then be able to demolish our existing

there will be packages that come back to

the council once this moves with

specific meets and bounds and things

like that. But it's it's hard to do it

on the front end, right? The original

plan was rejected, you know, and then it

sort of started over again. So So it has

to get to its final point. So this is

the beginning of a process from I think

a legal point of view.

and it basically includes a canopy of a

and Cameron Street. Just behind that is

a restaurant that used was most recently

for Aces. Uh and then behind that

there's a larger industrial building

that has had a variety of autooriented

uses over time. Uh most of this site is

uh paved. Um it's frankly uh in various

33:22

states of dilapidation. There's

33:24

overgrown weeds. Uh so overall the

33:27

project is going to uh have a

33:30

significant improvement um to this

33:32

really um conspicuous corner uh in the

33:35

city here at the corner of her and

33:37

Cameron Street. Uh there will be um

33:40

on-site storm water management

33:41

improvements done as part of this. Uh

33:43

there will be two uh different buildings

33:46

uh for the parks maintenance facility.

33:48

Uh and if and it's going to be it's

33:50

going to significantly modernize uh both

33:52

the um facilities for parks maintenance

33:55

staff uh and also the operations. And if

33:57

you've ever been in the existing parks

33:59

maintenance building, uh last time I was

34:01

there was like you know February and it

34:02

was cold inside like it's probably not

34:04

weather weatherproofed or climate

34:06

controlled. So, uh, this new building,

34:08

uh, will, you know, really raise the

34:10

standard of, um, of the city's

34:12

facilities, uh, with respect to this,

34:14

uh, particular department. Um, uh, in

34:18

addition to that, uh, there will be some

34:21

changes to the right ofway around the

34:24

site. Uh, right now there's some curb

34:26

cuts onto Hurst Street. Uh and although

34:28

there's not a lot of traffic to and from

34:30

these sites, um there is some and

34:32

because of the uh multiple curb cuts

34:35

along her street and their proximity to

34:37

the intersection with Cameron, uh it can

34:39

get a little hectic with people going in

34:40

and out. Um there'll be a fence pretty

34:43

much up along the frontages of both her

34:46

street and Cameron Street as part of

34:47

this new development. Uh and all of the

34:49

vehicular access will come in off 12th

34:51

Street. Uh so it will really simplify uh

34:54

vehicular circulation to the site which

34:56

will make things safer for everybody. In

34:58

addition um they're going to improve and

35:01

widen the sidewalks along her and

35:02

Cameron Street. Um and that's not just

35:05

important from a general perspective but

35:08

uh because um Certa's new facility will

35:10

be located just to the south along

35:12

Cameron Street. people will be walking

35:13

along along Cameron Street uh to that

35:16

facility because there will be a

35:17

transfer point um at that building um

35:20

for certainly the the near-term and

35:22

maybe uh into the longer into the

35:24

future. Uh so it will be necessary to

35:26

have these um pedestrian improvements as

35:29

part of the overall project. Uh again,

35:31

the um condition of the site, the

35:33

appearance of the site will be improved.

35:35

And also uh because the site is located

35:37

in the um 100red-year flood plane, uh

35:40

the applicants are working um with FEMA

35:44

to on a letter of map revision uh

35:46

document to um essentially revise the

35:50

base flood elevation at this site and to

35:52

make sure that their new construction uh

35:54

is compliant with the city's

35:56

regulations. We require uh 18 inches

35:58

above the base flood elevation uh which

36:01

is called the freeboard uh in our zoning

36:02

code. And so the proposed letter of map

36:05

provision is going to reduce the base

36:07

flood elevation about 3 ft which

36:09

significantly you know changes the

36:11

construction of the building um the uh

36:13

uh financial feasibility of the

36:15

building. You have to do a little bit

36:17

less in terms of the overall um flood

36:20

plan flood flood proofing of the

36:22

structure and the site. Um, so with that

36:26

all being said, the planning commission

36:29

uh has recommended that the city council

36:33

approved the request with the following

36:35

conditions. Uh, the applicant must

36:37

secure approval of a letter of map

36:39

provision from FEMA so the development

36:41

can proceed as proposed and must

36:43

eventually receive approval for both the

36:44

structural demolitions on site as well

36:46

as the proposed new construction. And

36:48

again, the applicants are currently in

36:50

the midst of coordination with FEMA on

36:52

that. Uh the applicant should coordinate

36:53

with the city arborist to increase the

36:55

ecological impact and tree canopy on

36:56

site by incorporating native tree

36:58

species and pollinator plants

36:59

particularly on the western edge of the

37:01

site around the storm water detention

37:02

infrastructure which can also address

37:05

localized air pollution created by the

37:06

Cameron Street Hurst Street in uh

37:08

infrastructure. Uh and the city arburous

37:11

actually uh review is actually kind of a

37:13

new uh component we are doing with our

37:14

land development plans uh because we

37:16

have them on staff and we've generally

37:18

been including it as a condition of

37:19

approval instead of just always adding

37:21

that. Uh we've incorporated their review

37:24

uh as a formal step in the process just

37:25

like we do the codes bureau or the city

37:27

engineer. Uh so there are um actual uh

37:31

comments from our city arborist on maybe

37:33

how to improve the overall site, what

37:34

types of uh tree species to use and and

37:37

things like of that nature. and I

37:38

believe that was included in your

37:39

packet. And then finally, if possible,

37:41

the planning bureau recommends removing

37:42

the southernmost vehicular access point

37:44

onto the site from North 12th Street to

37:46

clarify vehicular circulation and

37:48

eliminate a vehicular pedestrian

37:50

conflict point, which is especially

37:52

important given the proximity to

37:53

Sunshine Park. So, in the initial

37:56

proposal, there were two um vehicular

37:58

access points. Again, this is across the

38:00

street from the park, but I mean, kids

38:02

will probably be running up and down

38:03

this street. And the more we can clarify

38:06

uh where exactly vehicles will be going

38:08

on in off the site and in fact reduce

38:10

the overall number of those access

38:12

points, the uh safer it will be for all

38:14

of the people um around this area. And I

38:17

believe the applicants at the planning

38:18

commission uh uh meeting agreed to that

38:21

condition. Uh the planning commission

38:23

recommended the city council approved

38:25

the request for the following reasons.

38:26

project will expand and modernize the

38:28

city's parks mainten maintenance

38:29

infrastructure, improving the ability of

38:31

the parks and recreation department to

38:33

provide services to residents and a

38:34

facility that creates better working

38:36

conditions for staff. The project site

38:38

is a conspicuous location at the

38:39

intersection of two state routes and the

38:42

removal of dilapidated and underutilized

38:44

buildings and replacement of large

38:45

expanses of impervious surface with

38:47

vegetation and a modern city building

38:49

will bring aesthetic improvements not

38:50

only for passers by but local residents

38:52

and workers as well. And finally,

38:54

through coordination with FEMA, the

38:56

project will result in a site that is

38:57

floodplane compliant and more resistant

38:59

to future flood events in the Paxton

39:01

Creek

39:10

corridor. The only thing I'd add is the

39:12

the layout of the uh site was

39:15

coordinated with the parks department.

Uh so there's a process of uh working

39:20

with them to determine the size of the

39:22

buildings, the number of buildings, and

39:24

there's a uh the main building is a

39:26

maintenance building with the admin

39:28

attached to to it with garage doors on

39:31

both ends of the maintenance buildings

to be able to pull, you know, trucks

39:35

with trailers on through the through.

39:37

And then uh also is a uh is a storage

39:41

building associated with it and you

39:44

know, sufficient parking and material

39:46

storage.

construction projects. Uh we have

Sycamore Street, Berry Hill Street,

Chestnut Street, and that's just uh this

year. Uh in the future, we're going to

50:28

have much larger corridors such as

50:31

Division Street, Walnut Street, uh some

50:34

work on on her street. And it's it's

50:37

also my intent um similar to Sycamore

50:39

and Barry Hill Street to continue that

50:41

program throughout the city. Just uh you

50:44

know, like you said, everywhere needs

50:46

work. So, uh I I do not want to slow

50:49

down on any of the construction. And

then on the I call it smaller side, but

50:55

still significant is we have a lot of um

50:58

utility work being done in the city and

that requires what we call a street cut

permit. And last year alone, we had over

500 of these. And this is where they

they dig up the road and that we kind of

inspect it and make sure they put it

back according to um the city

specifications. And quite frankly, we're

we're just underst staffed to do all

these larger projects, 500 smaller

projects, which is why I went forward

with a an RFP for construction

services to to help the city on an as

needed basis. So it's not a constant

constant work, but It's as needed as as

we start to get overwhelmed. I can call

on the selector firm to to kind of

together a fantastic proposal and I I

recommending them for selection. And

into town, Arugas was a boarded up

it up and allows us to police ourselves

instead of the liquor control board

key component here is to say Harrisburg

can take care of our own. We can police

ourselves. As explained, there's many uh

citizens still can call 911. They can go

to the LCE. They have many angles to if

someone wants to act out. We don't need

the LCB in Harrisburg policing us. We

to support resolution 20 and the

amendment to add Midtown because I

believe Harrisburg is in crisis.

Midtown and downtown. Without it, they

wouldn't be able to function. And I

would also draw your attention to the

fact that the 2017 map was actually

continuing resolution from

2014. So in 2014, Midtown was was

included in the noise exemption and then

again and in those days you had

a three-year extension for the LCB and

then the LCB did another extension in 17

2019. How the map changed in

2019, we have no idea, right? Because as

somebody that would have been affected

by it. We were giving no notice of it

and we believed as did other businesses

in Midtown that we were part of that

noise exemption. So I think it might

have been an oversight when they put

that map together in 2019. They went

back to prior to

2014 because the it was a continuing

ordinance titled police transparency and

accountability reporting ordinance. I

have brought physical copies of the

proposed ordinance this evening for the

chief of for the chair of public safety,

1:08:14

the president of city council, and the

1:08:16

city solicitor. I respectfully request

your review and consideration of this

adoption. This ordinance is designed to

1:08:22

establish a responsible recurrent

1:08:24

reporting framework of bureau for the

1:08:26

bureau of police regarding the use of

1:08:28

body warn cameras. While many residents,

1:08:30

including myself, recognize the value of

1:08:32

body warn cameras and enhancing public

1:08:34

trust and accountability, the value

1:08:36

depends on more than just having the

1:08:38

equipment. It depends on what we do with

1:08:40

the data. That's why this ordinance

1:08:43

calls for quarterly reports to be

1:08:44

submitted to the mayor, city council,

1:08:46

and cleat. These reports will provide

1:08:48

foundational information such as the

1:08:50

number of officers equipped with body

1:08:52

warn cameras, any technical issue with

1:08:54

the system, and once permitted through

1:08:56

bargaining, additional data that can

1:08:58

help identify trends and improve

1:09:00

department policies. Importantly, this

ordinance does not overstep legal or

1:09:05

contractual boundaries. It was drafted

to be fully compliant with act 22 of

1:09:11

2017, the right to know laws, the

criminal history record information act,

the juvenile act, and act 111 governing

collective bargaining with police

1:09:22

unions. The ordinance acknowledges that

some of the the ordinance acknowledges

that some of the most meaningful data

such as body warrant activation

1:09:30

compliance, non-activation reasons and

footage use and internal investigations

relates directly to officers working

1:09:39

conditions. As such, it does not attempt

to bypass the collective bargaining

process. This is legally cautious and

forwardlooking. It enables the city to

begin building a foundation of

transparency now while respon excuse me

while responsibly planning for deeper

data reporting once labor negotiations

will allow. It helps Harrisburg avoid

litigation or labor disputes by

proactively respecting our legal

obligations. In short, this ordinance

strikes the right balance. It advances

transparency for the community. that

respects the rights and contracts of our

officers and its long-term

accountability policym based on data and

not assumptions. I urge the council to

consider this proposal seriously and to

refer it to the appropriate committee
