The meeting opens after an extended period of silence on the broadcast. The commission handles administrative items and approves the previous meeting's minutes.

This section contains only dead air and routine administrative approvals.

15:28-21:16

Capital Heights Phase 3: Project Overview

watch

Planning Bureau staff presents the land development plan for Capital Heights Phase 3. The overview highlights residential infill, mixed-use buildings, ADA compliance, native landscaping, and waste coordination.

Provides the essential baseline details, scope, and city-recommended conditions for the project.

21:16-32:52

Fulton Street Setback and Sidewalk Discussion

watch

Developers Matt Long and Andy George debate a zoning order requiring them to build directly on the Fulton Street property line. They propose a setback to allow for wider, ADA-compliant sidewalks, which staff accepts in principle.

Offers an in-depth look at how street widths, zoning mandates, and ADA standards conflict in practice.

32:52-38:40

Project Timelines and Infrastructure Questions

optional

Commission members inquire about construction schedules and sidewalk dimensions. The developers outline how HUD administrative delays have severely impacted their construction schedules.

Gives helpful context on development timelines but largely reiterates sidewalk dimensions.

38:40-56:04

Community Garden Relocation Dispute

watch

The commission debates the placement and accessibility of a promised community garden. Staff argues the developer's modified plan limits public access, while the developer defends the updated alleyway layout.

Crucial for understanding developer commitments to public benefits and community-centered zoning.

56:04-1:03:48

Zoning Adjustments and Capital Heights Vote

watch

The board assesses if setback changes constitute minor technical adjustments under local law. The commission votes to approve Capital Heights Phase 3 with an amendment allowing sidewalk redesigns.

Documents the official voting outcomes and key administrative decisions on the project.

1:03:48-1:09:36

Marketplace Midtown Project Introduction

watch

Staff presents the plan for Marketplace Midtown, which involves consolidating 51 vacant lots to build mixed-use buildings, residential townhomes, parking, and a food hall.

Introduces the second major mixed-use development proposal on the agenda.

1:09:36-1:15:24

Public Comment: Green Space Preservation

watch

Midtown resident Dylan Ziggler expresses concern over losing informal play areas to parking lots. The developers agree to collaborate with the HOA to set aside non-buildable land on Marion Street for community green space.

Shows a positive, constructive dialogue between developers and the neighborhood on land preservation.

1:15:24-1:15:24

Marketplace Midtown Approval and Adjournment

skip

The commission votes to approve the Marketplace Midtown project with standard conditions and adjourns the meeting.

Contains only the standard procedural vote and final adjournment.

Key points

  • The Sidewalk vs. Setback Conflict on Fulton Street — Midtown Redevelopment contested a Zoning Hearing Board mandate requiring buildings to front directly on the narrow Fulton Street property line. The developer successfully argued that a 5-foot setback is necessary to build code-compliant, ADA-accessible sidewalks instead of narrow, unsafe pathways.
  • Defining Genuine Public Space — Planning staff criticized the developer's relocated community garden layout, arguing that isolating it behind private townhomes and an alleyway does not constitute a welcoming community amenity.
  • Procedural Boundaries for Post-Approval Changes — The commission debated whether minor layout changes made after Zoning Hearing Board approvals require a formal return to the zoning board, ultimately ruling that converting setback space to sidewalk qualifies as a minor technical adjustment.
  • Preserving Informal Green Spaces in Urban Infill — During the Marketplace Midtown hearing, a local resident voiced concerns about losing open grass lots where neighborhood children play, prompting developers to collaborate directly with residents to preserve non-buildable parcels as green spaces.

if not I'd like to get a motion for

16:34

approval I'll move to approve as

16:36

submitted is there a second second it's

16:40

been moved and second for approval of

16:41

the minutes as they are all those in

16:44

favor state by saying I I oppose

16:48

extensions motion

16:50

carried under old business there's

16:53

none under new business uh item number

16:57

one is a lot consolidation on land

17:00

development plan application for Capital

17:02

Heights phase

17:04

three this is Zone RM is followed by

17:08

Chris Bryce and David long with Midtown

17:12

Redevelopment

17:13

LLC is to consolidate Lots across six

17:17

separate sites to construct misuse and

17:20

multi family blowing structures along

17:23

with the seated site and excess in

17:54

will be provided in

18:13

property project

18:24

Isis Street to the South oh thanks uh

18:27

and Logan Street to the West

18:29

the applicants intend to vacate Jud

18:31

alley and consolidate the subject

18:33

Parcels into nine separate project sites

18:35

that will include seven mixed juice

18:37

multif family buildings with site and

18:38

access improvements and four Town Homes

18:41

two along Logan Street and two along

18:43

Clinton Street uh per the development

18:45

map in the case report the planning

18:49

Bureau staff recommends that the case

18:51

that the uh application be approved with

18:54

the following conditions uh the

18:56

applicants will redesign aspects of the

18:57

project which were changed subsequent to

18:59

the zoning hearing board approval

19:00

including the configuration location of

19:02

buildings 5 through 7 and the Logan

19:04

Street Town Homes uh or will submit uh

19:07

resubmit new zoning relief applications

19:08

for such changes and receive approval

19:10

from the zhp uh those were based on some

19:12

preliminary drawings that were received

19:14

by the planning Bureau um in the uh

19:16

interim uh the applicants have provided

19:19

updated documentation on um some of

19:22

those issues uh including the removal of

19:24

a floor at Building 7 uh such that um uh

19:28

much l zoning relief is necessary uh if

19:30

the applicants want to move forward with

19:32

the uh uh project as proposed uh the

19:35

applicants will redesign the Logan

19:36

Street town homes so that the property

19:38

at 1640 nor4 Street can be utilized as a

19:40

public amend amenity incorporating a

19:42

relocated community garden which the

19:44

applicants agreed to during the review

19:46

of phase one of the Capital Heights

19:47

project which included the removal of

19:49

the community garden on North Third

19:51

Street uh the applicants should design

19:53

all the proposed residential units

19:54

within the project to be at least

19:56

visitable if not fully a Ada access ible

19:59

including aspects such as zero step

20:01

entries for the proposed Town Homes to

20:03

ensure the units are accessible to as

20:05

much of the population as possible uh

20:08

the applicant should ensure that the new

20:09

vehicular access point on Clinton Street

20:12

uh features a driveway curb cut design

20:14

as opposed to the current Street curb

20:16

cut design uh the applicants will

20:18

coordinate with the city Engineers

20:20

office on new or reconstructed sidewalks

20:23

and pedestrian markings such as

20:25

crosswalks uh the plan Bureau recommends

20:27

that the applicants consider sidewalks

20:28

full width of the public right away

20:30

Along Hamilton Street and North Fourth

20:32

Street specifically and uh the

20:34

applicants will should should consider

20:37

the inclusion of secure ground floor

20:39

bike storage in the proposed apartment

20:40

and mixed use buildings and will include

20:42

bicycle racks near the entrance of the

20:44

commercial spaces and buildings uh 2 3

20:46

and four as required per section 7-

20:50

327.5 of the zoning code the plan bureo

20:52

would recommend that such parking be

20:54

located near the main entrance and

20:55

sheltered if possible uh the applicants

20:57

will provide formal landscaping and

20:59

photometric plans to inform discussions

21:01

with the City Arborist and to confirm

21:02

consistency with the applicable

21:04

regulations of the zoning code such as

21:05

the fence regulations and the

21:07

environmental performance standards the

21:09

applicants should consider using native

21:10

tree species and pollinator plants and

21:13

finally the applicants will coordinate

21:14

with the Department of Public Works to

21:15

confirm the appropriate size location

21:17

and design of refu collection

21:19

particularly for the multif family

21:21

dwellings and mixed use buildings plan

21:24

Bureau staff recommends the request be

21:25

approved for the following reasons the

21:27

applicants have received approval from

21:29

the zoning hearing board where the

21:30

various relief requests needed to

21:32

effectuate the project as previously

21:33

submitted and if the bureau's conditions

21:35

are adopted will have met the conditions

21:37

of those approvals in the subsequent lot

21:39

consolidation and Land Development

21:40

submission uh the project will enhance

21:42

the character of the neighborhood by

21:44

replacing vacant Lots with buildings

21:45

that reflect the height massing and

21:47

configuration of the surrounding

21:48

community and will enhance pedestrian

21:50

infrastructure throughout the project

21:51

area the proposed residential uses both

21:54

the town homes and the apartment

21:55

buildings will feature two bedroom units

21:57

which are inard which are in higher

21:59

demand than some of the studio or

22:01

one-bedroom developments that have been

22:03

more commonplace in recent proposals and

22:05

finally The Proposal will add new

22:07

residents to the neighborhood and

22:08

activate the street and surrounding

22:09

community on nights and weekends and

22:11

contribute to a growing customer base to

22:13

support local businesses okay thank you

22:16

Jeff U could you state your name address

22:18

and relationship to the

22:21

project Matt long with Midtown

22:23

Redevelopment uh Andy George with one

22:26

law representing Developers

22:28

okay um you gentlemen heard the staff

22:32

report um with the conditions are you

22:36

acceptable of those

22:38

conditions um so uh thank you Mr

22:41

chairman by the way um I I don't know if

22:46

if uh this board because you've seen

22:48

this project on many many occasions

22:50

would like a presentation on uh the

22:53

project discussion around uh the

22:56

buildings and uses and Cly Mr can do

22:59

that and then we can talk about the

23:01

conditions look we can make things easy

23:03

I

23:04

mean we'll accept the conditions except

23:07

one we'd like to talk about with the

23:08

Planning Commission and and I leared

23:11

Jeff to some concerns um and we like his

23:15

input as well too so would you like a

23:17

little presentation for us to talk about

23:19

the project do that or we can talk about

23:21

the conditions I say since even though

23:24

we have reviewed it many times but we

23:27

these specific uh project yes we would

23:31

like a quick review okay and we do have

23:33

amended plans if you'd like me to pass

23:35

those

23:39

out are those different

23:42

from there are some minor um uh changes

23:45

in the plans with respect to like I said

23:47

U building seven in the original plan

23:49

set was four stories and 16 units this

23:51

one shows 12 sto or 12 units and three

23:53

stories um and a few other changes here

23:56

and there um with respect to some of the

23:59

building Footprints but for the most

24:00

part they're pretty similar I don't

24:02

think there's any um substantive changes

24:05

between the

24:18

two oh and uh two more uh one more

24:20

change I should note is buildings three

24:22

and four on those new sets do show the

24:25

first floor commercial space which the

24:27

prior set did not

24:29

um they just showed it as being sixun

24:31

apartment buildings but they still do

24:33

have the first floor commercial

24:43

space a quick walk through on the

24:46

project is these are the vacant lots and

24:48

Capital Heights every one of these is

24:50

the vacant lot that's been vacant for

24:52

sometime um and part of developments

24:55

that were started failed started stopped

24:58

failed uh repeat over and over about

25:01

four more times these are all infill uh

25:04

three buildings are uh very much

25:08

infill uh spaces that hit Corner Lots um

25:12

that are approximately 30 to 50 ft wide

25:16

uh they feature first floor commercial

25:18

space with a few apartments above each

25:21

uh there's adjacent parking uh to each

25:24

building um and then there are three

25:27

larger 12 unit buildings uh that span

25:31

across bigger lots that are about 200

25:33

feet long and about 100 feet wide and

25:36

then there's one 8 unit apartment

25:38

building uh that sits on a about 100

25:42

about 100 foot wide and Watt by about 70

25:45

ft deep um

25:49

the ldps that you have in front of you

25:52

um reflect the zoning that was approved

25:56

previously in the layout that were

25:58

approved previously with one note on our

26:02

zoning plans the language that was

26:06

listed was to match existing prevailing

26:09

setback on

26:11

buildings 5 six and seven or de and

26:15

app when we received the paperwork from

26:18

the solicitor uh the zoning hearing

26:20

board solicitor with the order there was

26:22

a note after the order on page 22 that

26:26

said instead prevailing to match

26:29

existing prevailing setback it noted to

26:32

move them to the front yard line this is

26:35

the only condition we have an issue with

26:38

because if you're on these Lots Folton

26:40

Street is very so every one of these

26:43

would be pushing against fton street

26:46

it's very narrow it's only about 14 feet

26:49

the total right away is 20 feet so it

26:52

gives you 2 6 in sidewall which isn't

26:56

legal to begin with we'd have to have

26:58

minimum 3T so we'd already be

27:00

encroaching 6 in onto the land to make a

27:03

legal sidewalk which is the intent what

27:06

we'd like to do is move the buildings

27:08

back about four or five feet because

27:10

you're going to have 15 135t long

27:14

building 3 feet off the road on a 14t

27:17

wide Road that's our concern is you'd

27:20

have a very

27:22

narrow lock a road way with a large

27:26

building directly adjacent to it and

27:29

then our original plan should prevailing

27:32

the prevailing block the only uh

27:36

instance of this is the existing town

27:38

homes on fton street and they sit back

27:41

about 6 feet and that was our original

27:43

intent is to sit back about six feet so

27:46

you're not crowding this big building

27:47

right against the road and there's ample

27:49

room on the other side to still maintain

27:51

plenty of Green Space facing roads alley

27:54

and uh Meer alley

28:00

um well I mean as to the zoning hearing

28:03

board's decision it is as written and if

28:05

it was not challenged by the applicants

28:07

that's what the zoning hearing board

28:08

decision is and so that's kind of what

28:10

the applicants need to conform to now

28:12

their point about the narrow sidewalks I

28:15

think is accurate if you go out there

28:17

they're almost certainly not um you know

28:21

compliant with the city standards I'm

28:22

kind of confused as to why they were

28:24

built that way in the first place um but

28:27

if the applic intention is to you know

28:30

provide a wider uh sidewalk um for the

28:34

general public in front of their

28:35

buildings we think that's a reasonable

28:38

um uh justification for um some

28:41

deviation uh for that uh but if it's

28:45

just to put a six yard a six foot wide

28:47

yard in the front you know as we noted

28:50

during the zoning hearing board uh

28:51

reviews and the Planning Commission

28:53

review of the zoning relief requests um

28:55

you know a lot of times these little

28:56

interstitial spaces

28:58

become useless spaces they become they

29:01

get walked on they just become dirt

29:02

patches and they're really not

29:04

contributing either to the streetcape or

29:06

to the benefit of the tenants of these

29:08

buildings whereas if buildings are moved

29:10

to the front property line you create

29:12

more space behind where they can have I

29:14

know patios you know fire pit cornhole

29:17

whatever a place to go out and uh um you

29:20

know maybe walk your do dog or something

29:22

um so in the interest of you know having

29:25

a more useful uh property I think and

29:29

something that I think does better

29:30

conform to the overall uh neighborhood

29:33

and they're right that the one row of

29:36

buildings across the street uh from site

29:39

five uh with the town homes is set back

29:42

and frankly I think going out there kind

29:43

of proves my point is that some of them

29:45

are overgrown with lots and it's because

29:47

they those spaces have no utility um and

29:50

so I think it would give the overall

29:52

project more utility the overall project

29:54

sites more utility to have them as close

29:56

to the front property line as possible

29:58

again if it if the intention is to the

30:00

applicant's point to try and provide a

30:03

more ADA Compliant path along the front

30:05

edges of these buildings that that I

30:08

think is a good justification um but if

30:10

it's just to have a couple of bushes

30:12

that are going to die out in a year and

30:13

a half or something I I don't think that

30:16

um that's frankly good Urban Design or

30:18

would be would make the projects look

30:24

better just on we would be perfectly

30:27

accept making a majority of it sidewalk

30:31

but we' also like to still have some

30:33

type of vegetation trees if you walk

30:35

around the block if you're walking up

30:37

Hamilton or you're walking up Harris you

30:39

have tree planters every 15 to 20 feet

30:42

that's the type aesthetic we'd like to

30:44

keep and we you know most of all we

30:46

would like to keep the building back so

30:47

it's not crowding the street and you're

30:49

not walking down you're not right

30:50

against someone's bedroom you're not

30:52

right up against the building um so we

30:55

definitely are not opposed to making it

30:57

a majority sidewalk with the ability to

31:01

have tree planers say every

31:07

15t

31:12

um quick

31:14

question Jeff yeah if if if that would

31:17

occur I believe that would be consistent

31:20

with the zoning code right we wouldn't

31:22

be in violation of The Zing code with

31:24

that six foot setback and with addition

31:28

I think the devil's in the details on

31:30

that we really have to see exactly what

31:32

that looks like I would not feel

31:33

comfortable giving a response without

31:36

seeing you know something written with

31:39

Dimensions well but if if the cach wrote

31:41

five foot or match existing prevailing

31:44

set back which that would do if we say

31:47

they're five foot then we're matching

31:48

the Z directly the point being the zon

31:53

hearing board rendered a decision with

31:54

their decision written out and so the

31:57

project needs to conform to that and

31:59

this was kind of the planning bureau's

32:00

intent from the get-go last year when we

32:03

were reviewing this project is not is

32:05

again not to have these small little you

32:07

know 3 foot x 3 foot front yards or

32:09

whatever it's to have a building that is

32:11

reflective of buildings literally

32:13

throughout the city um I don't

32:15

understand frankly the concern about

32:17

crowding the sidewalk when you

32:20

know blocks throughout Midtown Uptown

32:23

Allison Hill have buildings constructed

32:25

right to the sidewalk it is what kind of

32:28

defines Urban um streetscapes and urban

32:31

spaces is to have this um is to have

32:34

buildings fronting these uh uh the

32:36

sidewalk and directly accessible um to

32:39

the public right away yeah my

32:42

understanding of the concern though for

32:43

the developers Jeff really is the the

32:46

size of the sidewalk of area so um can

32:50

we reach a an agreement that expanding

32:53

the sidewalk would be good for Ada

32:55

purposes um to create some additional

32:58

space on the sidewalk for people to move

33:01

uh like I said I think then widening the

33:04

sidewalks to make them you know five

33:06

foot wide or whatever however large uh

33:08

wide they end up would be a reasonable

33:11

justification for that but um otherwise

33:14

I would probably say no okay so if if if

33:17

we if

33:19

we agree to expanding the sidewalk and

33:23

subject

33:25

to sta planning staff review prior to

33:28

the submission and following the plans

33:30

would that be an acceptable condition

33:33

that's up to the Planning

33:36

Commission if it's for the expansion of

33:39

the sidewalk that would be a

33:40

justification in my

33:44

opinion I'm going to um go to the

33:48

Commissioners I have no question at this

33:52

time and I'll start with commissioner

33:54

old yeah I know at this time right

33:58

commission

34:02

re these units are mixed income units

34:05

yes uh the whole overall project has U I

34:09

believe about 14% low income set

34:12

aside and the town homes those will be

34:15

those those four town homes in this

34:18

packet are low it doesn't too

34:21

low thank

34:24

you uh commission mark

34:30

uh thank you yep I'll start with an easy

34:33

question what's the uh project timeline

34:36

that we're looking

34:39

at within a year um and again I always

34:43

CAU saying this because as Chris and I

34:46

can tell you right now we are still

34:47

these are all H um we just got for the

34:53

project you heard almost two years ago

34:55

to the day uh our plans are sitting

34:58

with the codes Bureau and they're also

35:01

sitting with h waiting for some

35:03

revisions to the contract language and

35:06

after 17 months we receive new parcel

35:10

ideas So within a year is the ideal

35:14

time to break ground or complete ground

35:18

break okay all

35:24

right um so going back to the

35:28

conversation about you know the the

35:31

frontage of the buildings on Fulton

35:34

Street and setbacks or being right up

35:37

against

35:39

all do you know Matt what the WID is of

35:45

the proposed sidewalk presently is it

35:48

like a foot less than a foot the

35:51

addition I can't see a diens if you

35:53

follow what's there now uh they're two

35:57

feet 6 wide they're not even up to code

36:00

so if you look at our plans you see

36:02

about 6 in on there that's to get them

36:05

to Legal width right there I mean these

36:07

are they weren't built to code yeah and

36:10

they weren't built like anything else in

36:11

the city you don't have anywhere that

36:12

you have a two foot6 wide sidewalk and

36:15

the RightWay is 20 feet you got a 14

36:17

foot wide road so right so the side that

36:20

bit of sidewalks in the has to be in the

36:23

right of way of the road because it's so

36:26

yeah so that's not even ADA Compliant

36:30

correct at the current Dimension

36:32

no but

36:34

yet one of the conditions is asking for

36:38

Ada comp ADA compliance and visibility

36:41

at the highest extent possible so we're

36:43

sort

36:45

of sort of like double like like it's a

36:49

little bit hypocritic we're kind of

36:50

going double-edged sword here asking for

36:53

one condition but then not really

36:54

allowing for the other condition to be

36:56

fulfilled it's a little contradictory of

36:58

what we really want here yeah and and

37:01

like I said I agree that widening the

37:03

sidewalks is a is a reasonable

37:05

justification I would just like if if it

37:07

was just to have the setback with a yard

37:10

in front for example I would think that

37:13

that would not be you know a reasonable

37:14

justification right um yeah I mean I'm

37:17

thinking about the ADA compliance

37:20

accessibility the desire to allow for a

37:24

greater visitability of access of the

37:27

sites also the vision zero City plan of

37:31

pedestrian priority and

37:33

safety um so so that's sort of some

37:37

things I'm thinking about I going back

37:39

in then the planner thought

37:43

um would it be a possibility and a

37:46

consideration to sit down with Claire at

37:50

crw to

37:52

discuss um incorporating some of those

37:55

tree Wells and

37:57

uh the smaller storm like rain basing

38:01

you know rain capture areas you could

38:03

incorporate some of those if you went to

38:05

a six foot plus sidewalk with um it also

38:10

might help with some of your storm water

38:12

management

38:13

requirements on the

38:18

sites some food for thought

38:21

for is the condition

38:23

one all focused around this chain

38:28

that

38:29

was there other the condition one was a

38:32

little vague to me and that might just

38:33

be because I don't remember right the

38:36

back and forth well like I said it was

38:38

uh related to like the Logan Street Town

38:40

Homes were set back um and those in the

38:44

initial design and Zoning review were

38:46

set against the front yard there was the

38:47

additional building on um additional

38:50

floor on building seven uh and some of

38:52

these have been corrected in the um

38:55

revised plans but uh additionally when

38:58

the zoning her board does render a

38:59

decision if a plan is designed to not be

39:03

in conformance with those um conditions

39:05

of approval they uh the applicants have

39:07

to go back before this actually happened

39:10

it doesn't happen often uh but it did

39:12

actually happen with the molder Square

39:14

project where they moved some of the

39:15

units from one of the sites into another

39:17

building and the applicants had to go

39:19

back to the zoning hearing board and get

39:20

relief from the condition the zoning

39:22

hearing board applied in that situation

39:24

so that's why we want to make sure that

39:26

the project is going forward in

39:28

conformance with the zoning hearing

39:29

board decision sure understood that

39:32

makes sense

39:34

um my last question is around condition

39:39

two what is the intent of the planning

39:43

Bureau about redesigning that so that

39:46

it's utilized as a public

39:48

amenity so that was as as noted in the

39:51

condition there that was brought up uh

39:53

during the discussion on uh phase one uh

39:56

which was um the block along between

39:58

Third Street and Logan Street and if the

40:01

Commissioners may remember there was a

40:03

bit of a consternation uh from some

40:05

members of the public about the loss of

40:07

the community garden there along Third

40:08

Street and uh I mean you might not

40:11

remember that it was a while ago and I

40:12

think the garden itself has fallen into

40:14

some disrepair since then probably due

40:16

to the kind of Uncertain nature of where

40:18

everything stood there but um as a um uh

40:23

as a offset uh the applicants um had

40:26

noted and I believe it actually ended up

40:28

in some sketch site plan uh that they

40:31

would be having the community garden on

40:33

the Block to the east in fact I looked

40:35

it up uh while doing this case report

40:37

and I believe commissioner Merck you had

40:39

asked about that and they had said you

40:41

know we will provide this Garden um to

40:44

the East and I believe it was meant to

40:45

be a continuation of a brick sidewalk

40:47

that went through the uh block of phase

40:50

one and then through this site through

40:52

this uh block here alongside the Logan

40:55

Street town homs

40:57

if I can real quick on that um the size

41:01

of the town homes have been increased a

41:02

little bit which page are you on so

41:07

chp-1

41:10

c-1 thank

41:12

you so the community garden is still

41:14

going to be there um and we will update

41:18

the plans to show access to it but it

41:22

will be at the the where you see site

41:26

Logan Clon yeah that's where that so

41:29

what we'll do uh before submission and

41:32

we'll make you know send to the planning

41:34

Bureau is we'll throw a hatch pattern on

41:37

there and show this area is dedicated to

41:39

community garden if you look directly

41:42

above that there's actually an existing

41:43

RightWay there uh and there's a pathway

41:46

you you'll see it even indicated uh to

41:48

your left there's an existing walkway

41:50

there that buts the property so still

41:52

have a RightWay access um and then we

41:55

will show the portion beyond the

41:58

townhouse lot as dedicated to communal

42:01

space community garden space so there'll

42:04

still be access um we might put a note

42:06

on there that the portion of

42:11

access

42:12

within our land will be updated and

42:16

upgraded for easier ease of

42:21

access what's that yeah if well if the

42:25

intention is to expand that over to

42:27

North Fourth Street so that it's

42:29

accessible to the public and visible to

42:30

the public I think maybe that'd be okay

42:33

but to just put a little island in the

42:35

center of the of the block that's really

42:37

only accessible via the parking lot and

42:40

bya a maybe 4 foot wide uh Grocers alley

42:44

that runs behind buildings like that to

42:45

me does not say welcome Community it

42:47

does not say this is a community space

42:49

it says you know this is a space that's

42:52

really off limits to people and um you

42:55

know I don't think that was the

42:58

intention uh of the planning Bureau to

43:02

accept what they're proposing now um

43:05

when we discussed this a year ago uh and

43:08

you

43:09

know the I'm not sure why the townhouse

43:12

is just had to be widened all of a

43:14

sudden the ones along um uh Clinton

43:17

Street seem to be about the same size as

43:20

the lots that are along Logan Street

43:22

they've just widened the houses uh and

43:25

again post discussion of this with the

43:29

Commissioners and with you know planning

43:31

Bureau staff and uh you

43:35

know I I just think the applicant should

43:38

be following through on the commitments

43:39

they've made in previous discussions of

43:41

this project and phase one of the

43:44

project um again maybe it doesn't have

43:47

to look quite the same as using the

43:49

whole block or the whole property at

43:51

1640 North 4th Street for public right

43:54

away but you know that was definitely

43:56

the

43:57

uh discussion point at the last meeting

44:00

and um to change that then after the

44:02

fact after getting approvals is you know

44:06

not something that I think is a good

44:08

look um when we're changing the design

44:11

to something that was previously agreed

44:13

upon the applicant has no issue

44:15

dedicating four four feet space to the

44:19

north to wider access

44:29

which would match the

44:49

original well I can't Jim in about that

44:52

commentary it's between those

44:55

two we no toic it was 4T back so it

45:01

would be an 8ft

45:03

wide um so you have 7 ft right now

45:06

between the two but given up the three

45:08

foot set

45:11

back think the constract ability on it

45:15

this one the house doesn't actually

45:17

encroach the whole way so we have room

45:19

to run on the side this one there

45:21

actually built right onto the property I

45:24

wouldn't want to give up to 3 ft there

45:26

for constru

45:27

giving

45:28

thist as a dedicated path or an

45:34

EAS which would match the original plan

45:36

of the wi walkway I mean I'd really have

45:39

to see a

45:41

um a site plan of what this is as

45:43

opposed to a conceptual discussion um

45:46

for me to say whether the planning

45:47

Bureau felt that this met the intent of

45:50

the discussion at previous

45:55

meetings can we the Practical question

45:58

you're kind of negotiating sitting here

46:00

at the table for something that's not

46:01

confronted with the board so what are

46:02

you asking the board to do well we just

46:05

received these on Friday I'm asking what

46:08

are you asking the board to do because

46:09

how they something that's not in front

46:12

of the PID fuel should be

46:17

conditioned asking the bo to add

46:19

conditions you're proposing tonight I'm

46:21

just trying to get clarity what the

46:22

board is going to be es well I think I

46:26

think um

46:27

there are eight

46:29

conditions uh

46:31

that came along with the recommendation

46:34

from the city I think we're asking that

46:38

those conditions this board consider

46:40

amending those consistent with the

46:42

discussion tonight so so they're very

46:45

detailed what you're saying yeah and so

46:47

I just the clarity of everybody it has

46:49

to be very detailed how this what in

46:51

front of yeah and I think that along

46:54

with that I would say Neil um because I

46:57

think Jeff raises a good point that

47:01

certainly if the language isn't

47:03

perfected tonight but it comes with a

47:06

the plans have to be submitted to

47:08

planning stand for approval on on

47:10

meeting the conditions being discussed

47:12

tonight because I know for instance Jeff

47:14

ra a concern with look you're asking me

47:16

to say what's the sidewalk going to look

47:18

like when it's six foot and I don't have

47:19

a plan in front of me I want to see what

47:21

it looks like where the planners are you

47:23

know I think that's that's reason where

47:27

saying look I'll reverse the plans back

47:28

and you know provide some sort of easer

47:31

right away if that's subject to planning

47:33

staff review I think that' be an accept

47:40

condition I was just trying to get

47:41

clarification

47:44

trying I'll leave it to Mr

47:51

night at the end of the day I guess my

47:54

concern is why this plan does does not

47:57

look like what was reviewed and approved

47:58

at the zoning hearing board I don't

48:00

understand why certain changes are made

48:02

like that's the whole point is to say

48:04

here's what I'm going to do here's a

48:05

zoning relief I need to get to do that

48:08

and then here's Land Development plan to

48:09

effectuate what I said I was going to do

48:12

and now we're getting changes between

48:13

what that zoning relief is and now and

48:17

you know I there without seemingly

48:19

justification there seems to be just

48:21

well we decided to make the buildings

48:23

wider or we just decided to change this

48:25

community space we we told people where

48:28

it's going to be here and that is my

48:29

concern is that this is done kind of

48:32

really like I don't understand why these

48:35

things are being made when the whole

48:36

point of the process as we go through it

48:38

is to say this is what I'm doing here's

48:40

the

48:41

legal uh here's the legal uh permissions

48:45

that I need from the zoning hearing

48:46

board and then here is the land

48:48

development plan that again accomplishes

48:51

what we all talked about during the

48:52

zoning relief process and then there's

48:54

these changes between and if those if

48:57

that wasn't what they intended to build

48:58

they should not have brought that before

49:00

the board is my concern because now it's

49:02

just well we have to do it this way and

49:04

it's different than what we said

49:07

before Jeff you're saying

49:11

that we vote

49:13

on your report with the

49:17

conditions and they're acceptable of

49:20

those that's not changing the plans

49:23

right yeah and I and I think there is

49:27

some wiggle room here given the

49:29

conditions it says you know they'll use

49:31

1610 North 4th Street uh for um the for

49:37

the community space in the garden and

49:39

you can do that without having used that

49:41

whole property and still meet that but

49:43

if it's just hey we'll give you this 4

49:45

foot of space between these two fences

49:47

here that the community can walk down to

49:49

get to this Garden to me that's not a

49:53

community amenity that's not what uh the

49:56

intent of that discussion was at the

49:58

previous

50:03

meeting I just raise the issue then Jeff

50:06

is it is

50:09

it not consistent with the code and I I

50:12

think about both of these issues I

50:14

mean a plan may have been presented to

50:17

the zoning hearing board for the

50:18

purposes of relief but if a subsequent

50:21

plan is consistent with the code

50:23

regardless of what relief was granted by

50:25

the zoning hearing board

50:27

why does that matter so for example if

50:30

you have a

50:31

non-compliant not Ada accessible um

50:35

sidewalk you wanted to build back um off

50:39

of the street further which you're

50:41

permitted to do and these with

50:44

zoning and your proposal is to expand

50:46

the sidewalk and that's consistent with

50:49

the zoning code you don't need zoning

50:50

releas so even though zoning human board

50:53

may have conditioned something and we

50:56

may but that's the thing we may you're

50:58

you're bringing these things up now when

50:59

it's like okay we're what if we do

51:01

something different and I said I said

51:04

maybe that's something we can work

51:05

through but again I've asked for

51:07

drawings I don't have you're asking me

51:09

to say yes to things that I can't see

51:12

and that's that's why I said I think the

51:14

proposed The Proposal then from us would

51:17

be there's a list of conditions we'd

51:19

like to meet with those conditions in a

51:21

different way and we're fine if the

51:23

condition is that there have to be plans

51:25

submit to you planning staff for that's

51:28

part of the approval tonight we would

51:30

accept that as a

51:34

condition again I if if they want to if

51:37

the board wants to say we are fine with

51:40

adopting these with that condition that

51:42

the plan will meet planning Bureau

51:45

approval I guess it sounds like you're

51:47

asking then if I say well I don't like

51:50

this are you going to say you know well

51:53

we can do it anyway because what you

51:55

asked for is not in the is not

51:57

likei you have to approve it so again

52:00

you know may I real quick we're we're

52:02

going onto a long drawn out conversation

52:05

here and what I'd like to go back to is

52:09

we got two items we're talking of the

52:10

community garden and we're talking about

52:12

the

52:13

side the proposal that we're asking for

52:16

tonight is very clear and doesn't

52:19

deviate from the zoning plans it

52:21

deviates on language that was adopted in

52:23

the order that's open for interpretation

52:26

like

52:29

they're Illustrated in front of you is

52:32

the setback that we're requesting Jeff

52:35

is saying it would be acceptable if it

52:37

was presented as concrete as a sidewalk

52:40

that is our proposal it's that that's

52:42

where we're at it' be proposed as

52:44

concrete there there's nothing more and

52:46

then on the community garden I will note

52:48

that the community garden was never in

52:50

the Zoning for this phase it was in the

52:53

Zoning for a prior phase it was not in

52:55

the zoning for what is approved and what

52:58

is in front of you what is depicted in

53:00

front of you in these drawings matches

53:01

the two six of 23 drawings that were

53:04

submitted and approved by the zoning

53:06

hearing board and this Planning

53:07

Commission last year it would still

53:10

allow for the community garden and we

53:13

are willing to take the additional space

53:15

that is not required for the homes and

53:19

dedicate that we have two things change

53:21

to concrete

53:23

and add the additional space to make it

53:26

more welcoming as you walk down to the

53:28

community

53:30

garden I I would argue that the plans

53:33

here do not match what was shown to the

53:35

zoning hearing board if they did it

53:37

would have been brought up at the former

53:38

meeting they and the applicants admitted

53:40

they they changed the configuration of

53:42

the of the roow of the Logan Street row

53:44

homes I'm just I'm just asking people to

53:46

be consistent when they come before the

53:48

boards and say Here's what I'm going to

53:50

do if then if they then follow up and do

53:52

not do that then you know that is that

53:56

creates a problem for me that creates a

53:58

problem for me because they've sat in

53:59

front of the board and in front of the

54:01

public and said we're willing to do this

54:02

and especially in regards to the

54:04

Public's concerns about the loss of the

54:05

community guard say we hear you we're

54:07

going to do this for you and now later

54:09

they come back and say we're not going

54:10

to do it that way and to me that's a

54:13

that's a concern that is a concern to me

54:29

and I I don't know if it's a question

54:30

per se but in the spirit of yeah

54:32

continuing to try to refocus and narrow

54:35

down I just wanted to share that it did

54:37

sound to me earlier having to do with

54:39

the setbacks and the sidewalks that a

54:41

wider sidewalk which I think everyone

54:43

agrees is a good idea could be a

54:44

justification for that I guess slight

54:48

change to condition number two does that

54:51

and I'm not saying and when I said that

54:53

I'm not saying I would prove it because

54:56

again I have to do this in conformance

54:58

with the zoning hearing

55:01

board so I was not if if it came across

55:05

as that as I was saying like yeah i'

55:06

sign off if you change this because I

55:08

like the thing you're doing like that

55:10

was not my implic it's not my intention

55:12

I I appreciate that and I'm not trying

55:14

to pass the buff on that I guess I would

55:15

share my view that I think I would

55:19

Elevate the concern about getting those

55:21

sidewalk width up to the legal standard

55:23

and hopefully a little bit you know to

55:25

be

55:26

the elevating the elevated concern in my

55:28

mind so I would view that as a

55:30

justification for the the piece of that

55:33

that we were talking about first I I

55:35

know that we were talking about a second

55:36

thing as well but I guess I would share

55:38

that with the commission at this point

55:40

and maybe defer to others who were

55:43

around for the first

55:45

uh on the community garden piece of

55:51

it I know it's not a question but I

55:53

wanted to put it in the room

55:56

um I'll go around with the Commissioners

56:00

after we heard more

56:02

discussion commission

56:17

have okay I'm still trying to clarify

56:21

with you Jeff if

56:24

you're I'm that if we

56:29

approve the uh project with your

56:33

conditions then you're

56:36

saying they are in compliance with what

56:40

was the zoning hearing board that would

56:43

be correct I mean that's basically what

56:44

the condition says is you will be in

56:46

compliance with the zoning hearing board

56:48

decision

56:56

I'll go to the public first and then

56:58

come back to Mission is there anyone in

57:01

the middle war against this

57:04

project one to my right

57:29

hi I just I'm sorry I I'm sorry my

57:33

concern is that

57:37

um are we deciding that the changes made

57:40

here are minor in nature or adjustments

57:44

or correction because if not and if not

57:47

if it's not going to match exactly with

57:49

the zoning hearing board said then

57:52

changes to approv plans need to go back

57:54

to the zoning hearing board so I'm

57:57

trying to figure out if if Jeff you're

58:01

making decision

58:03

that if it's not required it's because

58:06

it's from minor technical adjustments or

58:08

Corrections of information that do not

58:11

affect the significant features of the

58:12

site plan and the intensity of use as

58:15

determined by the zoning officer so are

58:17

you telling them that if you accept the

58:21

conditions that you're saying or leeway

58:23

that you're saying are they sticking to

58:25

the Z zoning hearing board's decision or

58:28

are they making changes that should be

58:31

sent back to the zoning hearing board if

58:33

the conditions as outlined in the case

58:36

report are adopted it would be in

58:37

conformance with the zoning hearing

58:39

board decision I mean even with I hear

58:42

you saying like well there could be some

58:43

leeway like I'm not sure no I'm saying

58:46

that might be a justification for moving

58:48

the building back but that's not saying

58:50

like I'm authorizing you to do that and

58:53

there could even be could moving the

58:55

building back a minor technical issue or

58:58

is

58:59

that how I think there needs to be legal

59:02

interpretation of you know what I'm

59:04

saying like if you're saying if he could

59:05

move the building back are you saying

59:08

that that would be a minor technical

59:10

adjustment or correction from what

59:11

zoning hearing said I don't know what

59:13

minor technical adjust I mean those are

59:16

I I don't even think that's the issue I

59:18

I I think that I'm saying I think the

59:21

issue is that if you're not approving

59:23

what the zoning hearing board already

59:25

approved

59:26

then it's problematic and I I disagree

59:29

because the zoning hearing board didn't

59:31

approve Land Development plans that's

59:32

not their job what their job is to Grant

59:35

relief and the issue that we're

59:37

discussing um doesn't go to us asking

59:42

our client asking for Relief out of the

59:44

zoning hearing code what I'm saying is

59:47

that and I I indicated this earlier the

59:49

plans that we're submitting which have

59:51

the additional sidewalk are consistent

59:54

with the Z we don't need relief

59:57

in order to submit those plans to Jeff

59:59

and say to

1:00:01

Jeff we'd like to have a bigger sidewalk

1:00:03

and build a bigger sideb this is

1:00:05

consistent with the

1:00:06

code we staff approve the plans it's not

1:00:09

his only hearing Court issue at that

1:00:11

point I'm I'm saying changes to an

1:00:15

approved

1:00:18

plan dimenions match exact the

1:00:21

dimensions match exactly what was

1:00:23

submitted for the zoning hearing board

1:00:24

to the team I just looked up 44 feet

1:00:26

rear yard setback we have 44 feet and

1:00:29

and it showed a 5 foot but it said to

1:00:31

match prevailing which would be if you

1:00:34

go by matching

1:00:36

prevailing would be the six foot setback

1:00:38

already

1:00:40

established I think there may be with

1:00:43

respect to the sidewalks maybe some to

1:00:47

your point about being a minor technical

1:00:48

issue uh if the space there in the

1:00:52

setback was used for a sidewalk that

1:00:54

would be considered development still if

1:00:57

somebody does a parking lot and they

1:00:59

build it to to the property lines we

1:01:01

consider that a development that

1:01:02

encroaches into a setback so that would

1:01:05

still be considered development would it

1:01:06

be the Building Development you know no

1:01:10

but it would be a development footprint

1:01:12

of a building like there I think you

1:01:13

could make an argument that that's a

1:01:15

technical issue in that case you know if

1:01:18

if we're trying if we're trying to look

1:01:20

for like whether this conforms to like

1:01:22

the zoning code Andor conforms to the

1:01:24

zoning hearing board decision and saying

1:01:25

like well if you're moving that back

1:01:27

then you're not conforming to the zoning

1:01:28

hearing board decision that's still a

1:01:30

development encroachment into the foot

1:01:32

pack into the setback it's still

1:01:33

development up to the property line it's

1:01:36

just used for a sidewalk instead of the

1:01:39

building so I think in that Spirit of uh

1:01:42

what miss Cameron is saying that could

1:01:43

be considered a minor technical

1:01:45

alteration

1:01:59

um Commissioners there's any other

1:02:02

comments but uh at this time I like to

1:02:07

get a motion to

1:02:09

approve the project with the conditions

1:02:17

[Music]

1:02:32

if not I need a

1:02:34

[Music]

1:02:36

motion another motion

1:02:56

trying to

1:02:58

think um

1:03:28

I would make a motion to

1:03:32

approve with the conditions amending

1:03:35

condition

1:03:38

one to I'm trying to think how to word

1:03:41

this to State how uh to state

1:03:45

that buildings 5 through 7 in the Logan

1:03:49

Street Town Homes will be in zoning code

1:03:53

conformance

1:03:56

I think that would address what we're

1:03:59

discussing about

1:04:12

this is there a second

1:04:21

one yeah a

1:04:24

second with with with the well I don't

1:04:27

need to make a notation but with the

1:04:28

understanding that that result to be

1:04:31

approved by the reviewed by the the

1:04:33

planning bu Bureau I should add that um

1:04:36

statement as well to condition one

1:04:40

seconded the moov and second for

1:04:43

approval with the

1:04:46

amended one yeah all those in favor

1:04:51

state by St

1:04:52

I I opposed

1:05:03

okay we're go to item number two

1:05:16

then item number two is uh by

1:05:20

consolidation and land development plan

1:05:22

application for Marketplace Midtown

1:05:25

which is Zone RM it's followed by Chris

1:05:30

Rice and David long with Midtown

1:05:32

Redevelopment

1:05:33

LLC and it's to consolidate lot to cross

1:05:36

seven separate sites to construct initia

1:05:40

commercial and multi family dwelling

1:05:43

structures along with ass s

1:05:48

excise uh yes so the applicants are

1:05:50

proposing to consolidate Lots across

1:05:52

seven separate sites to construct mixed

1:05:54

use commercial and multif family

1:05:55

dwelling structures along with

1:05:57

Associated site and access improvements

1:06:00

three of the project sites will be

1:06:01

developed as row homes three will be

1:06:03

developed as multif family dwellings one

1:06:05

of the sites will be a mixed juice

1:06:07

building one of the sites will be a food

1:06:09

Hall and three will be developed as

1:06:11

accessory parking for the proposed

1:06:12

residential and commercial buildings uh

1:06:14

the six space 8 space and 43 space

1:06:17

parking lots in total there will be 62

1:06:19

units across 23 individual buildings and

1:06:21

approximately 5,500 Square ft of

1:06:24

commercial space uh similar to the last

1:06:26

one I'll just read the general property

1:06:28

description um as opposed to the

1:06:31

description of each individual site uh

1:06:33

the project is comprised of uh

1:06:35

51 separate vacant Parcels the applicant

1:06:40

the applicants intend to both

1:06:41

consolidate and subdivide the subject

1:06:43

Parcels into 11 separate project sites

1:06:45

that will include mixed use multif

1:06:46

family buildings with site improvements

1:06:49

town homes and a food Hall per the uh

1:06:52

attached development

1:06:54

map the Claim Bureau staff recommends

1:06:57

the request be approved with the

1:06:58

following conditions uh the applicant

1:07:01

should design all of the proposed

1:07:02

residential units within the project to

1:07:04

be at least visitable if not fully Ada

1:07:06

Ada accessible including aspects such as

1:07:09

zero step entries for the proposed Town

1:07:11

Homes to ensure the units are accessible

1:07:14

to as much of the population as possible

1:07:17

uh the applicants should ensure that all

1:07:18

new vehicular access points feature a

1:07:20

driveway curb cut design as opposed to a

1:07:22

street as opposed to a street curb cut

1:07:25

design

1:07:26

uh the applicants will coordinate with

1:07:27

the city engineers's office on new or

1:07:29

reconstructed sidewalks and pedestrian

1:07:31

markings such as crosswalks planing

1:07:33

Bureau recommends that the applicants uh

1:07:35

specifically consider full width

1:07:37

sidewalks on the public RightWay along

1:07:39

cder Street and North Fourth Street uh

1:07:42

the applicant should consider the

1:07:43

inclusion of secure ground floor bike

1:07:44

storage in the proposed apartment and

1:07:46

mixed use buildings and will include

1:07:48

bicycle racks near the entrances of the

1:07:49

commercial components of the project is

1:07:51

required by section 7- 327.2 of the

1:07:54

zoning code plane Bure would recommend

1:07:56

that such parking be located near the

1:07:58

main entrance and sheltered if possible

1:08:01

the applicants will provide formal

1:08:02

landscaping and photometric plans to

1:08:04

inform discussions with the city rbur

1:08:05

and to inform consistency with the

1:08:07

applicable requirements of the zoning

1:08:08

code such as the fence regulations and

1:08:11

the environmental performance standards

1:08:13

and finally the applicants will

1:08:14

coordinate with the Department of Public

1:08:15

Works to confirm the appropriate size

1:08:17

location and design of refuse collection

1:08:20

particularly for the multif family

1:08:21

dwellings and mixed use buildings uh

1:08:23

plan Bureau staff recommends the request

1:08:24

be approved for the following reasons

1:08:26

the applicants have received approval

1:08:28

from the zoning hearing board for the

1:08:30

various relief requests needed to

1:08:31

effectuate the project as proposed and

1:08:34

has met the conditions of those

1:08:35

approvals in the subsequent lock

1:08:37

consolidation and Land Development

1:08:38

submission the project will enhance the

1:08:40

character of the neighborhood by

1:08:41

replacing vacant Lots with buildings

1:08:43

that reflect the height massing and

1:08:44

configuration of the surrounding

1:08:45

community and with commercial space

1:08:47

tailored to small businesses similar to

1:08:49

those along nor Third Street and will

1:08:50

enhance pedestrian infrastructure

1:08:52

throughout the project area the proposed

1:08:54

residential uses both the town homes and

1:08:56

apartment buildings will feature two

1:08:57

bedroom units which are in higher demand

1:08:59

than some of the studio one-bedroom

1:09:01

developments that have been more

1:09:02

commonplace in recent proposals and

1:09:04

finally The Proposal will add new

1:09:06

residents to the neighborhood and

1:09:07

activate the street and surrounding

1:09:08

community on nights and weekends and

1:09:10

contribute to a growing customer base to

1:09:12

support local

1:09:14

businesses thank you Jeff uh gentlemen

1:09:17

you heard the staff report are you

1:09:20

acceptable of those comms yes

1:09:26

Commissioners I have no questions um if

1:09:29

you have any concerns or questions and

1:09:31

let's start with commissioner I have

1:09:33

none commissioner re none commissioner

1:09:38

mer uh just one similar question to

1:09:40

before what is the project timeline on

1:09:42

this proposal uh the same the goal on

1:09:46

this one actually is uh very aggressive

1:09:50

we

1:09:51

hope if approved and reported uh to

1:09:55

break ground on parking the main parking

1:09:58

lot the market building in the towns

1:10:01

soon as possible ideally we've been

1:10:03

talking March or

1:10:07

April hope to get the marketpl building

1:10:09

done before the

1:10:16

market think that may be

1:10:19

likely at this at the rate the city's

1:10:23

going uh I have no other questions

1:10:28

Joe no questions thank you okay is there

1:10:32

anyone from the public for against this

1:10:35

project start the

1:10:37

middle to my right would you state your

1:10:41

name and

1:10:42

address uh my name is Dylan Ziggler my

1:10:44

address is 1422 fton Street I think this

1:10:49

project is

1:10:50

surrounding area um is there green left

1:10:55

in any of these

1:10:57

areas um is that proposed in the project

1:11:00

because I live in this area um most of

1:11:02

the lots that I think because I couldn't

1:11:04

get any information as to exactly which

1:11:06

lots are in this area um those lots are

1:11:10

used by families in this area um it's

1:11:12

not quite the

1:11:14

same those lots don't look the same as

1:11:16

the ones that are up farther north on

1:11:19

Four Street that your other project that

1:11:21

you're doing um these lots are kept

1:11:23

really nice there are family that play

1:11:25

in those yards um in those empty lots

1:11:28

specifically the ones that have grass um

1:11:30

specifically the one that's next to the

1:11:32

church on Maran Street um so I just want

1:11:36

to know if there is any green space left

1:11:39

because now we're turning all this green

1:11:41

space into parking

1:11:44

lots um so these are all inil Lots uh

1:11:48

have you had a chance to look at the pl

1:11:50

directly I have not had any

1:11:53

okay yep and I will absolutely give you

1:11:56

a set here um so a lot of these Lots so

1:12:00

like what we're proposing right now U so

1:12:03

you said 1422 so that that's right at

1:12:06

the corner before the green lot that

1:12:08

sets on Ral correct okay so that lot's

1:12:11

not in the proposal right now just

1:12:12

saying that that's

1:12:14

a yep um so the uh most of these town

1:12:19

homes so there're say I believe we're

1:12:22

consolidating one two 3 four five so in

1:12:25

an area we looking to build seven town

1:12:28

homes or six town homes there was seven

1:12:30

lot previous uh part the planning Bureau

1:12:34

recommendation we're holding them as

1:12:36

close to the road as possible now these

1:12:38

houses are all going to have little

1:12:41

yards in the back um the apartment

1:12:44

buildings will have on one of them will

1:12:46

have green space out back so if you're

1:12:49

going

1:12:50

up fer the one on Maring there'll be

1:12:54

probably

1:12:56

give you an idea of 20 foot that opens

1:12:58

up to about 26 feet by 100 plus feet

1:13:03

will still be

1:13:08

green correct yeah yeah this is all in

1:13:12

fill I mean they're

1:13:14

smaller best we

1:13:16

can trying not to take it

1:13:19

every there is you there is no Act

1:13:25

[Music]

1:13:31

next

1:13:56

that also thaty Street was very

1:13:58

dangerous that not people down that

1:14:03

street as someone with a small

1:14:06

child

1:14:15

child so use specifically C Street

1:14:20

because that is way less traffic got

1:14:22

nice shade trees

1:14:38

actually one second I just want

1:15:01

we like to talk you afterwards because

1:15:03

there is a lot right on the corner of

1:15:06

Maran that it's really nothing to be

1:15:09

built

1:15:10

there

1:15:12

and Y and kind of meeting with you and

1:15:15

some residents in the HOA there even too

1:15:17

uh to discuss plan

1:15:22

for that's

1:15:29

okay thanks for your question

1:15:32

um and I was going to recommend you two

1:15:35

getting together but seems like you s

1:15:38

came to

1:15:42

AG okay

1:15:44

Commissioners any

1:15:47

other questions or

1:15:49

concerns if not could I get a motion

1:16:01

conditions is there a

1:16:03

second I'll second it's been moved and

1:16:06

second for approval of this project uh

1:16:10

with the conditions all those in favor
