Summary

The Harrisburg City Zoning Hearing Board reviewed several key variance and special exception applications, approving commercial sign additions, a residential duplex conversion contingent on ADA/safety compliance, and a 10-unit historic office-to-residential adaptive reuse project, while denying a request to convert an accessory lot into a commercial parking lot.

This meeting highlights the balancing act of historic preservation, urban density, ADA compliance, and local parking demand within a changing Pennsylvania municipality.

Meeting Commencement and Agenda Continuances

skip

The Harrisburg City Zoning Hearing Board opens its July 21, 2025 session. The chair establishes standard procedural rules for testimony and the role of the court reporter. The board immediately reviews and grants a continuance request for Application 2610 (508 and 510 N. Second Street) to the August 18, 2025 meeting.

Contains procedural setups and a meeting postponement with no active case discussions.

3:27-20:42

Application 2603: 1951 Hurst Street Sign Variance

watch

Dennis Boyer presents a request for a 50 sq. ft. sign at a recently consolidated gas station and convenience store site where only 25 sq. ft. is permitted due to split-zoning boundaries. A neighborhood resident testifies in favor, arguing that a larger sign is critical to preventing abrupt traffic maneuvers at the complex intersection. The board approves the variance with no conditions.

Crucial for understanding how split-zoning and intersection safety impact commercial signage approvals.

20:42-31:03

Application 2606: 600 South 17th Street Signage Variance

optional

Ben Orens of Allegra Image 360 presents a request for a second commercial wall sign for HB McClure/HB Home. Planning Director Jeffrey Knight outlines that the second sign at the south facade is needed to direct commercial delivery drivers coming from Interstate 83 safely into the driveway before they overshoot the site. The board quickly grants the variance.

Straightforward commercial sign approval with minimal debate or regulatory complications.

31:03-1:05:33

Application 2607: 1332 North 2nd Street Parking Lot Variance

watch

Bitner Rentals LLC requests a use variance to turn an accessory funeral home parking lot into a commercial parking lot for monthly neighborhood leasing. Planning Director Knight notes the RM district restrictions and outlines conditions like landscape screening and access revisions. Following a closed legal recess, the board votes to deny the request.

Essential viewing as it features a rare application denial and a deep dive into accessory versus commercial parking laws.

1:05:33-1:46:57

Application 2608: 2001 Lennox Street Duplex Conversion

watch

Dean Morgan and Gerald Radzik seek a special exception and variance to re-establish a historical two-unit duplex on a corner property in the RM district. Board members debate parking availability, historical records, and a public right-of-way issue involving a wooden fence blocking Chalky Alley. The board approves the application on the condition that the fence is removed for ADA compliance and safety stairs are coated with slip-resistant paint.

Highly relevant for understanding how zoning boards enforce public right-of-way ADA compliance and building code inspections.

1:46:57-2:14:33

Application 2609: 315 North Second Street Adaptive Reuse

watch

Adam Brenamman and attorney Phil Patrina present a request for a density variance to convert a historic three-building office block into a 10-unit residential apartment building. Brenamman reviews floor plans, explains the economic necessity of 10 market-rate units, and details parking easements with Verizon. The board approves the variance subject to standard historic (HARB) and city council land development reviews.

Provides an excellent case study of the economic challenges, historic preservation guidelines, and zoning negotiations involved in downtown office-to-residential conversions.

Key points

  • Zoning Hurdles in Office-to-Residential Adaptive Reuse — Converting the former PA Healthcare Association office at 315 N. Second St. into a 10-unit apartment building required a density variance because the lot size only allowed 8.3 units by right. The developer successfully argued that high infrastructure conversion costs—including running new plumbing, kitchens, and electrical systems into three historic, internally connected structures—created a financial hardship justifying the extra units.
  • Accessory vs. Commercial Parking in Residential Districts — Bitner Rentals sought a use variance to turn an underutilized accessory parking lot at 1332 N. Second St. (originally used for a funeral home) into a commercial lot leased to local residents. Despite arguments that this would relieve nearby on-street parking congestion, the board ultimately denied the request due to long-term zoning integrity concerns in Medium Density Residential (RM) zones.
  • ADA Sidewalk Compliance and Public Right-of-Way — During the review of a duplex conversion at 2001 Lennox Street, the Planning Bureau noted that a wooden fence at the rear of the property obstructed Chalky Alley. The board made the fence's removal a formal condition for approval to ensure a continuous, ADA-compliant pedestrian sidewalk connects to the newly developed property to the south.
  • Split Zoning Complications for Infill Commercial Signage — The consolidated lot at 1951 Hurst Street sat across both Commercial Neighborhood and Industrial zones. Because access constraints forced the convenience store building to be placed in the Commercial Neighborhood zone, it was legally restricted to a 25 sq. ft. sign, necessitating a variance for a safer 50 sq. ft. sign visible to drivers navigating a complex intersection.
At 25 square feet, it would be like I said, kind of like a postage stamp on that building. Dennis Boyer
the applicants have been in coordination with the codes bureau and has had multiple codes officer visits to the site Jeffrey Knight

0:40

this evening. This is the uh zoning

0:42

hearing board uh meeting for July uh

0:46

21st, 2025 for the city of Harrisburg.

0:49

Uh we have a rather large agenda uh this

0:52

evening. Um before we start, I just want

0:56

to uh go over some ground rules. Um

1:00

they're the same ones each time. Uh I

1:02

just want everybody to know that we have

1:03

a court reporter here. Uh the court

1:06

reporter stenographers taken down every

1:08

uh everybody's uh what everybody says

1:11

word for word. Uh this is done just in

1:13

case there's an appeal to the court of

1:15

common please. So we want to make sure

1:17

that we don't talk over uh another

1:20

person or if we answer a question we

1:23

enunciate the answer and not shake our

1:25

head up and down. Um, everybody uh here

1:29

who resides or owns uh property uh uh in

1:33

the city or uh close to the property and

1:36

has something legally relevant to say

1:38

will be able to participate in each one

1:40

of the various hearings uh as they apply

1:44

to each uh individual.

1:46

Um the first uh matter we're going to

1:49

address this evening is going to be uh

1:53

application uh 2610.

1:56

It's uh last on the agenda. Um

2:01

this is uh the application concerning

2:03

the property located at 508 and 510

2:06

North Second Street. And uh this is a uh

2:11

continuence request. Um, I just indicate

2:14

that uh to the board that uh we received

2:17

a uh letter from the applicant

2:20

requesting that this matter be continued

2:22

to the August 18th uh 2025 zoning

2:26

hearing board meeting. So, I'd like to

2:30

um ask for a motion uh uh for the

2:34

acceptance of this continuance request

2:37

and it'll be on next month's meeting.

2:49

18.

2:52

>> Is there a second?

2:54

>> Second.

2:55

>> All those in favor signify by saying I.

2:58

>> I.

2:59

>> Okay.

3:04

So the uh first order of uh business

3:07

will be old business uh application

3:10

number 2603. This is a variance

3:14

application

3:16

uh for uh 1951 Hurst Street. Um

3:22

and uh for the record for this hearing,

3:24

I'll just uh indicate that we have two

3:27

uh board members here. uh Claude Fipps

3:30

who is our chair and James Hobbs uh who

3:33

is uh the vice chair of the board. Um so

3:38

with that, do we have a a representative

3:41

of uh the applicant in this matter?

3:50

Okay.

3:52

Um,

3:54

I'll also note for the representing the

3:57

city's solicitor's office is TIA Cameron

4:01

is present here this evening. Um, we'll

4:05

start out uh by uh swearing in uh

4:08

witnesses. Um, Mr. Knight, do you want

4:11

to uh state your uh your position uh

4:15

with the city um and then uh we'll swear

4:18

you in?

4:19

>> Yes. Uh I'm the planning director.

4:21

>> Okay.

4:22

Um would you uh raise your right hand?

4:24

Uh do you swear or affirm that the

4:26

testimony you're about to give before

4:28

this board is the truth and nothing but

4:30

the truth?

4:30

>> I do.

4:31

>> And uh do you agree that uh that you

4:35

will be sworn in for each of the meeting

4:38

uh hearings this evening?

4:40

>> Yes.

4:40

>> Okay.

4:42

Um, and then, um, sir, uh, would you

4:45

like to, uh, um, tell us your name,

4:49

spell your last name?

4:52

>> My name is Dennis. B O Y E R.

4:59

>> Okay. And, um, what is your are you the

5:03

applicant in this matter?

5:05

>> No, I'm not. and the uh owner of the

5:07

sign company in reading that's going to

5:09

be hopefully installing the sign.

5:12

>> Okay.

5:14

Um would you uh please raise your right

5:17

hand? Do you swear or affirm that the

5:20

testimony that you will be giving to

5:22

this board this evening is the truth and

5:24

nothing but the truth?

5:25

>> I do.

5:26

>> Okay. Um Mr. Uh Knight, do you want to

5:31

give us a um a summary of this

5:34

application and indicate what zone the

5:36

property's located and such? Uh yes. So,

5:40

uh the uh case for 2603

5:43

um is a

5:46

variance application for a sign larger

5:49

than permitted by right uh in the

5:52

commercial neighborhood zoning district

5:54

in which the building uh to which the

5:56

sign will be affixed is located. Uh the

5:58

applicant is proposing a 50 square foot

6:01

sign when a 25 square foot sign is

6:03

permitted by right. Um this uh property

6:07

uh has been undergoing some changes in

6:09

the last few years. Uh it originally um

6:12

was two properties uh 1933 and 1951

6:17

Hurst Street. uh 1933 had a diner on it

6:20

and 1951 had a a small gas station uh a

6:24

canopy with uh islands with gas pumps on

6:28

them. Um uh two years ago the applicants

6:31

uh proposed and received approval for a

6:35

project to demolish both properties,

6:37

consolidate the lots into a single

6:40

parcel uh and build a new larger uh gas

6:44

station on the property with the uh

6:46

pumps pump islands and canopy at the

6:49

eastern end of the site and uh a

6:52

convenience store building at the

6:54

western end of the site. Um in this case

6:57

there uh are actually fairly unique

7:00

circumstances uh for the property um

7:03

because the two uh lots that previously

7:07

comprise the the property the project

7:09

site

7:11

are located in different zoning

7:12

districts. um 1933 Hurst Street uh which

7:16

is the uh portion of the property on

7:18

which the building uh that the uh sign

7:20

in question is located was in the

7:22

commercial neighborhood zoning district

7:23

and 1951 Hurst Street was in the

7:25

industrial zoning district. Um in during

7:28

their reconstruction of the uh site uh

7:31

into an improved uh gas station with

7:33

convenience store. Um the applicants

7:36

were limited to where they could put uh

7:38

the gas station, pumps, islands, and

7:40

canopy, and the uh convenience store uh

7:43

due to the fact that they needed to have

7:44

access um from Arsenal Boulevard and

7:47

from 20th Street. Uh so the gas pumps

7:50

needed to be at the eastern end of the

7:52

site in the industrial zoning district,

7:53

which left the convenience store being

7:55

in the uh commercial neighborhood zoning

7:57

district. So despite the two properties

7:59

being uh conjoined into a single lot uh

8:02

the split zoning remained um and uh this

8:05

it's this condition um that essentially

8:07

creates the justification for the

8:09

applicant's request. Uh the applicants

8:11

did not have the uh option based again

8:13

on the configuration of the site and the

8:15

necessary vehicular access of putting

8:17

the store at the eastern end of the site

8:19

uh where the proposed signage would have

8:21

been permitted by right with the gas

8:22

pumps being at the western end. Um so uh

8:26

from the planning bureau's perspective

8:27

it's a fairly straightforward request

8:29

with uh a simple justification and the

8:33

uh planning commission recommended the

8:35

zoning hearing board approved the

8:36

request for the following reasons. Site

8:38

features conditions that justify the

8:39

requested zoning relief including a

8:41

complicated intersection and extensive

8:42

street furniture including utility

8:44

poles, traffic control poles and

8:46

signage. Uh the applicant did not have

8:48

the option of constructing the

8:49

convenience store in the INDZONE portion

8:51

of the property which would have

8:52

permitted the proposed signage by right

8:54

as the site design is necessary to allow

8:56

appropriate vehicular access and

8:58

circulation. Uh the proposed signage

9:00

represents a minor deviation from the

9:02

zoning code to allow visibility and

9:04

legibility for drivers traveling along

9:05

her street. And finally, the proposed

9:07

signage would not be out of character

9:09

for this portion of her street.

9:14

>> Okay. Thank you, Mr. uh Knight. Is there

9:17

anybody else here before uh we go any

9:20

further? Um that any citizens here uh

9:23

relative to this matter? Just want to

9:26

identify him ahead of time. Oh, you are

9:29

okay. We'll we'll get to you. I just

9:31

wanted to make sure someone someone if

9:33

someone was here so that we know. I'm

9:36

going to mark a few exhibits and then

9:38

we'll have uh Mr. uh then then we'll

9:42

we'll move forward. Um, I'm going to

9:44

pre-mark exhibits uh starting with

9:46

exhibit uh B1. Uh B1 was the original uh

9:51

email that uh where this matter was uh

9:54

continued u from last meeting. Exhibit

9:58

B2 is a proof of publication.

10:00

Uh the time and place and particular

10:02

nature of this matter was published in

10:04

the Patriot News on June 1st and June

10:06

8th, 2025.

10:09

B3 is a letter dated July 17, 2025 from

10:12

the planning director uh Jeffrey Knight

10:15

to the applicant notifying the applicant

10:17

of the time and place of the hearing.

10:20

Exhibit B4 was the hearing notice which

10:23

was posted upon the property in

10:24

question. Uh there was uh exhibit B5 is

10:29

the applicant's not uh notification

10:31

letters to required neighbors

10:34

application or uh exhibit number exhibit

10:37

B6 is the application packet with plans

10:41

uh for the proposal. Uh exhibit B7 is

10:45

the letter of um the applicant designing

10:49

signature signs as the representative

10:51

for this hearing. Uh board exhibit

10:54

number eight is the affidavit of the

10:56

property owner uh authorizing the

10:58

applicant to pursue the zoning uh

11:00

application. Uh exhibit B9 is the deed

11:03

to the property. Exhibit B10 is the

11:06

planning bureau case report and exhibit

11:09

uh B11 is the city of Harrisburg uh

11:12

planning commission resolution.

11:16

So the to the individual that was here

11:19

earlier, could you identify yourself?

11:24

from the developer. Okay. So, are you

11:27

here in favor of this application? Okay.

11:30

All right.

11:32

Mr. Ber, would you like to present your

11:34

case?

11:35

>> U Well, I have a few things to say here.

11:38

I mean, I

11:40

obviously the whole contention here is

11:43

because of the zoning of the two

11:45

properties. That's where the issue

11:47

became an issue, let's say. And I I did

11:52

the square footage of the front of the

11:54

building and the square footage at the

11:56

front of the building is 1,084

11:59

square feet

12:01

and the design that we're proposing is

12:05

50 square ft. So, which is 4.6%

12:09

of this building front, which is a very

12:12

small small percentage of the building

12:14

front. I know that the zoning for that

12:18

district is only 25 square

12:21

And I don't I don't see any issues with

12:24

it. It fits in the building and the spec

12:26

of the building which of course the

12:28

planning commission agreed with all

12:30

that. That's why they approved it. Um

12:33

the to me it's it's just a simple

12:36

process. I mean I don't think it's

12:38

complicated. I don't think there's any

12:40

issues. I don't think there's any body

12:43

that would complain about this or object

12:45

to it.

12:47

So the

12:50

I don't know what else to say. I mean I

12:52

think it's in my way of putting it. It's

12:55

kind of like a

12:58

an issue that should be approved and um

13:03

move on to better and bigger and better

13:05

things. That's basically what I could

13:06

say. I don't know what else to tell you

13:09

or to say.

13:12

>> Um could you tell us why a 25 foot

13:15

square foot sign would be inadequate at

13:17

this location.

13:19

>> Well, it's it's just that much smaller.

13:21

I mean, if you take that for instance,

13:24

it would be 2.6 square feet of the front

13:26

of the building. You kind of would get

13:28

lost. I mean, it's like a posting stamp

13:31

on there for 25 square feet. When you

13:33

think about the total square foot of the

13:35

front of that building, that's I mean,

13:38

it's even though to be honest with you,

13:41

the 50 square feet is adequate, but that

13:44

isn't as big as it I would think it even

13:47

should be. But um in the position of it

13:51

though, it's going on a on a position on

13:53

the building where it's where it's nice.

13:55

It looks proportional. There's nothing

13:58

objectionable to the view of it on the

14:00

building. And

14:03

I don't think that 50 square feet is

14:05

objectionable. At 25 square feet, it

14:09

would be like I said, kind of like a

14:12

postage stamp on that building.

14:15

And like I said, I mean, here's a

14:18

developer that did exactly what they

14:20

did, could not put this building on the

14:22

right zoning property because of the

14:26

pumps. So, they were forced to put it

14:28

here. And I think that the board should

14:31

grant the parents for them to put the

14:33

sign 50 square feet.

14:36

>> Does the board have any questions?

14:50

Yeah, sure. If you want to come up to

14:51

the microphone, please identify

14:53

yourself.

15:00

>> Hi. Um, my name is Jennifer. I'm not um

15:04

I actually didn't come here for that.

15:05

Just wanted to see the process because

15:07

I'm coming next month. But I'm very

15:11

familiar with the um property with the

15:15

job site. I own 1939 BOAS which is

15:19

directly behind the site. Um and I just

15:23

wanted to say first off what they are

15:27

doing is it's it's very nice. Um I the

15:32

area it was bad before what was there

15:34

before the the diner and the previous

15:37

gas station. and it was very rand, very

15:39

deteriorated.

15:40

Um, with how big the building is, I

15:44

believe if they put the sign, the

15:45

smaller sign, the 25 ft 25 square feet

15:48

sign because of the intersection, the

15:51

street that it's at when you're coming

15:54

down, um, 20th is on the left and then

15:58

it becomes a oneway. Uh, what is it?

16:00

Arsenal becomes a oneway and then her

16:02

comes up. a smaller sign, someone that's

16:05

that doesn't see in time that this is a

16:08

convenience store and they're going,

16:09

they need a convenience store, it may

16:11

cause um an accident or traffic

16:13

violations if they try to turn too fast

16:15

because they didn't see the sign ahead

16:18

of time. Um again, because of the

16:21

complicated it's it's becomes a oneway,

16:24

but then you could turn left also into

16:26

it. So, as someone from the

16:29

neighborhood, I would be in favor of a

16:33

bigger sign to alert someone that's

16:35

looking for a convenience store that's

16:37

driving past to alert them in time so

16:39

they can turn on their blinkers and turn

16:41

on 20th Street, which is how they would

16:43

be able to turn onto this. And if

16:46

they're coming from her street, they

16:48

wouldn't actually see the sign if it was

16:51

that small because it would be on the

16:53

right hand side and it kind of blocks it

16:54

the angle. they wouldn't be able to see

16:55

it if it was that small. And again, they

16:58

would try to make a turn last minute and

17:00

it may create accidents or other traffic

17:02

violations um because of the if they

17:06

didn't see it in time.

17:08

>> That was it.

17:09

>> Okay. Thank you.

17:12

questions.

17:17

Are there any traffic

17:21

coming off making?

17:25

>> Uh yes. So there is a um uh traffic

17:29

light on the far side of that

17:31

intersection. So basically along this

17:33

property uh if you're coming from uh

17:36

Arsenal Boulevard. Um so there's uh the

17:40

traffic light. There's uh some street

17:42

lights and there's some utility poles uh

17:45

along that frontage of the property with

17:47

um her street.

18:12

reason I'm trying to get

18:22

that

18:27

cut that

18:29

You're saying

18:38

even though it's lit and it's

18:39

electronic.

18:41

>> Correct.

18:43

>> What what you have to realize is that 25

18:47

or the 50 square feet is the out

18:50

dimension of the sign. Totally right to

18:52

left, totally top to bottom. That does

18:55

not have anything to do with the

18:56

lettering. in that square footage. So

19:00

basically, you take a 25 square foot

19:03

sign, increase it to 50 square feet, the

19:06

letters can get twice as big, which is

19:08

twice as noticeable. That's basically

19:11

the whole context there.

19:22

>> Mr. night. Was there any conditions that

19:24

the planning commission placed on uh

19:26

their

19:28

recommendation of approval?

19:30

>> Uh there were none. The pro the proposed

19:32

sign is otherwise in conformance uh with

19:34

the illumination um and it's not going

19:37

to have movable uh animation on the

19:40

sign. So it's otherwise in conformance

19:41

with the zoning code.

19:42

>> Okay. Thank you.

19:52

Make a motion.

19:54

So I make a motion that

19:59

we

20:02

with the conditions set by

20:06

>> there were there were no conditions. So

20:08

is your motion to approve uh the request

20:11

for dimensional variance in this matter?

20:13

>> Yes, it is.

20:17

>> There's a motion and a second. Um all

20:20

those in favor signify by saying I.

20:23

>> I.

20:24

>> Okay. Um you'll get a written decision

20:26

within 45 days of today's uh meeting.

20:30

>> Okay.

20:30

>> Thank you. Thanks.

20:34

Excuse

20:37

me.

20:38

>> Thank you.

20:56

Okay, we're ready for our next

20:57

application. This is a variance

21:00

application for 600 South 17th Street.

21:12

Uh Mr. Uh uh again um for this

21:17

application uh we have Jeffrey Knight

21:20

from the city of Harrisburg uh codes

21:22

office, Tarsa Cameron from the city of

21:25

Harrisburg solicitors office uh Claude

21:28

Fipps who is the chairman of uh zoning

21:32

hearing board and James Hobbes who is

21:34

the vice chair. uh for this is a um

21:39

application number 2606 for 600 South

21:43

17th Street. Uh Mr. Knight uh was

21:47

previously sworn in and indicated he

21:49

would be sworn in for all hearings uh

21:51

this evening. Um for the applicant,

21:55

could you identify yourself uh and spell

21:57

your last name, please?

21:58

>> Yeah. Uh Ben Orens, O R O Ns.

22:03

And what is your are you the applicant

22:05

in this matter?

22:06

>> No, I'm the owner of the sign company

22:08

Algra Image 360 on behalf of the client.

22:12

>> Okay. Um I'm going to read some uh uh

22:16

the uh list of exhibits that we have

22:18

pre-marked in this matter. Uh I have

22:21

marked as exhibit B1 the proof of

22:23

publication. The time and place of

22:24

particular nature of this matter was

22:26

published in Patriot News, a newspaper

22:28

of general circulation in the city of

22:31

Harrisburg. It appeared uh in the July

22:34

6th and July 13th uh publication.

22:37

Exhibit B2 is a letter dated July 17,

22:40

2025

22:42

uh from planning director Knight to the

22:45

applicant notifying uh the applicant of

22:48

the time and place of the hearing.

22:50

Exhibit B3

22:52

is the hearing notice posted on the

22:54

property

22:56

that was accomplished uh on June 29th,

22:59

2025. Exhibit B4 is the applica

23:02

applicants notification letters to

23:04

require neighbors. Exhibit B5 is the

23:07

application packets with plans for the

23:10

proposal. Exhibit B6 is the letter and

23:14

notice uh to uh uh of the property owner

23:18

authorizing the applicant to pursue uh

23:21

the zoning relief. Uh exhibit B7

23:25

uh is the u deed to the property.

23:28

Exhibit B B8 is the planning bureau case

23:32

report. Exhibit B9 is the city of

23:35

Harrisburg uh planning commission

23:38

resolution. And I'll just ask uh for the

23:41

record if there's anybody here that's a

23:43

citizen that is uh appearing this

23:46

evening uh because they have an interest

23:49

in this uh application.

23:53

I'll let the record reflect there are

23:54

none. Uh Mr. Knight, do you want to give

23:56

us a summary of this matter? Uh yes. So

24:00

uh the uh issue in case 2606

24:04

uh involves uh the um allowance of a

24:09

second sign uh on the property which is

24:11

one more than would be permitted by

24:13

right uh in the IND district. Um the

24:16

signage is otherwise in conformance with

24:18

the um allowable uh size and

24:21

illumination. It's 96.6

24:24

uh square feet. Um and uh the proposal

24:28

is actually part of a a larger um

24:30

project that involves um both the

24:33

replacement of the existing sign uh at

24:36

the um southwestern corner of the

24:39

intersection of uh 17th Street and um

24:43

forgetting off the top of my head here.

24:45

Uh Brookwood Street, sorry, to the

24:47

north. Um and so that sign will be

24:50

replaced uh with a sign that is in

24:52

conformance with the zoning code. And

24:53

then the applicant is also proposing to

24:56

install another sign at the southern uh

24:58

frontage of the uh front of the

25:01

building. Um now the uh second sign uh

25:06

the location uh creates the

25:08

justification uh for the applicant's

25:10

request. Uh, as noted, the current the

25:13

building occupies um a full city block

25:16

uh actually a little bit more um running

25:19

probably a couple blocks uh east west

25:21

and then the front is a full city block

25:24

uh north south. Um the existing sign

25:28

again is at the northern end of this

25:30

front elevation. So visible to that

25:32

intersection of 17th and Brookwood

25:33

Street. However, it is likely that a

25:36

majority of the uh applicants um

25:39

traffic, both visitors um and uh maybe

25:42

deliveries uh will be coming directly

25:44

from the south uh from um from

25:47

Interstate 83, which is uh just to the

25:50

um south of the railroad tracks that

25:51

border the uh southern edge of this

25:53

property. Um and the applicants uh have

25:57

one of their uh driveways onto the um

26:00

subject property and to the uh parking

26:02

area and loading docks at the rear of

26:04

the property um just to the south of um

26:07

the front of the building here. So if uh

26:10

they were only permitted to have one

26:11

sign by the time um deliveries and

26:14

visitors were able to uh get to the

26:16

northern end of the front elevation uh

26:19

to see it, they might have passed uh the

26:21

uh vehicular access point. Um

26:24

and then they'd be forced to maybe

26:26

either turn around or drive down

26:28

Brookwood Street, which uh having done

26:30

several site visits to the property, uh

26:33

is fairly narrowed by the fact that

26:34

there's a truck parking along the

26:36

southern side of the street and uh

26:38

there's a um drug treatment center just

26:40

to the north. So, there's parking along

26:41

that side of the street. It's really

26:43

only one lane even though it's two-way

26:44

traffic. So, uh, for the benefit of, um,

26:47

visitors and, uh, deliveries, uh, it is,

26:51

um, reasonable to have the sign at the

26:54

southern end of the building near that

26:55

vehicular access point so that people

26:57

coming off the highway, uh, can quickly

26:59

identify the building and turn in, uh,

27:01

on the safest vehicular access point.

27:04

Um, again, the signage is otherwise in

27:06

conformance with the zoning code. So uh

27:10

the proposal uh does represent uh the

27:12

minimum deviation uh from the zoning

27:14

code because it's one additional sign um

27:16

when only one is permitted by right and

27:19

therefore uh the planning bureau uh and

27:21

the planning commission uh both

27:23

recommend approval uh of the request for

27:26

the following reasons. The proposed

27:28

signage will better identify the

27:29

business and appropriately direct

27:30

vehicular traffic to the on-site parking

27:33

for visitors from the south and

27:34

specifically from Interstate 83 where

27:36

the majority of deliveries, shipments,

27:37

and visitors are anticipated. And aside

27:40

from the zoning relief required for an

27:41

additional sign beyond that permitted by

27:43

right in the IND district, the proposed

27:45

signage is otherwise in conformance with

27:47

the size, height, and illumination

27:48

requirement.

27:50

>> And the planning commission has no

27:52

conditions.

27:53

>> That is correct.

27:54

>> Okay. And um is there one tenant in this

27:59

building?

27:59

>> I believe so. Yes.

28:01

>> Okay. Is that I saw some of the plans.

28:03

Is it HB McCor?

28:04

>> I think so. Yeah. And I believe they've

28:06

been there for a little bit. Yeah.

28:08

>> Occupies the entire building.

28:09

>> Yeah.

28:10

>> Okay.

28:12

So, do you uh

28:14

do you have anything to add or to

28:17

present in this matter?

28:18

>> Um

28:20

not much beyond uh what was just said.

28:23

Um

28:25

because technically it is it is it is

28:27

two business units you know under common

28:29

ownership they have the HB mcclor side

28:31

and the HB home side so along with the

28:34

identification they want to you know as

28:37

as a big of a business as they are they

28:40

want to denote both business units on

28:42

the side of their building HP home on

28:44

the left HP on the right you were

28:46

looking at it straight on

28:49

>> and you're a in agreement with uh the

28:51

testimony of Mr.

28:54

I am.

28:54

>> Okay. Does the board have any questions?

29:00

>> Uh, I just going to ask Mr. Knight, um,

29:02

has there been any, I guess, recent, uh,

29:04

approvals to a similar type of request

29:07

to have multiple signs?

29:09

>> Um, in this general vicinity or just

29:12

overall,

29:16

>> I guess general vicinity is is

29:18

>> um, I can't think of any off the top of

29:20

my head for uh, this particular area. I

29:23

know um just one that springs to mind is

29:26

uh I believe um Harrisburg University

29:28

downtown several years ago uh had a

29:30

larger building where they were

29:31

proposing uh signage at the top on three

29:34

uh of the facades uh where two would

29:36

have been permitted by rights. So that's

29:37

a similar request.

29:39

>> Okay. Thank you.

29:49

>> They will not

29:59

Uh well, both of these signs are facing

30:01

uh 17th Street and I believe across the

30:03

street is um a an auto repair shop and

30:07

uh there is some other industrial

30:09

activity at the southern end of that

30:10

block.

30:18

>> Miss Cameron, do you have any questions?

30:32

66.

30:40

>> Yep.

30:43

You're so Okay. So your motion is is to

30:46

approve the uh the application for the

30:49

eventual variance for a second sign.

30:53

>> Is there a second?

30:54

>> Second.

30:55

>> All those in favor signify by saying I.

30:58

>> I.

31:00

>> Okay. Well uh congratulations. Uh we

31:03

will uh issue a written decision uh

31:05

within 45 days of today's hearing.

31:08

>> Okay.

31:10

Do you need these hardigital?

31:12

The digital. Thank you.

31:24

Okay. Next uh application is application

31:27

2607. This is a variance application

31:31

relative to the property located at 1332

31:34

North 2nd Street in the city of

31:36

Harrisburg.

31:38

Um,

31:44

looks like the applicant is Bitner

31:46

Reynolds LLC.

31:50

And

31:54

for this hearing uh again um we have uh

31:58

Claude Fipps who's the chair of this

32:01

board and James Hob Hobbs who's the vice

32:04

chair. Um

32:07

Jeffrey Knight uh was already sworn in

32:09

and indicated that he would be sworn in

32:11

for all future hearings including this

32:13

one. Um he's a zoning administrator.

32:18

Uh we have uh Tissa Cameron uh from the

32:22

solicitor's office. Um

32:26

Mr. Clark, uh do you want to introduce

32:28

yourself uh and u whoever you're going

32:31

to have testify today?

32:33

>> Sure. Uh good evening. My name is Jeff

32:35

Clark, attorney at Wixer and Widner

32:39

representing Bitner Rentals. And with me

32:41

is Nathan Bitner.

32:44

>> Okay. Is uh Mr. uh um

32:50

Bner going to testify today.

32:52

>> Uh possibly and certainly available to

32:54

answer questions.

32:55

>> Okay. So, should we swear him in just in

32:57

case? Uh could you uh uh identify

33:01

yourself, Mr. Bner? For the record,

33:04

spell your last name and then we'll

33:05

swear you in.

33:07

>> Nathan Bner,

33:10

>> could you raise your right hand? Do you

33:11

swear or affirm the testimony you're

33:13

about to give before this board is the

33:14

truth and nothing but the truth? Okay,

33:17

I'm going to u mark some uh exhibits

33:20

that were forwarded to the board um so

33:24

that we have them on record. I have

33:26

marked as exhibit B1, the proof of

33:28

publication. The time and place and

33:30

particular nature of this matter was

33:32

published in the Patriot News uh which

33:35

is a newspaper of general circulation uh

33:38

in the city of Harrisburg. publication

33:40

appeared on in the July 6th and July

33:43

13th

33:45

um publication. Exhibit B2 is a letter

33:49

dated July 17, 2025 from the planning

33:53

director to the applicant notifying the

33:55

applicant of the time and place of this

33:57

hearing. Exhibit B3 is a hearing notice

34:00

uh posted upon the property in question

34:02

that occurred on June 29th, 2025. Board

34:06

exhibit number four is the applicant's

34:08

notification letters to the required

34:10

neighbors. Board exhibit number five is

34:13

the application package

34:16

um with the attached narrative aerial

34:19

map of the property and street view

34:23

photos of the property. Uh board exhibit

34:26

number six is the deed of the property

34:28

establishing the applicant standard to

34:30

pursue zoning relief in this matter.

34:33

Board exhibit number seven is the

34:36

planning bureau's case report and board

34:39

exhibit number eight is the city of

34:41

Harrisburg uh planning commission

34:43

resolution.

34:45

Um and again before u we start with the

34:48

applicant um and if you want to just

34:51

give a a general Mr. Knight a general

34:53

overview of this matter.

34:55

>> Sure. Um so the issue for case number

34:57

2607

34:59

uh is um the use of the current

35:02

accessory parking lot on the subject

35:04

property as a commercial parking lot uh

35:06

available to uh residents or uh

35:09

customers of businesses in the immediate

35:10

area. Uh currently uh the property is

35:14

functioning as uh both a funeral home

35:16

and a an apartment building. Uh so the

35:20

existing parking lot on site uh provided

35:22

parking uh for both the uh residents of

35:25

the property as well as um visitors and

35:28

employees of the business on site. Uh as

35:30

the applicant attested to at the

35:33

planning commission meeting, uh the

35:36

business um of the funeral home has kind

35:38

of gradually been winding down to the

35:40

point where they're only doing I think a

35:41

a funeral a month. Uh they testified. Um

35:44

so uh the need for parking has certainly

35:47

been greatly lessened from when the

35:49

height of that use would have been and

35:51

there are five apartments on site but

35:53

certainly uh more parking than is

35:56

required for um the tenants of those

35:58

units. Uh and so the applicant uh is

36:01

proposing um not really any change in

36:05

the use or the development per se uh but

36:08

in who can use the park uh the who can

36:11

use the parking lot. Um

36:14

the uh property is located outside of

36:18

the of the city's competing parking

36:20

area. So the um that is not a

36:23

consideration in this case. Uh would be

36:25

you know whether that would be in

36:27

conformance with that agreement or not.

36:29

Um that is no longer uh that is not

36:31

applicable uh to this particular site.

36:33

Um and uh so the applicant is uh simply

36:38

seeking to use the existing

36:40

configuration of the property in a

36:42

different way uh and in a way that will

36:45

uh be of benefit to the surrounding

36:47

community. Um you know parking can

36:50

certainly be difficult at uh times uh on

36:53

uh Second Street uh and on uh nearby

36:56

Verbeck Street. Um there are

36:58

occasionally people uh parking in the

36:59

vacant lot that's about a block away on

37:02

Front Street there. Uh so there is

37:04

certainly a um a demand uh for more off-

37:08

streetet parking which again will bring

37:10

the parking on street into uh hopefully

37:12

better and safer uh conformance with the

37:14

city's regulations. Uh so with that

37:17

being said uh the planning commission

37:21

recommended that the zoning hearing

37:22

board approved the request uh with the

37:24

following conditions. Uh the applicant

37:26

should provide a site plan of the

37:27

proposed surface parking lot including

37:29

aspects such as line spaces and driveway

37:31

aisles with dimensions to confirm the

37:33

parking lot will be in conformance with

37:34

applicable regulations. The site plan

37:36

should be should identify ways in which

37:38

to bring the property into conformance

37:39

with the applicable zoning regulations

37:41

such as the inclusion of landscape

37:42

screening and possibly street trees

37:44

planted in the corners of the lot. Um

37:46

and to be clear, uh because the property

37:49

is already existing as a surface parking

37:51

lot, um you know, any non-conforming

37:54

aspect with respect to those, um uh

37:57

sections of the zoning code would be a

37:59

legal non-conforming aspect. Um but we,

38:03

you know, realize that in um changing

38:06

it, uh or in changing the use and

38:08

availability of parking, uh the

38:10

applicants may be seeking to do some

38:12

additional work to the site, repaving

38:13

perhaps. Um and so uh we thought it

38:17

would be prudent to if that was going to

38:19

be done um look for ways to bring the

38:21

property into conformance uh for

38:23

aesthetic purposes if nothing else

38:25

landscape screening things of that

38:26

nature. Um but again that's uh more of a

38:31

recommendation uh and you know less of a

38:33

requirement because the existing

38:35

configuration of the lot is a parking

38:37

lot so it can be used as that going

38:38

forward. Um, and then the planning

38:40

bureau did recommend the removal of one

38:41

of the second street cuts to remove a

38:43

vehicular pedestrian conflict point if

38:45

the applicant does not intend on

38:46

utilizing both access points or possibly

38:48

relocate a vehicular access to Safford

38:50

Street. Uh, the reason that was added

38:52

was during our site visit. We noted that

38:54

one of the access points was uh chained

38:56

off. Um, so we were unsure of whether

38:59

the applicant was only intending on

39:00

using uh one of the access points. Uh,

39:03

and so that was what uh that condition

39:06

referenced. Um, in the discussion at the

39:09

planning commission meeting, the

39:10

applicants confirm they do that to uh

39:12

prevent parking by residents um of the

39:16

of the neighborhood um currently uh

39:18

which again they would not be permitted

39:19

to do really. So once the uh presuming

39:22

approval is granted uh by the zoning

39:24

hearing board, they would likely open up

39:26

both vehicular access points. So that

39:28

would kind of make that condition move

39:30

at that point. Uh the planning

39:32

commission uh recommends the zoning

39:34

hearing board approve the request for

39:36

the following reasons. The proposed use

39:38

does not require zoning relief for any

39:40

proposed development or use but rather

39:42

who would be using the existing parking

39:45

spaces and thus represents a deminimous

39:47

deviation from the zoning regulations

39:49

which meets the applicable criteria in

39:51

the zoning code. uh and I should have

39:52

clarified earlier that the property is

39:54

in the residential medium density uh

39:56

district which does not permit

39:57

commercial parking lots by right and

39:59

that's what is necessitating the

40:00

variance application in this case. Um,

40:03

number two, while service parking lots

40:05

are generally not advisable from a

40:06

planning perspective as they represent

40:08

an underutilization of valuable urban

40:10

land and create impacts such as storm

40:12

water runoff and urban heat island

40:13

effect, in this instance, it is

40:15

reasonable to maximize the utility of

40:16

spaces in an existing lot by leasing

40:18

parking to local residents. And finally,

40:21

reuse of the property to accommodate

40:22

parking demand created by residents and

40:24

businesses at the surrounding

40:25

neighborhood can provide benefits by

40:27

reducing on street parking near

40:28

intersections, in crosswalks, and on

40:30

vacant lots. And the site can be

40:31

designed to incorporate elements such as

40:33

landscape screening that improve the

40:34

aesthetics of the property.

40:38

>> Okay. Thank you. Um is there anybody

40:41

here um

40:44

for this application? Anybody?

40:48

Okay. Well, we'll let the record reflect

40:50

that there are no citizens here um

40:54

for this particular application. Mr.

40:56

Clark, would you like to proceed with

40:58

your case?

40:59

>> Sure. um like to ask Mr. Bitner a couple

41:02

uh questions about the application. Uh

41:06

Mr. Bitner, are you the um managing

41:08

member of Bitner Rentals LLC? I am. And

41:12

when did when did you purchase this

41:14

property?

41:17

>> And was it in its current configuration

41:20

when you purchased it? Current use.

41:25

>> Um and so have you Does it currently

41:30

operate as a funeral home and then also

41:34

as it does? Yes. About how many funerals

41:38

are held at the

41:42

do about one a month.

41:45

Um and so and it has do the residents of

41:49

the multif family apartments use the

41:52

parking spaces.

41:54

So is there one each for each? How many

41:56

apartments are there? Five. They each

41:58

have

42:00

Yes. And so is the remainder of the

42:03

parking lot more or less unused.

42:07

About how many parking spaces are

42:14

um and so we're here on an application.

42:19

You would like permission. you would

42:20

like to change the use to a commercial

42:24

parking lot

42:27

and do you intend to have

42:30

what basis would you rent the parking

42:33

spaces on a monthly basis? So permit

42:36

parking for on a monthly basis.

42:40

Um

42:41

do you

42:44

is it currently listed for SIM? It is.

42:48

>> Does it appear what what kind of

42:52

market? What does it seem like it's

42:55

showing? What kind of purchases are

42:57

showing interest in that way? We've had

43:00

people look at it.

43:11

And before it was a funeral home, was it

43:15

was it a town home in the first place?

43:18

>> So I I know that funeral

43:30

and so if converted, it still wouldn't

43:33

use all of the parking spaces for the

43:35

parking lot.

43:37

Um

43:40

the

43:43

guess the other question I would have

43:45

there there was a question about it

43:47

being one of the there's two entrances

43:49

on second

43:51

>> and you have one sort of chained off.

43:53

Can you explain why that is? So when we

43:56

purchased the purchases

44:28

All right. Um,

44:31

do you

44:34

if if the permission is granted to use

44:36

it as a commercial parking lot, would

44:38

you intend to comply with zoning

44:41

regulations as a

44:48

further question?

44:52

Board have any questions?

44:54

Mr.

45:00

Good evening

45:02

question.

45:33

I got

45:33

>> I I don't know that he I mean I think it

45:36

would it would be insured within

45:38

whatever requirements there are. But to

45:40

be honest, I I don't know if he's able

45:42

to answer that question. I don't know

45:44

the answer either other than

45:58

But you're basically

46:09

present.

46:25

I think it in answer to your further

46:28

answer to your question I think as part

46:30

of the multif family use they might be

46:32

required to have parking for the

46:34

residents. So I think the intent would

46:36

be that the residents would have parking

46:47

and they park there.

46:54

>> Yeah, I I mean I don't know whether

46:55

they'd be able to park on second or I

46:57

believe Calder is to the north there. Um

46:59

but again I think the applicants uh

47:01

intend on providing parking not just for

47:04

um you know current uh residents but if

47:08

the funeral home goes away and the uh

47:11

apartment use expands they would provide

47:12

it for those residents as well.

47:39

Good evening. Um, so I just had a

47:41

question. I know it was mentioned right

47:42

that

47:44

I guess with having minimal activity in

47:48

terms of business for the funeral home

47:50

that kind of leads into this this uh

47:52

proposed use. Is that minimal activity

47:56

is that something I guess that's

47:57

purposeful? Are you planning are you

47:59

phasing that that business out? And I'm

48:01

just asking because of course if that

48:03

activity were to increase then that

48:05

would potentially conflict with it use.

48:07

>> We have two other funeral homes in the

48:09

Harrisburg area.

48:23

got. Okay. All right. Thank you.

48:28

I just have one or two questions. Um,

48:32

Mr. Bitney, you indicated that the

48:34

funeral home is listed for sale. How

48:36

long has that been listed for sale?

48:46

When did you put it back on?

48:52

>> Okay.

48:52

>> Not the funeral home itself.

48:56

>> Real estate. Okay. And and you said that

49:00

there were there were people looking for

49:01

it, but they wanted to change it into

49:03

apartments.

49:05

>> Yeah. A while back we had

49:12

contract.

49:20

>> Okay. And Mr. uh Knight, if someone were

49:24

to purchase this uh the uh the building

49:28

where the funeral home was in and wanted

49:30

to change or convert it into apartments.

49:34

um would that be allowed in this uh

49:37

zoning district?

49:38

>> So, they would have to file a special

49:40

exception for an expansion of a

49:41

non-conforming use because a multif

49:43

family dwelling is not permitted by

49:44

right in the RM zoning district. Um

49:47

given the size of the property, I would

49:49

anticipate you could add a few more

49:52

units without um triggering zoning

49:54

relief for the density. Um but at a

49:57

certain point if they added you know

50:00

five six units they would have to get a

50:03

variance for relief from the density

50:04

regulations as well.

50:06

>> Okay. And then

50:09

uh

50:10

would you agree that the uh request here

50:13

is uh is for a use variance? Is that

50:16

correct?

50:16

>> Uh yes.

50:19

>> Um

50:25

Any other questions?

50:44

At the very least, there again, there is

50:46

a five unit multif family dwelling

50:48

currently on site. Um, so at the very

50:50

least, they'd come back for a special

50:52

exception to expand an existing

50:54

non-conforming aspect of the property.

51:06

If if they if they just left uh the

51:09

property alone, did not replace the

51:11

funeral home space with additional um uh

51:15

residential units, then they would not

51:16

come back before the board. It would

51:18

only be if they converted that space

51:20

into additional

51:42

Okay. Mr. Clark, do you have anything

51:43

else?

51:46

>> Uh, the only thing I guess I would

51:47

mention as to uh the use variance is

51:50

there is case law I think changing an

51:54

accessory parking lot to a commercial

51:56

parking lot is is I would say a de

52:00

law that you can consider a change for a

52:03

use. So

52:05

>> do you have that case with you? I don't

52:07

have the case, but I the site uh is

52:10

versus zoning hearing board of East

52:12

Bradford Township.

53:00

Okay, we're going to if there's nothing

53:02

more, uh, Mr. Clark, we're we're going

53:05

to recess and they have some qu legal

53:07

questions and then we'll be back. Okay.

53:09

>> Okay.

53:27

What are you doing?

53:56

these guys. I appreciate

54:25

Yeah,

54:48

They have

1:06:51

uh does a board member have uh

1:06:56

does a board member have a uh is there

1:06:59

any motion uh before the board to be

1:07:02

presented?

1:07:03

>> Yes. regarding application 2607. I would

1:07:06

like to make a motion to uh deny the

1:07:09

request for variance.

1:07:12

There's a motion. Is there a second?

1:07:13

>> I second.

1:07:15

>> Moved.

1:07:17

Moved and seconded. Uh all those in

1:07:19

favor signify by saying I.

1:07:21

>> I.

1:07:23

>> Okay. The motion uh to for the denial of

1:07:26

the application

1:07:28

uh was approved by the board. you'll get

1:07:30

a written decision within 45 days of

1:07:32

today's uh hearing. Thank you.

1:07:47

Next is application 2608.

1:07:52

This is an application relative to the

1:07:54

property located at 2001 Lennox Street.

1:08:16

Okay, for this uh hearing um again for

1:08:20

the record because these are independent

1:08:22

uh hearings, we have Claude Fipps, who

1:08:25

is the chairman of the zoning hearing

1:08:26

board. Uh and James Hobbs uh that is the

1:08:30

uh who is the vice chair. Um my name is

1:08:34

Mike Pyosh. I'm the solicitor for the

1:08:36

zoning hearing board. Uh Jeffrey Knight

1:08:39

is here from the uh uh K uh city codes

1:08:44

office. He was sworn in uh at a uh

1:08:47

previous hearing this evening and uh

1:08:50

noted that he will remain sworn in uh

1:08:53

for uh every hearing this evening

1:08:56

including this one. We have uh Tersa

1:08:59

Cameron Cameron uh from the solicitor's

1:09:02

office present.

1:09:04

uh and uh

1:09:07

we'll uh

1:09:09

we'll swear in the applicant. Could the

1:09:11

applicant um could you uh introduce

1:09:14

yourselves um and spell your last names

1:09:16

for the record?

1:09:17

>> My name is Dean Morgan. I'm an attorney

1:09:18

for Mr. Usher.

1:09:20

I can't pronounce a who is the owner of

1:09:24

the property.

1:09:26

>> Okay.

1:09:26

>> Tonight I might be giving testimony. So

1:09:28

I will beating.

1:09:30

>> Okay.

1:09:32

And um what was your client's name? Can

1:09:35

you

1:09:37

>> Oh, Sam. I'm sorry. The owner is

1:09:40

Shamboo. S H A M B H U A Sheria. A C H A

1:09:45

R Y A.

1:09:49

>> Okay. Mr. Morgan and Mr. Sheria, could

1:09:52

you uh please raise your

1:09:54

>> This is not Mr. This is

1:09:56

Construction.

1:09:59

>> Okay. What is your name?

1:10:01

>> Geraldic.

1:10:03

>> Gerald Radic. Could you spell your last

1:10:05

name?

1:10:12

>> For the record, Mr. was not able to make

1:10:15

it tonight.

1:10:17

>> Okay. You're his attorney. That's so

1:10:19

that's fine. And then you said Mr.

1:10:21

Radzik, your first name is Gerald.

1:10:23

>> Yes.

1:10:24

>> Okay. Uh Mr. Radzik and Mr. Morgan. Um,

1:10:29

could you please uh raise your right

1:10:31

hand? Do you swear affirm testimony

1:10:33

you're about to give before this board

1:10:34

is the truth and nothing but the truth?

1:10:36

>> I do.

1:10:37

>> Okay. And just for the record, um is

1:10:40

there uh anybody here uh anybody else

1:10:44

here for this application?

1:10:48

Uh we'll have the record show that there

1:10:49

is uh no one here u present for this

1:10:53

application other than the applicant. Uh

1:10:56

with that uh I'm going to mark some

1:10:58

exhibits

1:11:00

uh for the record.

1:11:06

I have marked as exhibit B1, the proof

1:11:08

of publication. Uh the time and place

1:11:11

and particular nature of this matter was

1:11:12

published in the Patriot News, a

1:11:14

newspaper general circulation for the

1:11:16

city of Harrisburg. Um the ads appeared

1:11:21

on July 6th and July 13, 2025. Exhibit

1:11:25

B2 is a letter dated July 17, 2025 from

1:11:29

the planning uh director to the

1:11:31

applicant notifying the applicant of the

1:11:33

time and place of the hearing. Board

1:11:35

exhibit number three is the hearing

1:11:37

notice uh posted upon the property in

1:11:40

question which was accomplished on June

1:11:43

29th, 2025.

1:11:45

Exhibit B4 is the applica applicant's

1:11:47

notification letters to the required

1:11:49

neighbors. Exhibit B5 is the application

1:11:52

packet with the attached narrative

1:11:55

aerodial map

1:11:58

and

1:12:16

uh exhibit B5 is the application packet

1:12:18

with the attached narrative.

1:12:20

photos of the interior um and exterior

1:12:24

of the property uh the plans for

1:12:27

proposal

1:12:29

uh and the application uh signed by the

1:12:32

applicant and property uh owner. Exhibit

1:12:35

B6 is the deed to the property

1:12:37

establishing the applicant standing to

1:12:39

pursue relief. Board exhibit number

1:12:42

seven is the planning bureau case report

1:12:44

and board exhibit number eight is the

1:12:45

city of Harrisburg planning commission

1:12:47

resolution. So we have exhibits B1

1:12:50

through B8 and um Mr. Knight, would you

1:12:54

uh please give a um general overview of

1:12:58

this matter?

1:12:59

>> Uh sure. So, uh, the proposal for case

1:13:02

2608,

1:13:04

um, involves, uh, the reestablishment of

1:13:08

a two-unit multif family dwelling on the

1:13:10

subject property, uh, which requires at

1:13:12

least one special exception and one

1:13:14

variance, the special exception for the,

1:13:16

uh, multif family dwelling use in the RM

1:13:18

zoning district. uh and the variance for

1:13:21

uh relief from the density regulations

1:13:24

uh in the um in section 7-307.3

1:13:28

of the zoning code. Um I do uh I did add

1:13:32

a second um zoning relief application

1:13:36

for relief from the off- streetet

1:13:37

parking in the event that it could not

1:13:39

be provided and I'll discuss that in a

1:13:41

little bit. Um so in uh this case the

1:13:45

property had previously uh operated as

1:13:48

two units uh per the city's um records

1:13:51

up until I believe the early 2000s. Um

1:13:56

and then or maybe the late 1990s. Uh and

1:14:00

at that point uh the property reverted

1:14:03

back to a single family dwelling um and

1:14:05

had remained that way uh up until uh Mr.

1:14:09

Chara's uh recent uh purchase of the

1:14:11

property um and during which he sought

1:14:15

to uh con revert the property I guess

1:14:17

back to um two units. Uh the um

1:14:23

while the planning bureau has not been

1:14:25

inside the property uh per the

1:14:27

applicant's uh testimony at the planning

1:14:29

commission meeting uh there are um there

1:14:32

is a first floor unit of the property

1:14:34

and uh a unit on the upper floors as

1:14:37

well. Um, now the there is a um kitchen

1:14:42

in both of these units. Um, but per the

1:14:44

testimony at the meeting, there does not

1:14:46

appear to be a bedroom on the first

1:14:48

floor unit. Uh, so it's likely that at

1:14:51

some point in the past, again in the

1:14:52

1990s, maybe the 1980s. Um,

1:14:56

a previous owner might have established

1:14:58

like an in-law unit or something on the

1:15:00

upper floors. Otherwise, they would have

1:15:02

had a bedroom for themselves on the

1:15:04

first floor. Um, so it was likely, you

1:15:06

know, they were living in it, created

1:15:08

this uh second kind of mini unit, uh,

1:15:10

with its own kitchen and own bathroom.

1:15:13

Um, and, uh, the applicant is seeking to

1:15:16

go back, uh, to that configuration. Um

1:15:19

so there is uh a justification

1:15:23

uh for uh the proposed variance um and

1:15:27

the special exception uh given the uh

1:15:30

previous configuration of the property

1:15:32

the existence of um two kitchens and its

1:15:37

operation uh as that two unit. Uh with

1:15:40

respect to the relief from off streetet

1:15:41

parking, uh we do note that there is a

1:15:43

two bay garage at the rear of the

1:15:45

property accessible um from sorry uh

1:15:50

Lennox Street um or sorry, South 20th

1:15:54

Street. Uh it's a little unclear whether

1:15:58

uh the bays are accessible. Uh they

1:16:01

currently have wooden doors over them.

1:16:03

Uh not sure if they're operable. There

1:16:04

are two cars parking uh in the driveway

1:16:07

right in front. Um however we note that

1:16:09

driveway is actually the public right

1:16:11

ofway and uh the cars are parked across

1:16:13

sidewalks. Uh so they do not constitute

1:16:16

um legal parking spaces. Uh but again

1:16:18

we're not sure whether these the doors

1:16:20

on the garage can be opened or not. If

1:16:22

uh they can or if they can be removed

1:16:24

and tenants can park in them, then the

1:16:26

applicants would have the required off-

1:16:27

streetet parking. Uh in the event that

1:16:29

they cannot be opened or vehicles cannot

1:16:32

be parked in there. Uh given that it's a

1:16:34

corner lot, it has frontage along South

1:16:36

20th Street and Lennux Street. Um we

1:16:38

believe that uh there is sufficient on

1:16:40

street parking to provide park the two

1:16:43

off- streetet parking spaces uh required

1:16:45

for the property. Uh with that being

1:16:48

said, the uh planning commission and the

1:16:52

planning bureau uh recommended that the

1:16:56

zoning hearing board approved the

1:16:57

request for the following conditions. If

1:16:59

granted zoning approval to move forward

1:17:01

with the project as proposed, the

1:17:02

applicant shall allow the codes bureau

1:17:03

to perform a comprehensive inspection to

1:17:05

identify any outstanding code violations

1:17:07

and will receive approval for all

1:17:08

necessary city permits prior to

1:17:10

receiving a certificate of occupancy. Um

1:17:13

and uh as uh they testified to at the

1:17:15

planning commission meeting, the

1:17:16

applicants have been in coordination

1:17:18

with the codes bureau uh and has had has

1:17:21

had multiple codes officer visits to the

1:17:23

site um to review aspects of the

1:17:25

building related to the electrical panel

1:17:28

um related to um some of the um some of

1:17:33

the other elements inherent in uh

1:17:35

establishing a multif family dwelling on

1:17:37

site. Um,

1:17:39

but we do want to ensure that any work

1:17:41

that was done previously to kind of

1:17:43

create that second unit, you know, is up

1:17:45

to code. Um, I believe the applicant,

1:17:48

um, Mr. Radzig testified that they had

1:17:50

to replace the, uh, electrical panel

1:17:53

because it wasn't up to code. So, we

1:17:55

want to make sure that the rest of the

1:17:56

property is in a similar state. Um, and

1:17:59

then the second condition was the

1:18:00

applicant must remove the fence between

1:18:01

the driveway and Chalky Alley, which is

1:18:03

currently blocking the public right

1:18:04

ofway, and require tenants to either

1:18:06

park in the garage or on the street to

1:18:08

ensure that an ADA compliant sidewalk is

1:18:10

maintained along South 20th Street. Um,

1:18:12

along the South 20th Street frontage,

1:18:15

uh, when you get to Chalky Alley at the

1:18:16

rear of the property, there's a small

1:18:18

wooden fence built there. Uh, and in the

1:18:20

past that didn't really have much of an

1:18:22

impact because the property just

1:18:23

directly to the south was a car

1:18:25

dealership and uh the cars were parked

1:18:28

uh all the way up to the uh cartway to

1:18:30

the street basically. So there was no

1:18:32

pedestrian path. Uh in the last couple

1:18:34

years uh that property has been

1:18:36

redeveloped and as part of that the city

1:18:37

required them to install um sidewalks

1:18:40

along that. So now there is a compliant

1:18:42

path or now there is an existing

1:18:44

pedestrian path uh from the property uh

1:18:47

to the property of the south across

1:18:49

Chalky Alley. So we want to ensure

1:18:50

that's opened up to provide uh

1:18:52

pedestrian access there. Um the planning

1:18:56

commission recommends the request be

1:18:57

approved for the following reasons. Uh

1:18:59

the zoning relief request for the

1:19:01

proposed use are warranted by the

1:19:02

history of the property which has

1:19:03

operated in the past as two units as

1:19:05

well as the configuration of the

1:19:06

property in which existing elements such

1:19:08

as a rear fire escape to the second

1:19:09

floor provides a co building code

1:19:11

required secondary egress. Uh the

1:19:14

project will address the primary concern

1:19:15

of the public regarding such

1:19:16

convergence, specifically the impact on

1:19:18

parking available to existing residents

1:19:20

through the provision of the required

1:19:22

parking in the detached garage at the

1:19:23

rear of the property and due to the

1:19:25

availability of ample on street parking

1:19:27

along the frontage of the property with

1:19:28

South 20th Street and Lennox Street.

1:19:34

>> Thank you. U Mr. Morgan, do you want to

1:19:38

present your case? Um

1:19:42

with respect to the planning

1:19:43

commission's recommendations

1:19:45

uh and specifically with respect to the

1:19:48

condition regarding removing the fence

1:19:51

uh Mr. is certainly able and willing to

1:19:54

do so. Uh with respect to the matter of

1:19:58

it being a two unit, I would also like

1:20:01

to note that not only were there two

1:20:03

kitchens, there's fireplace, there are

1:20:06

also two electrical panels which were

1:20:08

part of this building beforehand. It's

1:20:11

evident this has always been operated as

1:20:14

a twounit

1:20:17

facility. Whether during 1999 to 2022 it

1:20:22

was a single family living there. It's

1:20:24

evident that this has always operated

1:20:27

with two

1:20:29

separate tents. Um, with respect to the

1:20:35

garage, uh,

1:20:38

because there's ample street parking, we

1:20:41

and because the age of that garage

1:20:44

can tell us a little bit more about

1:20:45

that, uh, it's likely that we would need

1:20:48

to only be able to have off on streets

1:20:52

there.

1:20:54

that garage was built long time ago

1:20:58

and it's not ample it's not it's

1:21:01

probably not of the correct size for

1:21:03

vehicles modern

1:21:08

and with that I would rely on the

1:21:10

information provided in the planning

1:21:12

commission approval would ask for

1:21:19

>> Mr. Rajik I had a a question uh Mr.

1:21:22

Knight indicated that there is not a

1:21:24

bedroom in the uh lower level unit.

1:21:27

>> Yes. Uh where where would a person

1:21:30

sleep?

1:21:53

chose the

1:21:55

ch.

1:22:04

>> Okay. So, you have one bedroom on the

1:22:06

first floor and what would be the

1:22:08

occupancy for the second floor?

1:22:11

[Music]

1:22:19

Well, do you know or you're the

1:22:21

contractor? Do you know how many

1:22:22

bedrooms are up there?

1:22:25

>> Okay.

1:22:28

And and I do believe the um the property

1:22:31

owner testified that there are three

1:22:33

bedrooms up there and and a tenant

1:22:36

showed up at the planning commission

1:22:38

meeting and testified there were three

1:22:39

bedrooms up there.

1:22:40

>> Okay.

1:22:40

>> Yes.

1:22:44

>> And and I do apologize. I thought this

1:22:47

was included in the packet. These are

1:22:48

the these are the drawings that reflect

1:22:51

a bedroom on that first and I can

1:22:54

certainly publish that.

1:22:56

the board if you'd like to. I thought

1:22:58

that was already included in the packet.

1:23:02

>> I do I do see um it's pretty small but I

1:23:06

see the second floor here.

1:23:08

>> So on that first page directing your

1:23:09

attention to the bottom left hand corner

1:23:12

which reflects the first floor. You'll

1:23:14

see that it is a kitchen area, a living

1:23:17

room and then a bedroom and then a

1:23:20

sitting there.

1:23:28

Your eyes are as bad as mine. I'm happy

1:23:30

to show you the full copy.

1:23:35

What's there's a on the one plan there's

1:23:38

a third floor there. There is which

1:23:41

comes up from the second floor. That

1:23:43

would be the same unit. Second floor.

1:23:50

>> Oh, I see. So the the second floor It

1:23:53

has two bedrooms. It's all one unit, but

1:23:56

two bedrooms on the second floor and one

1:23:58

on the third floor.

1:23:59

>> Yes.

1:24:02

>> Two on the third floor, one on second.

1:24:06

>> And then the other room there is a

1:24:08

living room.

1:24:10

>> Oh, I see. So on the third floor you

1:24:13

have storage, a bedroom, a bedroom, and

1:24:16

then storage.

1:24:18

And then on the second floor, you have

1:24:20

the kitchen, living room, and a bedroom.

1:24:24

But and all that, that's all one unit.

1:24:27

And then the first floor

1:24:29

is a kitchen, living room,

1:24:33

you're going to put in a a a bedroom,

1:24:37

and there's going to be a sitting room.

1:24:38

>> Yes.

1:24:39

>> I see.

1:24:43

I don't have any other questions. Board,

1:24:45

have any questions?

1:25:17

Yeah. So when we look at uh properties

1:25:19

like this um we go back through

1:25:22

essentially what are the codes bureau

1:25:23

records although um the same database

1:25:25

has like merile permit records and

1:25:27

stuff. Um and the codes bureau records

1:25:29

uh are comprised of things like building

1:25:31

permits um rental inspections uh buyer

1:25:34

notices and zoning certificates. Um, now

1:25:37

I think sometimes, uh, what'll happen is

1:25:40

a contractor, for example, will submit a

1:25:44

you submitted a permit in the past and

1:25:45

maybe only put one unit because they

1:25:47

were only working on one unit. And so

1:25:48

that's how that's entered into our

1:25:50

system. And so what what it's our job to

1:25:53

do is kind of to parse through these old

1:25:55

records and kind of say, is that what

1:25:57

happened here? And, you know, if we see

1:25:59

rental inspections for two units, we

1:26:01

assume the codes bureau went out there,

1:26:03

did an inspection, and confirmed there

1:26:04

were two units. So while the um

1:26:07

numerical record may be a little back

1:26:09

and forth, you know, we kind of know

1:26:12

what to look for in identifying like,

1:26:15

okay, we acknowledge that this was uh

1:26:17

two units at one point. Um you know,

1:26:19

that being said, this was all decades

1:26:21

ago and I don't think anybody from the

1:26:23

coach bureau is still working here that

1:26:25

was back there then. So um you know, I

1:26:28

can't attest to what city staff did at

1:26:30

the time, but we have to use the best

1:26:32

information available to us.

1:27:13

So you provided by

1:27:21

there are two electric

1:27:45

Mr. Knight, I had a quick question. Um,

1:27:48

do you know or Mr. Morgan, if you could,

1:27:51

do you know what the square footage of

1:27:53

this is? Because was there some

1:27:55

confusion that it was maybe over 2500

1:27:59

square feet, but the old city record

1:28:02

said it was 2400 or and if it's over

1:28:06

2500,

1:28:07

do they need a special exception for

1:28:10

conversion?

1:28:12

>> Yeah. So, uh, the county's records say,

1:28:14

uh, 2400 square f feet, but the

1:28:17

applicant, um, stated that they did a

1:28:21

current measurement of the property, and

1:28:23

I I want to say it was 2552

1:28:26

maybe. Uh, I don't 2528. Yeah.

1:28:29

>> Okay.

1:28:41

Okay. So, Mr. Radzik, it's your

1:28:46

testimony that the square footage is

1:28:49

2528. Is that correct?

1:29:00

Mr. You have any questions

1:29:24

in an overabundance of caution here and

1:29:27

with the availability of street parking.

1:29:29

I

1:29:32

I believe it would be appropriate to

1:29:34

allow for street parking in this

1:29:35

particular case rather than having to

1:29:38

later on come back and make that

1:29:41

request. I'm understanding how process

1:29:44

works

1:29:46

>> that there would be required to have two

1:29:47

off street parking spaces for the two

1:29:49

units. Yes.

1:30:02

I have a question just to maybe to Jeff

1:30:05

just to jog my memory. There was quite a

1:30:08

bit of conversation at planning about

1:30:11

the back steps and I thought

1:30:14

>> slip proof paint or something like that.

1:30:16

Wasn't that a condition about the back

1:30:18

stairs? Hold on. because there was a the

1:30:21

one of the tenants came and she had

1:30:23

already fallen down the back steps and

1:30:25

there's going to be a period of time

1:30:27

where there is no front steps while they

1:30:30

build a egress and a a new doorway

1:30:32

because if I'm understanding right now

1:30:35

there's the upstairs tenant basically

1:30:38

has to walk through the downstairs

1:30:39

tenants building until they build the

1:30:41

egress. But I just maybe it was an

1:30:44

agreement it wasn't a condition I

1:30:46

thought we said specifically planning

1:30:47

was concerned about He said he was going

1:30:50

to get paint with sand in it. You

1:30:52

remember that?

1:30:53

>> Yeah, they they did they did say that.

1:30:56

Um

1:30:58

>> yeah, I I I honestly don't recall

1:31:00

whether

1:31:01

>> they just

1:31:01

>> I think they I don't I don't think it

1:31:03

was formally added as a condition. And

1:31:07

>> yeah, they but they did uh uh the owner

1:31:09

did commit to um and I believe Mr. Raza

1:31:12

committed to painting it with non-slip

1:31:14

uh paint. Um that was primarily a lar a

1:31:18

larger issue for a temporary period when

1:31:20

they're going to be installing this new

1:31:22

wall and re uh configuring the front

1:31:24

entrance. Once that happens, um you

1:31:27

know, that will be a secondary means of

1:31:28

aggression. It won't be their only point

1:31:29

of access.

1:31:35

>> It's existing wood.

1:31:39

>> Yeah.

1:31:40

>> And if I can address that, we would

1:31:41

certainly have no problem making that a

1:31:44

condition. Um certainly the safety of

1:31:48

>> I mean if they didn't make it a decision

1:31:49

that's fine. I actually think the owner

1:31:51

just agreed that he would do it. So

1:31:54

>> and and we're okay with either way

1:31:56

because the safety of the tenants is

1:32:05

>> I don't think so. But that would be

1:32:08

something we would expect the codes

1:32:09

bureau to bring up during their uh

1:32:11

inspection of the property if if there

1:32:13

are. I don't believe there's like a

1:32:14

requirement that it be ADA compliant or

1:32:16

anything, but they would be able to

1:32:17

address that.

1:32:20

>> So, Mr. Knight, just to re review, um

1:32:25

there's a special exception for the

1:32:27

conversion

1:32:28

>> for the use

1:32:29

>> for the use.

1:32:30

>> Yep.

1:32:31

>> Um there's a special exception

1:32:35

um for the parking

1:32:37

>> for relief from the off street parking.

1:32:38

Yep.

1:32:39

>> And is it the case that they're over

1:32:43

2500 square feet if that's what the

1:32:45

board finds that there's the dimensional

1:32:48

variance is not applicable.

1:32:50

>> Uh so the 2500 square ft applies to the

1:32:54

specific criteria and 7309.2V

1:32:57

it requires the building be 2500 ft in

1:32:59

order to be converted. Um and you know

1:33:02

based on the uh architect's measurements

1:33:04

that it is that uh variance would be

1:33:07

obiated but the variance for the density

1:33:10

um would still apply.

1:33:11

>> Right. Okay.

1:33:19

>> And if I can note one further for the

1:33:22

for the record. Um, as stated in the

1:33:26

planning commission's report, this is

1:33:27

not something caused by the current

1:33:30

owner when he bought the property on

1:33:32

January 23rd. This was the condition of

1:33:35

the property at that time.

1:33:40

>> Okay. Anything else?

1:33:51

>> We're going to take a a a short break

1:33:54

and we'll be back. Okay.

1:48:18

Okay, we'll go back on the record. Um,

1:48:21

does any of the board members have a a

1:48:24

motion they'd like to present?

1:48:29

>> Yes. Uh regarding application 2608,

1:48:33

I would like to make a motion to approve

1:48:36

the request for variance and special

1:48:38

exception

1:48:40

um inclusive of the conditions set forth

1:48:43

by the planning commission um as well as

1:48:46

the owner taking steps satisfactory to

1:48:49

the city uh to address the concerns of

1:48:51

slipping on the uh with the back steps.

1:48:56

>> Okay. Okay. So, your motion was to uh

1:48:58

grant the u

1:49:01

um request uh pursuant to the

1:49:04

application. Uh is there a second?

1:49:09

Moved and second. All those in favor

1:49:11

signify by saying I.

1:49:13

>> I. Okay. Motion passes and uh you'll

1:49:16

receive a written decision within 45

1:49:18

days of today's hearing. Okay.

1:49:27

Thank you.

1:49:42

>> Okay, last item on the agenda is item

1:49:45

number 2609.

1:49:47

This is a variance application

1:49:50

for 315 North Second Street.

1:49:55

uh filed by uh Adam Brenamman of

1:49:58

Brenamman Properties LLC.

1:50:04

Um we have this evening uh with us uh

1:50:08

chairman of the zoning hearing board

1:50:10

Claude Fipps. Uh vice chair James Hobbs.

1:50:15

Um

1:50:16

uh we have um

1:50:19

Jeffrey Knight who was uh previously

1:50:22

sworn in in a previous in a hearing

1:50:24

earlier this evening um who has

1:50:27

indicated that he will um remain sworn

1:50:30

in. We have Tercan from the uh city

1:50:34

solicitor's office

1:50:36

um and um Mr. Patrina. Would you like to

1:50:40

introduce yourself and uh anybody that

1:50:42

would be testifying this evening? Yes.

1:50:44

Good evening everyone. Thanks for having

1:50:46

us here tonight. Uh my name is Phil

1:50:48

Patrina Mcnes Wallace and 100 Pine

1:50:51

Street in Harrisburg. I'm here on behalf

1:50:54

of the applicant here, Brenamman

1:50:56

Properties LLC. Uh and my client Adam

1:51:00

Brenamman, the owner of that company is

1:51:02

here and he will provide some testimony

1:51:04

tonight as well. So he should be sworn

1:51:07

>> Okay. Mr. Brenamman, could you raise

1:51:08

your right hand? Do you swear or affirm

1:51:10

that the testimony that uh you will give

1:51:13

this evening before this board is will

1:51:15

be the truth and nothing but the truth?

1:51:17

>> Yes.

1:51:17

>> Okay. And then um do you have anybody

1:51:20

else that will be testifying this

1:51:22

evening?

1:51:22

>> No, that's it.

1:51:23

>> Okay. And um it appears um that there's

1:51:29

uh no one else here opposing or for the

1:51:32

application. Is that correct? We'll let

1:51:35

the record show that there's no uh

1:51:36

citizens here um either opposing or um

1:51:43

here to support this application. I'm

1:51:45

going to mark some exhibits uh for the

1:51:48

record before we start.

1:51:50

I have marked as exhibit B1 uh the proof

1:51:54

of publication. The time and place and

1:51:56

particular nature of this matter was uh

1:51:58

was uh advertised in the Patriot News

1:52:00

which is a newspaper general circulation

1:52:02

in the city of Harrisburg. Publication

1:52:04

appeared on July 6th and July 13th of

1:52:07

2025.

1:52:09

Board exhibit number two is a letter

1:52:11

dated July 17, 2025 from the planning

1:52:14

director to the applicant notifying the

1:52:16

applicant of the time and place of this

1:52:18

hearing. Board exhibit number three is

1:52:21

the hearing notice that was posted upon

1:52:22

the property in question that was

1:52:24

accomplished on June 29th, 2025. Board

1:52:27

exhibit number four B4 is the

1:52:30

applicant's notification letters to the

1:52:32

required neighbors. Board exhibit number

1:52:34

five is the application packet with the

1:52:37

attached narrative, photos of the

1:52:39

exterior of the property and plans for

1:52:42

uh for the proposal. Board exhibit

1:52:45

number six is the agreement of sale for

1:52:47

the property establishing a uh applicant

1:52:49

standing to pursue the zoning uh relief

1:52:52

uh this evening. Board exhibit number

1:52:54

seven is the deed to the property. Board

1:52:56

exhibit number eight is the planning

1:52:58

bureau case report. Uh board exhibit

1:53:01

number nine is the city of Harrisburg

1:53:03

planning commission resolution. So we

1:53:07

have exhibits B1 through B9 which will

1:53:10

be uh admitted into the record. Uh Mr.

1:53:13

tonight. Would you like to give a brief

1:53:15

brief summary of this application and

1:53:17

then we'll have the applicant present

1:53:19

this case?

1:53:20

>> Uh yes. So uh the issue uh in case

1:53:24

number 2609

1:53:26

uh is a variance for relief from the

1:53:29

density regulations um for multif family

1:53:32

dwellings in the commercial neighborhood

1:53:35

uh zoning district. Um the project site

1:53:39

is comprised of three separate

1:53:42

buildings. um that are all on a single

1:53:44

lot um and have been internally

1:53:47

connected at some point in the past. Um

1:53:50

and the uh total square footage of the

1:53:55

property would permit about 8.3 units by

1:53:59

right. Um and the applicants are

1:54:00

requesting 10 total units. Um so there's

1:54:03

relief from uh two um dwelling units uh

1:54:08

per the density regulations in the

1:54:09

zoning code. Um the planning bureau

1:54:13

notes uh again the unique configuration

1:54:16

of the site in that it's uh again three

1:54:18

buildings that are internally connected.

1:54:20

Um so the it has um you know stairwells

1:54:26

kind of in different

1:54:28

and maybe less um uh useful locations

1:54:32

than you would have if you just had one

1:54:34

building built um purpose built for this

1:54:37

uh type of use. Um in addition uh the

1:54:40

there's like kind of different floors of

1:54:42

the uh buildings. If you note the uh

1:54:45

floor plans provided by the applicant

1:54:47

where uh the central uh building has a

1:54:50

third floor uh that uh the other two

1:54:52

buildings don't really um have. Uh so

1:54:55

there's kind of additional space there.

1:54:57

Um and uh the planning bureau notes that

1:55:02

um the uh units range in size from 486

1:55:07

to,290 square ft. Um so it's clearly not

1:55:11

a case where the applicants are trying

1:55:14

to fit as many units into the building

1:55:16

as possible. They are uh working within

1:55:19

the unique configuration creating um

1:55:21

smaller one-bedroom units and then uh a

1:55:24

two-bedroom loft uh unit again in that

1:55:27

central uh unit. Uh and then uh finally

1:55:31

uh because they're converting it from

1:55:32

office space to residential use um there

1:55:35

is a significant amount of investment

1:55:37

that needs to be made uh bringing in you

1:55:39

know a kitchen for every unit. Um even

1:55:42

if they were only doing eight units um

1:55:44

and not uh 10 units. Uh the addition the

1:55:46

cost of bringing in kitchens for eight

1:55:48

units and running uh new lines for those

1:55:50

things, bathrooms for each of the units,

1:55:53

uh new electrical for each of the units.

1:55:56

um does um create a financial hardship

1:55:59

which uh the board has um heard in the

1:56:02

past from other uh applicants um uh

1:56:05

about the legal precedent of there being

1:56:08

an allowance for uh some financial

1:56:10

hardship in the granting of a

1:56:11

dimensional variance. Um so with all of

1:56:14

that being said uh the planning

1:56:17

commission and the planning bureau

1:56:18

recommended the uh zoning hearing board

1:56:21

approved the request with the following

1:56:22

conditions. If the applicant receives

1:56:24

approval of the requisite zoning relief

1:56:26

requests, they must secure city council

1:56:28

approval of a land development plan for

1:56:30

the proposed conversion. Uh any exterior

1:56:32

alterations to the building will receive

1:56:34

approval from the historic preservation

1:56:36

specialist or if necessary receive HARB

1:56:38

approval of a certificate of

1:56:40

appropriateness application. Um the plan

1:56:42

B recommends the applicant consider

1:56:44

differentiating the facades of the three

1:56:45

buildings to reestablish their original

1:56:47

identities. Um and it should be noted

1:56:49

that there were some minor um uh I think

1:56:52

uh exterior work noted by the applicants

1:56:55

in their site plan and so that's what

1:56:57

we're referencing uh in regards to the

1:56:59

exterior alterations and as noted the

1:57:02

buildings are already painted um so

1:57:04

painting the building which would

1:57:05

generally not be permitted uh for or

1:57:07

recommended for a masonry building in a

1:57:09

historic district um can be done uh

1:57:12

without HARB approval and we'd recommend

1:57:14

you know reestablishing again that uh

1:57:16

individuality of each of the units um if

1:57:19

the reference parking spaces are not on

1:57:21

the subject property the applicant

1:57:22

provide a signed lease agreement to

1:57:24

allow parking at those spaces. The

1:57:26

property is located in the CN district,

1:57:27

which does not require off- street

1:57:29

parking, but uh the applicants have

1:57:31

testified that there are eight spaces

1:57:32

that I believe uh convey with um uh the

1:57:36

deed uh to this property um located in

1:57:38

the lot uh directly to the rear of the

1:57:40

properties. Uh and then finally, the

1:57:43

applicant will coordinate with the

1:57:44

Department of Public Works to ensure

1:57:45

that the account billing reflects the

1:57:47

establishment of the proposed uses on

1:57:49

site and to identify the appropriate

1:57:50

refuge storage and collection needs. The

1:57:53

planning commission recommends that the

1:57:54

zoning hearing board approved the

1:57:55

request for the following reasons. The

1:57:58

internal configuration of three attached

1:57:59

buildings, specifically the locations of

1:58:01

aspects such as walls, stairs, and doors

1:58:03

and windows, compels the reorganization

1:58:05

of space into more units than we would

1:58:07

be permitted by right and the components

1:58:09

necessary for the establishment of the

1:58:11

by right multif family dwelling use such

1:58:13

as kitchens and bathrooms, requires

1:58:15

investment compensated for through the

1:58:17

inclusion of additional units. The

1:58:19

proposed reuse will add new residents to

1:58:21

the neighborhood to activate the street

1:58:22

on nights and weekends and grow a

1:58:24

customer base to support local

1:58:25

businesses and will provide additional

1:58:27

units to the downtown housing inventory.

1:58:29

Range of unit sizes in the mix of one

1:58:31

and two-bedroom units will accommodate a

1:58:32

variety of household sizes and needs

1:58:35

helping to further diversify the

1:58:36

downtown housing inventory. Uh finally,

1:58:38

other conversions of former office

1:58:40

buildings in the surrounding

1:58:41

neighborhood have demonstrated the

1:58:42

proposed use will not adversely impact

1:58:44

the character of the neighborhood.

1:58:48

Okay,

1:58:50

Mr. Patrina, do you wanna

1:58:52

>> Yes, with that. Thank you, Mr. Knight.

1:58:53

Um, we have a short presentation tonight

1:58:56

and I'm going to pass out some exhibits

1:58:58

um just so that we're all

1:59:27

Okay.

1:59:29

So, as Mr. Knight stated, this property

1:59:31

is located at 315 North Second Street.

1:59:34

It's the former administrative office

1:59:37

location of the Pennsylvania Healthcare

1:59:39

Association. Um, they've used it

1:59:41

commercial office space since at least

1:59:43

1996

1:59:45

and they've ultimately decided to

1:59:47

downsize its office presence uh postco

1:59:50

um with people really working from home

1:59:53

and have entered into uh the the

1:59:55

attached agreement of sale as provided

1:59:57

our application with Mr. Brenamman uh

2:00:00

for the sale of the property property is

2:00:03

located in the city's commercial

2:00:05

neighborhood district and old Harrisburg

2:00:08

historic district and it is improved

2:00:11

within approximately 8,300 square foot

2:00:14

building and eight off- streetet parking

2:00:16

spaces uh that the property has use of

2:00:19

through an access easement agreement

2:00:20

that's conveyed in the deed to the

2:00:22

property. Brenamman properties proposes

2:00:25

to convert this office uh this existing

2:00:28

office building into a 10 dwelling unit

2:00:31

uh multif family apartment building.

2:00:34

Residential uses are permitted by right

2:00:37

in the CN district. And the CN district,

2:00:40

as Mr. Knight pointed out, is exempt

2:00:42

from the city's off streetet parking

2:00:43

requirements, although we do have those

2:00:45

additional eight spaces provided uh in

2:00:48

the north uh or rear of the property.

2:00:52

Tonight we're here to request the board

2:00:54

uh for a variance from section 7-307

2:00:57

of the zoning ordinance uh a dimensional

2:01:00

variance to permit 10 dwelling units in

2:01:03

the building.

2:01:05

Um on July 2nd, 2025, the Harrisburg

2:01:08

Planning Commission recommended approval

2:01:10

of the variance application.

2:01:12

Uh and there were a few conditions that

2:01:14

you know we are agreeable to. I would

2:01:16

note that um Mr. Brenamman uh as far as

2:01:21

the exterior of the property goes, I

2:01:23

think is no longer planning to really

2:01:25

alter the outside of the building and

2:01:28

you know to the extent that there would

2:01:30

be any exterior changes, we would

2:01:32

obviously seek the approval uh of HARB

2:01:35

and any other necessary zoning ordinance

2:01:37

requirements, but I I think that the

2:01:39

plan is to really preserve the history

2:01:41

of this building and as much of the

2:01:44

street facade um as as possible. And so

2:01:48

I think decision was made to just leave

2:01:50

it as is. Um, so with that, I'll call

2:01:53

our first and only witness tonight, uh,

2:01:56

Adam Brenamman.

2:01:58

Uh, Mr. Brenamman has been sworn in. So,

2:02:01

um, we'll just get right to it. Um, Mr.

2:02:04

Brenamman, what is your position with

2:02:06

Brenamman Properties LLC?

2:02:08

>> I'm the sole owner.

2:02:10

>> Okay. And how many properties um, do you

2:02:12

own within the city?

2:02:14

>> Uh, about 25 units. Okay.

2:02:18

Uh looking in front of you um what we'll

2:02:22

mark into the record as applicants

2:02:24

exhibit A1.

2:02:26

Um what is shown in front of you there?

2:02:30

In front of me is 315 North Street

2:02:33

that we would convert

2:02:55

>> yes.

2:02:56

>> Is the property also part of the city's

2:02:58

old historic district.

2:03:00

>> Yes, sir.

2:03:01

>> And are you the equitable owner of this

2:03:03

property in the form of an executed

2:03:04

agreement of sale?

2:03:05

>> Yes.

2:03:07

>> Okay. Um with that, I'll move to uh

2:03:09

offer that exhibit into evidence as

2:03:11

applicants exhibit A1 or however you

2:03:14

would like to mark it.

2:03:15

>> Yeah, we'll leave it as A1 and it'll be

2:03:17

admitted into evidence.

2:03:18

>> All right. And then we're going to turn

2:03:20

to the second uh few pages here of the

2:03:23

packet that I just distributed um which

2:03:26

are Google Street View images of the

2:03:28

existing conditions of the property. Um

2:03:32

we're looking at the first page here,

2:03:34

Mr. Brenamman. What does this first page

2:03:36

show of the street view image?

2:03:39

>> Yeah, this is the building from looking

2:03:41

at it from street.

2:03:44

>> Okay. And then flipping to the second

2:03:45

page here.

2:03:50

Does that show the building facade from

2:03:52

the right of way at Barber Street and

2:03:55

North Second?

2:03:56

>> Yes.

2:03:59

>> We're going to turn to the third image

2:04:00

now

2:04:02

uh which shows the back rear of the

2:04:04

property. Does this prop does this image

2:04:07

here show the eight off street parking

2:04:09

spaces that are located behind the

2:04:10

property?

2:04:11

>> Yes, it does.

2:04:12

>> Okay. Will the tenants of your property

2:04:14

or proposed apartment um dwelling have

2:04:17

access to these eight off- streetet

2:04:19

parking spaces?

2:04:20

>> Yes.

2:04:23

>> The street view images uh show the

2:04:25

historic nature of this building as I

2:04:27

alluded to earlier in the presentation.

2:04:30

Do you plan on preserving the historic

2:04:32

nature of this building? Yes, the the

2:04:34

historic nature of the building was a

2:04:36

major part in wanting to purchase the

2:04:38

building and plan

2:04:41

that historic piece of it.

2:04:42

>> Okay. And and to the extent required for

2:04:44

any of your minor cosmetic changes, I

2:04:46

know that we did discuss earlier tonight

2:04:49

um that you're planning to just leave

2:04:51

the building facade as is. If in the

2:04:53

future at any point um that does change,

2:04:56

do you agree to obtain a certificate of

2:04:58

appropriateness from the historic

2:05:00

architectural review board or any other

2:05:03

uh city zoning requirements?

2:05:05

>> Yes.

2:05:06

>> Okay. And with that, I'll go ahead and

2:05:08

move to admit the street view images as

2:05:11

applicants exhibit A2.

2:05:15

>> All right, Mr. Brenam. Now turning to

2:05:17

the floor plan that is in

2:05:22

the those exhibits there. Um so Mr.

2:05:26

Brenamman, uh please describe the unit

2:05:29

mix of the multi the proposed multif

2:05:31

family residential building.

2:05:33

>> Yeah. So um 10 units total as you'll see

2:05:36

on the first floor here we have six

2:05:38

proposed units all onebedroom units and

2:05:43

you can see the different colors of

2:05:44

units there and the second floor of the

2:05:47

building will be four two bedroom units.

2:05:50

It was important to as we as we put this

2:05:53

plan together to have a mix of one

2:05:55

bedroom and two bedrooms

2:05:58

as many units as possible

2:06:01

in the city and um and ranging in size

2:06:04

from

2:06:06

500,200

2:06:10

ft good units and even includ a unit of

2:06:14

the second floor that will have access

2:06:16

to a third floor

2:06:19

>> and in determining the 10 units for this

2:06:22

8,300 square foot building. How did you

2:06:25

and your engineering team arrive at a

2:06:27

unit mix of 10 units?

2:06:28

>> Yeah, we bring a lot of different plans

2:06:30

and financial analysis and formulas and

2:06:32

the reality is with construction costs

2:06:34

where they are that 10 units was the

2:06:37

least amount of units we could

2:06:40

build that would be financially

2:06:44

given the cost of the conversion. It

2:06:46

being an office space, the unique nature

2:06:48

of of the building the building

2:06:51

lot different buildings

2:06:57

10 units.

2:07:01

>> And will these uh proposed units be

2:07:03

market rate rental units?

2:07:04

>> Yes.

2:07:06

>> Uh Mr. Bman, please uh you know, take a

2:07:09

look here at sheet A 101 of the floor

2:07:12

plan and walk us through what it is

2:07:15

showing on the first floor.

2:07:17

>> Yeah, first floor you'll see uh unit

2:07:20

on the left 548 ft. It's a one bedroom

2:07:23

as you can see the bathroom and the

2:07:25

kitchen area and bedrooms outlined which

2:07:28

is 659

2:07:30

unit C there

2:07:36

on the top right.

2:07:38

>> Okay, we'll turn to uh sheet A 102 of

2:07:42

the exhibit. Um why don't you walk us

2:07:45

through what that is showing us? So unit

2:07:48

2 a 859 feet that's a twobedroom and and

2:07:53

one and a half bath. You see unit 2 C

2:07:56

which is 819 square ft that is a two bed

2:07:59

one bath. See unit 2 which is actually

2:08:03

the unit which will be two stories. So

2:08:06

the the first story there on unit 2B is

2:08:09

the living area and the kitchen and then

2:08:11

unit 2 on the right

2:08:14

overt.

2:08:17

>> Okay. And then turning to the last sheet

2:08:19

of the exhibits sheet A 103. Um what

2:08:22

does that one show us?

2:08:23

>> Yeah, that is the the top floor the loft

2:08:25

area of the uh unit 2B that you saw on

2:08:29

the last page. That is where the two

2:08:31

bedrooms will be, the bathroom upstairs,

2:08:33

which I think will be a really neat unit

2:08:35

for the city.

2:08:36

>> Okay, great. Um, with that, I will move

2:08:39

Mr. Solicitor to admit the floor plan as

2:08:42

applicants exhibit A3.

2:08:44

>> Okay, that'll be uh that exhibit will be

2:08:48

uh

2:08:50

moved into evidence. Thank you.

2:08:52

>> Thank you. Um, okay, just a few more

2:08:55

questions here for you, Mr. Brown. Um,

2:08:57

did you create the existing lot

2:08:59

conditions at the property?

2:09:02

>> What was that? Sorry.

2:09:02

>> Did you create the existing lot

2:09:04

conditions at the property?

2:09:07

>> Does the building's approximately 8,300

2:09:10

square foot size in relation to the

2:09:13

approximately 4,300 square foot lot

2:09:16

create a hardship uh to developing the

2:09:19

property in conformance of the zoning

2:09:21

ordinance?

2:09:22

>> Yes.

2:09:23

and anything less than 10 units is not

2:09:26

financially feasible for this project.

2:09:29

>> Is the required variance the minimum

2:09:31

variance necessary to afford appropriate

2:09:34

relief to to redevelop this property for

2:09:36

residential purposes?

2:09:38

>> Yes.

2:09:39

>> Okay. And will you agree to comply with

2:09:41

all other city zoning ordinance

2:09:43

requirements and any reasonable

2:09:45

conditions that are imposed by this

2:09:47

board in making the apartment

2:09:48

conversion?

2:09:49

>> Yes.

2:09:50

>> Did you review the and the materials

2:09:53

that were submitted in support thereof.

2:09:55

>> Yes.

2:09:56

>> Okay. And to the extent applicable, do

2:09:58

you adopt the statements made in the

2:10:00

application and here tonight um as your

2:10:04

own statements?

2:10:05

>> Yes, I do.

2:10:06

>> Okay.

2:10:08

Uh and for all the uh aforementioned

2:10:11

articulated reasons um we have no

2:10:15

further questions for Mr.

2:10:17

and respectfully request this board uh

2:10:20

approve the requested variance uh in the

2:10:23

application here tonight. And uh with

2:10:26

that, we'll yield back for questions you

2:10:27

might have.

2:10:28

>> Okay. Thank you, Mr. Petrina. Does the

2:10:30

board have any questions of uh Mr.

2:10:32

Brenamman?

2:10:40

>> I'm just curious. So, these units um

2:10:43

these 10 units are all I'm assuming be

2:10:45

market rate housing. Is that correct?

2:10:47

>> Yes.

2:10:48

>> Okay,

2:10:53

I'm good.

2:11:17

So they currently are all connected

2:11:20

as an office building. So our plans

2:11:23

involve moving and removing some of the

2:11:26

walls in the building, but we are trying

2:11:27

to preserve as much as possible. But it

2:11:30

is different. They are operating

2:11:32

currently as one.

2:11:46

>> Yeah.

2:11:47

Yeah. It'll end up being between $1,200

2:11:50

to $1,400

2:11:55

probably out.

2:11:59

Those are the numbers that make

2:12:21

>> parking

2:12:26

space.

2:12:29

cameras.

2:12:33

>> Um, I believe that

2:12:41

came

2:12:50

right next to

2:12:58

But that that lot is not owned by won't

2:13:02

be part of this uh agreement of sale is

2:13:05

that's

2:13:14

>> no but they they said they have reserved

2:13:17

spots there but it's

2:13:18

>> the lot is technically owned by Verizon

2:13:22

Bell Atlantic telephone company and

2:13:24

Pursuant to the deed that's also

2:13:26

attached to this application, there's an

2:13:28

access ement agreement

2:13:30

>> um to those eight parking spots,

2:13:32

>> right?

2:13:44

>> Well, I mean, I guess they, you know,

2:13:45

there could be a a camera on the

2:13:48

building itself, you know.

2:13:52

It looks like it almost is. I mean, it's

2:13:54

just something to think about.

2:14:10

>> I'm sorry.

2:14:22

singles.

2:14:28

Yeah, I think professionals in the city

2:14:32

want to do this project

2:14:35

downtown

2:15:04

I mean, I don't know whether they've

2:15:05

reached out, but I know they've

2:15:07

discussed this with the planning bureau.

2:15:24

>> I don't have any other questions.

2:15:27

You have any questions?

2:15:38

>> He's the broker.

2:15:41

>> I hope he's not opposed.

2:15:48

>> He's got a stake in this thing.

2:15:57

Okay.

2:15:58

>> Is there anything else, Mr. Katrina?

2:16:00

>> That was all we had.

2:16:01

>> Okay.

2:16:05

Okay.

2:16:17

recommendations

2:16:20

by

2:16:23

>> So your motion um Mr. Fipps is to um

2:16:29

grant the dimensional variance request

2:16:32

uh along with the conditions set forth

2:16:34

in the planning commission's um

2:16:38

resolution.

2:16:40

>> Is there a second?

2:16:42

>> So moved.

2:16:44

uh moved and seconded. All those in

2:16:46

favor signify by saying I.

2:16:48

>> I.

2:16:49

>> Okay. Um so your uh request was uh

2:16:53

granted. You'll get a written decision

2:16:55

within 45 days of today's hearing. Okay.

2:16:58

>> Thank you.

2:16:59

>> Thank you very much everybody.

2:17:00

>> Thank you.

2:17:03

Thanks.

2:17:25

>> Second.

2:17:30

>> All right. Thanks.
