. Same thing. We'll get a written

45:42

decision out there.

45:42

>> Thank you all very much. Appreciate

45:43

>> it.

45:47

Excellent. James the same thing. So,

45:51

>> I don't know why, but

46:04

When I get in front of this paper, I

46:06

actually

46:14

move.

46:15

>> I don't even know what I didn't even

46:17

bother to check.

46:29

Yeah, that's a brick wall and probably

46:31

structure probably found.

46:52

I think that top water damage too from

46:56

the roof being opened.

47:03

It would not be surpris

47:23

But the amount of money put into this,

47:27

>> you should have given them four years.

47:30

>> Well, I'm just I'm looking at this. I'm

47:32

saying, wait a minute.

47:36

>> Yeah. It's not going to be, let's say

47:38

this way, this is not afford. It won't

47:40

be affordable.

47:47

>> Yeah. I mean, I don't know what Remember

47:59

how they enision street

48:08

complex

48:16

to the

48:19

Start here.

48:33

I think you'll know. I think

48:43

it's major. Thanks. Uh so I think once

48:47

you start to see that you know there'll

48:49

be some more momentum to rehabing this

48:52

stuff and

48:57

Okay.

48:59

>> Okay.

49:00

All right. So uh we are

49:04

up to application 2624

49:08

uh 2140 North 2nd Street. Um I will go

49:14

through the exhibits then turn it over

49:16

to uh Mr. Knight and then we'll have

49:19

applicants sworn in and introduce

49:20

themselves. Uh so we start off proof of

49:23

publication Patriot News January 11

49:26

January 18 2026. B2 uh letter sent from

49:30

planning director to applicant notifying

49:31

of the hearing. B3 hearing notice posted

49:34

on the property. B4 notification letter

49:36

sent to required neighbors. B5

49:39

application packet with attached

49:42

narrative, site plan, photos of the

49:44

existing conditions of the property and

49:46

floor plans uh for the project. B6 is

49:50

the deed to the property establishing

49:52

applicants standing to pursue the

49:53

requested zoning relief. Uh B7, planning

49:57

bureau case report. B8, city of

49:59

Harrisburg planning commission

50:00

resolution. B9 is an email uh dated

50:04

January 26, 2026 from the applicant

50:07

requesting a continuence to uh tonight,

50:10

February 23, 2026. B10 is a proof of

50:13

publication for tonight's meeting in the

50:15

Patriot News, February 8 and February

50:17

15, 2026. B11 is a supplemental

50:21

narrative uh to the application with

50:24

with a list of the neighboring property

50:26

owners aerial view of the existing

50:29

conditions of the property and photos of

50:30

the exterior of the property. And B12 is

50:34

a parking lot lease agreement uh with

50:37

the nearby property owner. Okay. So, we

50:39

have B1 through B12. And with that, I

50:43

will turn it over to Mr. Knight.

50:45

>> Uh yep. So, uh, case number 2624, uh,

50:49

for 2140 North Second Street. Um, so,

50:52

initially this was reviewed, uh, by the

50:54

planning commission and presented to the

50:56

planning, uh, sorry, reviewed by the

50:57

planning bureau and presented to the

50:58

planning commission and acted upon by

51:00

the planning commission commission,

51:01

although as though it were a variance

51:03

and special exception request. Um, and

51:07

that was an error on my part. Um, I had

51:11

reviewed this as though it were in the

51:12

residential medium density zoning

51:14

district, in which case the uh variance

51:17

for um the density and uh uh the two

51:21

special exceptions would have applied.

51:23

Um, however, the applicants legal

51:25

council had uh apprised me uh last week

51:28

of um of my error in reviewing that. Um,

51:32

and thus the proposal would only require

51:35

two special exceptions because there is

51:36

no density regulation. um for their

51:39

riverfront district uh for both the spe

51:42

the multif family dwelling use and then

51:44

relief from the off- streetet parking

51:45

requirements. As um Mr. Okconor noted in

51:49

uh recitation of the documentation uh

51:52

the applicant has provided a draft

51:54

parking lease uh for uh property at

51:56

21109 North Front Street which is within

51:59

500 ft of the subject property um and

52:02

therefore uh meets the um criteria for

52:06

uh the provision of off- streetet

52:07

parking at an offsite location. Um and

52:11

therefore the proposal has now been just

52:14

whittleled down uh to only requiring a

52:16

special exception for the proposed

52:18

multif family dwelling use uh in the uh

52:20

riverfront zoning district. Um so uh

52:24

with that being said I would say you

52:26

know some of the uh analysis in the case

52:30

report is no longer applicable as well

52:32

as some of the discussion that occurred

52:34

at the um planning commission meeting.

52:37

The planning bureau's recommendation of

52:39

denial was predicated upon the uh

52:42

variance aspect of the proposal. Uh as

52:45

we noted, the property had been used as

52:47

a single family you uh single family

52:49

dwelling and therefore could be going

52:51

forward. Uh however, uh the um

52:54

correction uh to a special exception

52:58

only changes you know the calculus of uh

53:01

the decision. Um and therefore uh

53:04

although the planning bureau and

53:05

planning commission had recommended

53:06

denial uh the planning bureau um has

53:10

modified its uh recommendation to one of

53:14

um uh re a recommendation of support uh

53:18

uh for the proposal. Um, as the

53:21

applicant uh noted in their supplemental

53:23

documentation, uh there are other um

53:28

multif family dwelling uh properties

53:30

both on this side of uh the 2100 block

53:33

of North Second Street as well as a

53:34

couple on the other side. Um and there

53:37

are uh residential or sorry, there are

53:39

commercial and institutional uses uh

53:42

just to the west fronting Front Street.

53:45

And uh because the applicant uh has

53:48

submitted a draft parking lease for uh

53:50

the required the four required off

53:52

street parking spaces uh and because the

53:55

building itself is large enough to be

53:56

converted uh to up to three units. Uh we

54:00

feel that the property uh and their

54:02

proposal uh meet the uh criteria for the

54:06

granting of a special exception in the

54:08

riverfront zoning district.

54:10

>> Okay.

54:14

and um applicant if you could introduce

54:16

yourself.

54:20

>> Hi, I'm Steven Tulle. I reside at 505

54:23

Pellingham Circle in the Noah, PA.

54:26

>> Okay.

54:32

>> I do.

54:33

>> Okay.

54:34

Okay. Attorney Mccumbi, go ahead. Y as

54:38

Jeff pointed out, we were able to narrow

54:39

down and and really uh cut out a lot of

54:42

the relief that was needed. So, it's a

54:44

pretty simple request at this point,

54:46

just a special exception uh for the

54:49

single family home. Um

54:52

just a few questions for Mr. Tulle then

54:55

with that in mind. Mr. Tool, are you the

54:57

equitable owner of the property located

54:59

at 2140 North Second Street?

55:01

>> I am.

55:02

>> Do you plan to offer any of the units at

55:05

an an affordable rate. Excuse me,

55:08

>> I do.

55:09

>> Um, one of the units then be offered uh

55:13

as affordable housing as defined by the

55:16

city's zoning ordinance?

55:17

>> Yes.

55:18

>> Can Off Street parking be provided on

55:20

the property?

55:21

>> Uh, no, but as we discussed, uh, we're

55:24

going to have it adjacent to the

55:25

property.

55:26

>> And how many spaces are you leasing?

55:29

>> Four.

55:31

>> Uh, will those spaces be dedicated to

55:33

the residents of the property? They

55:35

will.

55:35

>> Do you agree to continually provide at

55:37

least four dedicated off- streetet

55:39

parking spaces to the residents as a

55:41

condition of approval of this

55:42

application?

55:43

>> Yes.

55:44

>> Is there also on street parking

55:45

available in the area?

55:47

>> Yes, there is.

55:48

>> And bus stops?

55:49

>> Uh yes, on Third Street.

55:52

>> In your opinion, will the proposed uh

55:55

will the proposal change the character

55:57

of the neighborhood?

55:58

>> Uh in my opinion, it will not. Uh all

56:02

the other residential on that block are

56:05

already multifamilies.

56:07

2134 North Second, 2138 North Second,

56:11

2144 North Second, 2146 North. Um,

56:17

across the street, we have 2139

56:20

North Second and 2141 North Second as

56:24

well as

56:25

home at 2147 North Second.

56:28

>> Great. And our only exhibit, we'll call

56:30

it A1. I'm handing that to you now. What

56:32

is exhibit A1?

56:38

>> Yes. Uh, exhibit A1 is a letter from my

56:42

neighbor Annette McCra who resides at

56:45

2144 North Second Street.

56:50

>> Uh, the second one is a letter of

56:53

support from Michael Rathon and Susan

56:57

Euing who reside at 2401 North Second

57:00

Street. Is it all right if we just mark

57:02

them both? I mean, just a A1. Yep. Good.

57:05

Perfect.

57:06

>> So, A1 is uh two pages for the record.

57:08

>> Got it.

57:11

>> Uh so then um in your opinion, given the

57:15

number of uh other dwelling units in the

57:18

area that that are multif family and the

57:20

letters of support from your uh two of

57:23

your neighbors, again, it's your opinion

57:25

that this will not change the character

57:26

of the neighborhood.

57:27

>> Correct. Did you review the narrative

57:29

submitted in support of the application?

57:31

>> I did.

57:31

>> And to the extent applicable, do you

57:33

adopt the statements made in that

57:35

narrative as your own testimony?

57:36

>> I do.

57:37

>> That's all I have for Mr. Tol. He's

57:39

happy to answer questions.

57:40

>> Okay. All right. So, now the board can

57:44

ask.

57:48

>> Okay.

57:50

Good evening, Mr.

57:51

>> Good evening.

57:52

>> Um, so this is going to this is a

57:54

conversion multif family dwelling. What

57:57

are you

57:58

How are you handling

58:00

uh fire support for fire? Are you going

58:02

to have fire suppression

58:05

system?

58:07

What?

58:07

>> Uh yeah, my plan is to have a fire

58:10

suppression as well as fire alarms per

58:13

code.

58:17

>> You did say is this is going to be

58:18

affordable housing based off of the

58:21

criteria set by the city. Correct.

58:23

>> Correct. One of the units.

58:24

>> One of the units. Yep. So 33% of it

58:27

off street parking. You've handled that.

58:30

Um, now you also know this isn't a flood

58:33

plane.

58:35

>> Yes, it is.

58:35

>> Okay. How do you address that?

58:38

>> Uh, I believe that the valuation of the

58:42

property will allow for the construction

58:45

cost um per flood plane rules. Um, I own

58:51

2134 North Second and 2138 North Second.

58:54

So, I'm very familiar with uh the flood

58:57

plane rules.

58:59

>> Mr. Tol is aware he and I had a

59:01

conversation. I emailed Jeff about it as

59:03

well that he understands should be

59:06

needed from a flood plane once he has

59:07

his dollars and cents figured out.

59:14

>> Okay.

59:18

I'm not going to ask you about the

59:19

financial questions. You probably sat

59:21

here and heard the financial questions I

59:23

tend to throw at you, but I'm pretty

59:25

familiar with the area. Okay? And I

59:28

learned something tonight. I didn't know

59:31

there were conversions. There were other

59:32

conversions on Second Street. Thought

59:34

that and I'll get with you, Jeff. I

59:37

would like to know when they were

59:38

converted. Okay. Just for my own

59:40

edification.

59:42

>> 34 as the applicant noted.

59:46

Now, that was a commercial use was

59:50

studio.

59:52

Yeah.

1:00:05

>> Attorneys used to have attorney's office

1:00:07

there and dentist office. Okay. One

1:00:09

second.

1:00:11

I'm showing I guess my hair is gone. So,

1:00:14

okay. I'm showing my age, but yeah, I'm

1:00:16

pretty familiar with the area.

1:00:19

And this is good. Thank you. You know, a

1:00:21

lot of times when I look to to see how

1:00:25

the neighbors are supporting the

1:00:26

project, neighbors support the project,

1:00:28

that means that you they you've gone out

1:00:30

and did your Dick Tracy. You've gone out

1:00:33

and done your ground work and talked to

1:00:35

people. Well, thank you. Um I don't have

1:00:38

anything else. Thanks. Thank you.

1:00:40

>> Thank you.

1:00:46

Just confirming right so there's no

1:00:49

variance associated with this

1:00:50

application

1:00:52

>> right okay yeah so that takes out any

1:00:55

>> special

1:01:00

>> so uh no I do not have any questions

1:01:08

>> okay you want to make a

1:01:21

I would say the only condition that I

1:01:23

can think of would be that the applicant

1:01:29

regulations

1:01:37

>> well I think that right the flood but

1:01:40

that's fine you say just subject to the

1:01:43

condition Mr. Knight just stated just

1:01:44

like that. That's fine.

1:01:47

>> So just say you can just say exactly

1:01:50

what you know subject to the condition

1:01:52

that Mr. Knight put on the record.

1:01:55

>> All right. I make a motion to approve uh

1:01:59

application 2624

1:02:01

uh for a special exception with

1:02:03

conditions with the condition that Mr.

1:02:06

Knight uh added to the record.

1:02:09

>> Okay. Is there a second?

1:02:11

>> Second.

1:02:12

>> Okay. All in favor?

1:02:13

>> I

1:02:14

>> Okay. Written decision will be sent. All

1:02:18

right.

1:02:18

>> Appcate it.

1:02:19

>> Excellent. Thank you.

1:02:21

>> She got off early. You got off easy. You

1:02:24

know that

1:02:31

you got to take some credit for right

1:02:42

>> wasn't anything really difficult.

1:02:54

Change that

1:03:02

right

1:03:06

there.

1:03:23

One of them was just under

1:03:30

>> and it was the right mix, the right one

1:03:32

to be under.

1:03:38

>> They would both

1:03:42

>> make a motion to adjourn the meeting.

1:03:46

>> Okay. Second. Okay.
