Summary

The Harrisburg Zoning Hearing Board approved several key variances and special exceptions, resolving retroactive zoning gaps for previously renovated multi-family rentals and authorizing active new adaptive reuse projects. The session highlights how the city balances density requirements and parking constraints to support blight remediation while addressing community concerns over neighborhood congestion and safety.

This meeting reveals the shifting regulatory dynamics between Harrisburg's Codes and Planning Bureaus, showing how local administrative changes directly affect property developers, historic preservation, and neighborhood housing density.

Section summaries

0:00-2:37

Meeting Opening and Personnel Introductions

optional

The Harrisburg Zoning Hearing Board opens its rescheduled April meeting. Board member Mr. Fipps is established as the sole hearing officer for the night due to initial quorum constraints, and the board introduces Stephanie Thompson as the new Deputy Director for Planning.

It contains standard administrative introductions and setups without specific property hearings.

2:37-13:05

Case 2625: 1100 North 17th Street (Place of Worship)

watch

The board reviews a special exception for a place of worship. The application was previously denied due to a lack of legal standing on accessory parking lots. Applicant Abdul Larry confirms they now control the parking parcels, and the board approves the application subject to completed property transfers.

It shows how the board manages off-street parking requirements and equitable ownership.

13:05-23:33

Case 2629: 514 Emerald Street (Multi-Family Conversion)

watch

Geoffrey Knight outlines a retroactive zoning application caused by a past regulatory gap between the Codes and Planning Bureaus. The applicant converted a blighted repository-sale single-family home into a two-unit property. Planning Commission recommends approval based on the deep capital investment required.

Essential explanation of the new Floodplain Zoning Certificate process and retroactive compliance.

23:33-31:24

Case 2629: Developer Presentation and Vote

watch

Robert Shokes Jr. of Harrisburg Rents LLC explains the financial necessity of the multi-family setup to secure local bank refinancing. He discusses the history of local blighted acquisitions and notes the state of the rear garage. The board unanimously approves the application with conditions.

Demonstrates the financial calculations behind blighted rehabilitation in the city.

31:24-47:06

Case 2630: 1923 State Street (Three-Unit Conversion)

optional

The board reviews another retroactive case by Harrisburg Rents LLC, involving a former commercial hair salon converted into a three-unit property. Planning director Knight analyzes the parking alternatives, pointing to street parking and nearby Reservoir Park.

Shares a very similar legal context to the previous Emerald Street case.

47:06-1:00:11

Case 2630: Public Opposition and Board Vote

watch

Resident Kathy Carmen voices strong objections over fire escape safety on the third floor and intense neighborhood parking congestion. Developer Shokes clarifies the floor exits, and the board notes safety is a building code issue, ultimately voting to approve the variance.

Shows how the board handles public safety complaints and clarifies the boundary between zoning and codes enforcement.

1:00:11-1:10:39

Case 2632: 1637 & 1637.5 North 3rd Street (Bakery and Studios)

watch

Planning director Knight introduces a proposal to consolidate two long-vacant parcels into a mixed-use building containing a bakery, artisan studio, and three upper-floor apartments. The main challenge is a total lack of on-site parking, which the planning commission proposes resolving via off-site leases.

Represents a major adaptive reuse project on a critical commercial corridor.

1:10:39-1:39:26

Case 2632: Developer Presentation and Approval

watch

Carla Harrison of CAS Group LLC presents the architectural layout, explaining the duplex configuration on the third floor and plans for Section 8 housing. She agrees to seek a parking lease agreement with a neighboring lot. The board votes to approve the project with conditions.

Key discussion of adaptive reuse economics and Section 8 integration.

1:39:26-1:42:03

Procedural Votes and Meeting Adjournment

skip

The board formally votes on administrative continuances for various March-to-April and April-to-May cases. Planning director Geoffrey Knight formally welcomes the new deputy director, Stephanie Thompson, to the planning department.

Purely administrative wrap-up and procedural scheduling.

Key points

  • Closing administrative loopholes via updated zoning certificates — The Planning Bureau implemented a revised Floodplain Zoning Certificate process to address historical gaps where the Codes Bureau issued building permits for multi-family conversions without verifying zoning compliance. Property owners who previously acted in good faith must now retroactively petition for zoning relief to align with current codes.
  • Using density variances as a tool for financial viability in blight remediation — Developers targeting repository-sale, blighted, and condemned properties face exceptionally high upfront capital costs. Securing a variance for an additional housing unit (e.g., converting to three units instead of two) is often the only way to demonstrate sufficient cash flow to refinance short-term hard money loans with local banks.
  • Mitigating urban parking shortages through creative off-site agreements — In highly congested, historic neighborhoods like Midtown Harrisburg, providing required on-site, off-street parking is physically impossible. Rather than denying high-density developments, the board accepts agreements that secure off-site parking leases in underutilized commercial lots within a reasonable walking distance.
  • Delineating the boundary between zoning and building code enforcement — When residents express public opposition during zoning hearings regarding issues like third-floor fire egress or structural safety, the Board and Planning Bureau clarify that these matters are strictly within the purview of building code inspections rather than land-use hearings.
without the the additional unit, they would it would never have been able to get to the point to where we could could demonstrate that cash flow. Robert Shokes Jr.
often times what happens we'll have people that are that will invest in Harrisburg or this type of market from outside say New York or Baltimore etc. under the lure of it's an easy buy... but then they're going to go out and put a bunch of money... and use that to get as a guarantee for some other funding... and so it might then sit there and do nothing Robert Shokes Jr.

0:01

This is a monthly meeting of the

0:04

Harrisburgian Hearing Board.

0:07

This is originally scheduled in March

0:10

and and basically had be adjusted move

0:13

to the date of April 13th.

0:16

Um

0:18

I normally have a colleague with me and

0:22

when he shows up he'll be

0:25

do the introduction. From the left is

0:27

our solicitor.

0:31

Okay. And representing the city planning

0:35

organization is

0:38

>> and I need to get your name because I'm

0:40

probably get to know you very good, very

0:42

well.

0:44

>> My name is Stephanie Thompson. I'm the

0:45

new deputy director for planning.

0:48

>> And to his right is the city business.

0:58

I'll do

0:59

Okay. Um and also uh this is a uh these

1:04

are hearings. So uh testimony will be

1:07

taken under oath. Um there is a court

1:10

reporter here that is taking everything

1:12

down. Um witnesses will be sworn in

1:15

before they testify. Uh as Mr. Fips

1:19

mentioned, um he is here u by himself.

1:23

Uh and which is uh fine. it uh um he

1:29

will be acting as the hearing officer

1:31

for tonight's hearings. Um ordinarily

1:34

there is two and even just with two it

1:37

is a quorum but even in that situation

1:40

if they would split it would be denied.

1:42

So um but tonight it will be just Mr.

1:45

Fipps. So if anybody though wants to um

1:49

have it decided by two they can request

1:51

a continuance tonight and uh um to the

1:56

April meeting. we wouldn't have time,

1:57

right, to obviously advertise or

1:59

anything, right?

2:00

>> Probably

2:01

>> if I I don't know what the requirements

2:04

are for, you know, such a quick

2:05

turnaround here, but um I don't think

2:08

there'd be any additional preparation on

2:10

our behalf for moving it to the 20th.

2:13

>> Okay.

2:14

>> So, um

2:17

but uh so with that though, we'll start

2:19

with our first application. It's 2625

2:24

uh special exception application for

2:26

1100 North 17th Street. Um and I will

2:31

read in uh the exhibits uh board

2:34

exhibits.

2:36

And then

2:38

before we begin though, I'll have uh Mr.

2:41

Knight uh sworn in. And Mr. Knight, once

2:44

you're sworn in, you'll be sworn in for

2:45

all the hearings tonight. Okay. All

2:47

right. You could swear them in, please.

2:59

I do.

3:06

>> Yeah. Once I read in the uh um exhibit.

3:09

So we have B1 the proof of publication.

3:13

Um this was for obviously the March uh

3:15

hearing. Then B2 is the letter uh sent

3:18

from the planning director to the

3:19

applicant notifying of the uh March

3:22

hearing. B3 is a hearing notice posted

3:25

on the property. B4 is the application

3:27

packet with the attached narrative. B5

3:30

is a neighborhood petition in support of

3:32

the application. B6 or agreements uh for

3:36

the sale of the property uh to

3:39

applicant. The third page of that uh

3:42

exhibit though seems to be the more

3:44

recent one which includes um

3:48

more than one property that uh is to be

3:51

included for the uh parking. Um B7 is

3:55

the deed to the properties at 1100 North

3:59

17th Street, 1616 Hurst Street, 1625

4:04

uh Cumberland Street, identifying the

4:05

seller as the current owner of the

4:07

property. Uh that uh owner also signed

4:11

the application in in addition to the

4:13

applicant that is here today. Uh B8 the

4:17

planning bureau case report. B9 uh city

4:20

of Harrisburg planning commission

4:21

resolution. B10 is the uh uh email of

4:26

continuance submitted by the applicant

4:28

to tonight's meeting since it did not

4:30

occur in March. And B11 is the proof of

4:32

publication for tonight's meeting. It's

4:34

published uh March 29 and April 5.

4:39

Um, why don't we swear in the applicant

4:41

and then we'll turn it over to Mr.

4:42

Knight.

4:51

>> I do.

4:54

>> My first name is Abdul. Abd Du L. Last

4:58

name Larry. L A R R Y.

5:02

>> You're welcome.

5:04

>> Okay. Mr. Larry, what what is your

5:06

position? Is it with uh how do you

5:10

pronounce the

5:11

>> Mohein?

5:12

>> Okay. And

5:13

>> I'm the chairman.

5:14

>> Chairman.

5:15

>> Yeah.

5:15

>> Okay.

5:17

Okay. All right. Mr. Knight.

5:20

>> Okay. Um so the uh application for case

5:23

number 2625. Uh the board may recall

5:26

this from late in 2025. Um basically the

5:30

exact same application was filed at that

5:31

time. Uh the proposal is to convert the

5:34

property at 1100 North 17th Street uh to

5:37

a place of worship use. Um the uh

5:42

accessory parking that's um required for

5:44

that use uh can be provided at uh the

5:48

associated parcels at 1616 her street

5:50

and 1625 Cumberland Street. Uh back in

5:54

uh late 2025, um uh there was uh the

5:57

applicant was lacking legal standing for

5:59

those uh uh latter two properties uh

6:03

1616 Her Street and 1625 Cumberland

6:06

Street. Uh then there was some

6:07

miscommunication regarding the November

6:09

meeting. So uh at that time uh the board

6:11

did deny the application. Um but uh the

6:14

applicant after coordination with the

6:16

applicant uh confirming they still

6:17

wanted to move forward, they resubmitted

6:19

uh and so that is um the application

6:22

that's here before uh the board today.

6:24

Basically the exact same um application

6:26

is from uh late 2025. Uh the project

6:29

itself um involves the uh

6:32

reestablishment of a or the

6:34

establishment of a place of worship use

6:36

at 1100 North 17th Street. Uh it is a

6:39

commercial building. Um, it has a

6:42

history of uh past commercial uses, the

6:45

most recent of which uh was a child care

6:47

center use. Um, and I believe that was

6:50

operating up until about 2019 or 2020.

6:53

Um, and uh, since that time, the

6:56

property has been vacant. Uh, so it's

6:58

got a long-standing vacancy. Um and uh

7:02

the request for relief is a special

7:04

exception which is required for place of

7:06

worship uses in the RM zoning district

7:08

per section 7- uh 305.7 of the zoning

7:12

code. Um the planning bureau is largely

7:16

supportive of the uh proposal. Um it'd

7:19

be uh good to have the building

7:21

reactivated uh and become um you know a

7:24

useful contributing part of the

7:26

neighborhood. Um and uh as previously

7:28

noted um the applicant does have the

7:32

required off- streetet parking at the

7:34

two adjacent lots at 1616 Hurst Street

7:36

and 1625 CL Street. Based on the

7:39

information in their application, the

7:41

applicants uh would require uh 19

7:44

parking spaces and they do have 20

7:46

parking spaces across those two lots. Uh

7:49

so with all that being said, the

7:51

planning commission has recommended that

7:53

the zoning hearing board approve the

7:55

request with the following conditions. A

7:58

new wall signage as proposed to the

7:59

applicant will be limited to four square

8:01

feet and must otherwise be in

8:02

conformance with the applicable zoning

8:04

regulations or a separate zoning relief

8:06

application will need to be approved by

8:08

the zoning hearing board. Uh the

8:09

planning commission recommends the

8:11

zoning hearing board approved the

8:12

request for the following reasons. The

8:14

property has experienced an extended

8:16

period of vacancy over seven years and

8:18

previously accommodated a different

8:20

non-conforming use, a child care center

8:22

on site. As such, there is support for

8:24

the allowance of non-conforming use so

8:26

that the building can be actively

8:28

occupied. Uh the the project the

8:30

proposed use is a fairly low inensity

8:32

use which should be compatible with the

8:34

surrounding residential neighborhood and

8:36

should not create adverse impacts for

8:38

the residents. And finally, the

8:39

applicant is committed to building and

8:41

site improvements that will improve the

8:42

aesthetics of the properties, ensure

8:44

their compatibility with the surrounding

8:46

neighborhood, and increase their

8:47

conformance with the zoning code.

8:51

>> Okay. Well, we've had uh Mr. Hobs show

8:54

up, so Mr. Larry, if you want him to

8:56

also consider your application instead

8:59

of just

9:01

uh Mr. Fipps, is that okay with you?

9:04

This was it was an application that had

9:07

been presented uh previously to the

9:10

board and Mr. Hobbs was here you know

9:13

for that and

9:15

I think the board also recalls it just

9:18

the only thing that was missing was

9:20

right that the the parking that uh

9:22

wasn't included in the agreement of sale

9:24

that that type of thing. So if if if

9:27

it's fine with you they can both

9:29

consider it um or if you just want Mr.

9:31

Fipp since he was here from the

9:33

beginning. Okay. All right. Um

9:38

Okay. Well, now we'll move to Go ahead.

9:40

You can ask applicant to

9:46

>> only question I had again.

9:47

>> Well, yeah. Ask applicant if you want to

9:50

say anything in in support of the

9:52

application. Now, uh testify in support

9:55

of that before any questions by the

9:57

board members.

10:00

All I have to say is that you know it's

10:02

a marathon for us because it's been more

10:06

than a year where we we're trying to you

10:09

know attend the property but because of

10:11

some glitches

10:13

you know we're not able to meet you know

10:17

the requirement on time as we supposed

10:20

to buy. I think now is the time that we

10:24

hope that we finalize everything today

10:27

and we keep on moving. Thank you.

10:32

So, um I only have one question because

10:35

I heard a year ago and again it was a

10:39

paperwork, but in the recap of this case

10:44

I I see a phrase uh for the two other

10:47

two properties 1616

10:49

and 1625 and we and by those we're using

10:53

those properties to basically meet the

10:56

requirement for parking. There's a set

10:59

about contingent upon the

11:03

do you own those properties? Yes or no?

11:04

It's binary question.

11:06

>> Yes, we do.

11:09

>> Because if you don't know or if it's

11:12

still in contingency.

11:13

>> No. No, we do.

11:17

Thank you.

11:18

>> You're welcome.

11:25

>> Good evening. So I guess just following

11:26

up and then I guess it's safe to say

11:29

that with that requirement then they

11:30

pass

11:32

>> of the the parking concerns that were

11:34

the the issue the last time you

11:36

presented in front of us.

11:38

>> Okay.

11:38

>> Yep.

11:40

>> And well is is there anybody here from

11:42

the public that wishes to speak on this

11:45

application?

11:48

>> Okay. Um what I would though recommend

11:51

as another condition in addition to Mr.

11:54

nights is that um that is the agreement,

11:59

right? That that that's the um that

12:02

one-page agreement that includes the

12:04

properties 1100 North North 7th Street,

12:08

1616 Hurst Street, 1625 Cumberland

12:12

Street, and the agreement also includes

12:13

1621 Cumberland Street. That is uh the

12:18

agreement that's in effect right now.

12:20

Correct.

12:20

>> That's correct.

12:21

>> Okay. Um, and if it's approved by the

12:25

board here tonight, that's when you will

12:28

complete though the negotiations for the

12:31

price and all that. Is that

12:32

>> That's correct.

12:33

>> Okay. And that's that does have we've

12:36

had plenty of developers come in here

12:38

and actually have their agreements

12:40

contingent on whether, you know, it's

12:42

approved. They're equitable owners of

12:45

the property. Okay. So, um, I would

12:47

though have as a condition that um, um,

12:52

applicant uh complete u the sale of the

12:56

properties

12:57

um uh the four properties that I just

13:00

stated and the property is transferred

13:02

to um applicant um as part of the

13:07

approval of this board

13:09

and you don't have to restate it you can

13:11

say that you take what I said as the

13:13

second condition and we take what Mr.

13:15

Knight said his first condition.

13:19

So if somebody wants, you know, make a

13:21

motion subject to the two conditions,

13:24

that'll work.

13:25

>> So I'll make a motion that based off the

13:28

condition set by the planning commission

13:31

of the wall signage and second by our

13:34

solicitor requiring

13:38

contingency

13:40

sale being completed. Um I make a motion

13:44

that for

13:47

the request.

13:49

>> So moved.

13:51

>> Okay. Motion made and seconded. All in

13:53

favor?

13:54

>> I.

13:55

>> Okay. Approve. And you will get uh a

13:58

decision within 45 days just you know

14:01

describing the decision and the

14:02

conditions. Okay.

14:03

>> All right. Thank you.

14:04

>> All right.

14:12

Okay.

14:15

And next we have application 2629

14:21

which is 514 Emerald Street

14:27

Variance and special exception

14:29

application.

14:31

Uh the applicant is Harrisburg Rents LLC

14:36

uh by Robert Sches Jr. Right. Okay.

14:41

Uh I will read in uh the exhibits and

14:45

then we'll follow the same procedure.

14:47

Turn it over to Mr. Knight.

14:50

So we have B1 is the proof of

14:52

publication for the March meeting. B2

14:55

the letter sent from uh the planning

14:58

director to applicant notifying of the

15:00

March hearing. B3 the hearing notice

15:02

posted on the property. B4, notification

15:05

letter sent to sent to the neighbors and

15:07

certificate of mailing. B5, the

15:10

application packet uh with photos of the

15:12

exterior of the property and nearby

15:14

properties and the floor plans. B6 is

15:17

the deed and the uh realy transfer

15:20

statement establishing applicant

15:22

standing to pursue the uh requested

15:24

zoning relief. B7, the durable power of

15:27

attorney from the owner of the property,

15:29

naming applicant as POA to handle all

15:31

affairs with the property. B8, planning

15:34

bureau case report. B9, city of

15:36

Harrisburg planning commission

15:38

resolution. Uh B10, the uh request for

15:42

the continuence from the March meeting

15:44

to tonight's meeting. And B1 is the

15:47

proof of publication for tonight's

15:48

meeting published on March 29 and April

15:52

5

15:54

um in the Patriot News. So with that we

15:56

have B1 through B1

15:59

and then Mr. Knight

16:02

you can provide a background. Go ahead.

16:04

>> Yep. Sure. Uh so the case for 2629

16:07

um is uh an after the fact application

16:11

as will be the following case and then

16:13

five on next uh week's uh agenda. Um and

16:18

this is due to the uh it essentially uh

16:21

traces back to the um revision and

16:25

adoption of a new flood plane zoning

16:27

certificate application uh which is a

16:29

document the city has had for a very

16:31

long time. Um but in the past had uh

16:34

been reviewed solely by the codes

16:37

bureau. Uh and this is a document that

16:39

is submitted upon the transfer of

16:41

properties. And so it basically informs

16:43

a new property owner of um you know what

16:46

an allowable use is or uh or a new

16:48

property owner conveys to the city what

16:50

they're going to be doing. Um and as

16:53

noted in the past, it was largely

16:54

handled by the codes bureau. Um however

16:57

there is information uh managed by and

17:00

under the purview of the planning bureau

17:02

uh that is often pertinent to a

17:04

purchaser um zoning which is kind of why

17:07

we're here but also historic district

17:08

and flood plane regulations as well. Um

17:11

and so uh we adopted um a new document

17:14

and a new process in April of last year

17:17

and uh as part of that um when this

17:20

property and the others uh that uh are

17:24

are being brought uh before the board

17:26

for similar reasons um were submitted

17:29

through that process. Uh I went back and

17:32

looked through the city's records and

17:34

noted that this had been converted at

17:36

some time in the past after the adoption

17:38

of the current zoning code. So this is

17:39

not something where I'd go back before

17:41

the current zoning code um to do. And so

17:44

uh in coordination with the applicant um

17:46

and to ensure that uh you know the

17:48

integrity of the um zoning relief

17:51

process and to ensure that we're um

17:54

applying our regulations fairly and

17:56

consistently across the board uh under

17:58

the current zoning regulations. Uh we

18:00

did ask the applicant to bring these

18:02

cases uh before uh the planning

18:04

commission, the zoning hearing board for

18:06

review. Um, I do want to make it clear

18:08

that in all of these cases, uh, the

18:10

applicants did coordinate, uh,

18:13

previously, whether it was as far back

18:14

as 2014 or 2016, um, with the codes

18:20

bureau. Uh, they submitted building

18:21

permit applications, they did get for

18:24

the most part ongoing, um, rental

18:26

inspections on an annual basis. So, the

18:28

applicants did work in good faith. they

18:32

just had um through a kind of a gap in

18:35

the uh permitting review process between

18:37

the codes bureau and the planning bureau

18:39

uh converted these without the necessary

18:40

zoning relief oversight. So I do want to

18:43

provide that background because I think

18:44

it is relevant to uh how we got here and

18:47

why all seven of these cases are being

18:50

brought uh by this applicant um at this

18:52

month's zoning hearing board meetings.

18:54

Um, so and we do we did want to make

18:56

sure we're uh reviewing this as we would

18:59

if this were brought to us back then um

19:02

under this. So this is not trying to

19:03

like look back and kind of um you know

19:07

find a workaround. It's are the

19:09

conditions um uh justifiable. With that

19:12

being said, um the applicant has

19:14

converted the uh single family dwelling

19:15

into a two-unit multif family dwelling

19:18

which requires zoning hearing board

19:19

approval of special exceptions for the

19:20

proposed use and relief from off-

19:22

streetet parking requirements per

19:24

section 7-305.7

19:26

and 7-327.6

19:28

of the zoning code respectively and

19:30

variances for relief from the density

19:32

regulations and specific criteria in

19:34

sections 7-307.3

19:36

and 7-309.2V

19:38

of the zoning code respectively. Um and

19:42

uh for this uh application, as for um

19:45

most of the others, uh the applicant

19:48

purchased these properties uh off of a

19:50

repository sale. Um and so they were

19:53

generally vacant, uh had issues that

19:56

also uh resulted in fairly long uh

19:58

histories of condemnations, uh maybe

20:01

structural issues. Um and so uh this

20:05

long vacancy and this history of um

20:08

violations that did necessitate uh more

20:12

uh investment in the properties than

20:13

would have been required if say they

20:15

were just buying a property that

20:16

somebody had been living in and flipping

20:18

it uh do in our in the planning bureau's

20:20

opinion provide justification uh for the

20:23

requested addition of one uh unit beyond

20:26

what would be permitted by right at this

20:28

property. um you know oftent times um

20:32

when you're buying off a repository

20:34

that's kind of can tend to be a

20:35

lastditch effort to uh preserve a

20:38

building and to make sure it it stays up

20:40

and standing and and a contributing part

20:42

of the streetscape. Um and so uh this is

20:44

not a situation where again a property

20:47

was purchased from a homeowner and then

20:49

somebody's looking to flip it into

20:50

multiple units um purely for financial

20:53

reasons. There is definitely a

20:55

justification uh based on the amount of

20:57

investment that was necessary to uh

20:59

retain this building. Um and with that

21:01

being said, the planning commission uh

21:05

recommended the zoning hearing board

21:06

approved the request with the following

21:08

conditions. Uh if granted approval to

21:10

move forward with the project as

21:11

proposed, the applicant shall allow the

21:12

codes bureau to perform a comprehensive

21:14

inspection to identify any outstanding

21:16

code violations and will receive

21:17

approval for all necessary city permits

21:19

prior to receiving a certificate of

21:21

occupancy. Uh this should include the

21:23

detached garage at the rear of the

21:24

property if the applicant intends on

21:26

using that to provide the required off-

21:28

streetet parking which should be done as

21:29

eventual redevelopment of the adjacent

21:31

vacant lots may make on street parking

21:34

more difficult. Uh so a couple of things

21:36

to to clarify there. Um, we do feel that

21:40

the uh history of rental inspections

21:42

conducted by the codes bureau uh do uh

21:45

meet the uh spirit of the first part of

21:49

that condition that uh to make sure the

21:51

building's habitable, that the work has

21:52

been done um appropriately. Uh and then

21:55

with respect to the detached garage at

21:56

the rear of the property, um during my

21:58

site visit, it was um unclear whether

22:00

that was still being used um due to the

22:04

fact there's vacant lots on the street.

22:05

the residents may have just been parking

22:07

on the street or something. Um, but the

22:09

applicants did provide um photographic

22:12

evidence that the uh garage can

22:15

accommodate two vehicles. Um, so the

22:17

applicants can actually uh provide the

22:20

two required off- street parking uh

22:21

units on site on this property. So, we

22:24

consider uh that the uh off- streetet

22:27

parking requirements are met for this

22:28

property. Uh, the Harrisburg Planning

22:30

Commission recommends the zoning hearing

22:32

board approve the request for the

22:33

following reasons. The property had a

22:35

history of unpermitted and uninspected

22:37

work and condemnation condemnations for

22:39

various building code deficiencies over

22:41

the 20 years prior to the applicant's

22:43

ownership requiring more investment than

22:45

would be viable for rehabilitation as a

22:46

single family dwelling. As such, there

22:48

is justification for the allowance of an

22:50

additional unit than would be permitted

22:52

by Wright. Uh the project reconstructed

22:54

a blighting influence and attractive

22:55

nuisance into units that will contribute

22:57

to the housing inventory in the city and

22:59

the neighborhood and rehabilitated an

23:01

historically and architecturally

23:03

significant building. And finally,

23:05

existing conditions of the property and

23:06

its context within the neighborhood,

23:08

specifically the provision of off-

23:10

streetet parking at the rear of the lot

23:11

and the row of vacant parcels directly

23:12

to the west mean the proposed increase

23:14

in residential residential density

23:16

should have a limited impact on the

23:18

surrounding community.

23:20

>> Okay.

23:22

If you can swear in the applicant,

23:24

please.

23:33

>> I do.

23:36

>> Robert Shooks Jr.

23:40

Robert R O B E R T S H O K E S Jr.

23:46

Thank you.

23:47

>> Okay. And Mr. shows. Uh, what's your

23:50

position with Harrisburg Rents?

23:52

>> I am the sole member of Harrisburg Rents

23:54

LLC.

23:55

>> Okay.

23:59

>> Okay, Mr. Schultz, uh, your opportunity

24:02

then to present

24:05

anything in favor of your application

24:07

before any questions are asked.

24:09

>> I believe that Mr. Knight presented the

24:11

case uh, pretty thoroughly. I I will

24:14

simply say or to add on to that that

24:16

during the

24:18

probably the the years 2008

24:22

through 2018

24:24

we a similar process here with the the

24:27

co department on 90 different buildings

24:30

that's 90 for a total of 120 units. Now

24:34

we've since begun the process of

24:35

divesting from that as a result of co

24:37

difficulties and that kind of thing.

24:39

However, uh, of those 90, um, Mr. Knight

24:43

reviewed them and found seven that

24:45

didn't meet qualifications that were

24:48

required. And so, we felt like that was

24:49

a reasonable number that we would go

24:51

ahead and tried to maintain the

24:52

integrity of this process. And so,

24:54

that's that's why we're here. I believe

24:56

he he explained it adequately as to how

24:58

we got here. It's just a bureaucratic

25:01

snafu as it were.

25:03

>> Okay. Go ahead.

25:08

Good evening, Mr. Schultz. Um, so you

25:11

know, we usually, this is the usual

25:12

circumstance, this type of uh

25:14

application. Um, I just did have one

25:16

question or if you could explain or give

25:19

some insight to what was mentioned about

25:22

um the need for the additional unit, the

25:25

one additional unit over what would

25:27

usually be allowed based on um the

25:30

guidelines. um you know from a financial

25:32

perspective if you could just share

25:34

insights on what you were facing or what

25:37

was part of that analysis or valuation

25:39

that you did specifically for this

25:40

particular property.

25:42

>> Absolutely. Uh the process here is

25:44

typically um when we purchase a a

25:48

property we're not coming out of pocket

25:50

cash to to buy these. I'm actually

25:53

borrowing money from someone else who is

25:55

a hard money lenders. And this is money

25:57

that exists outside of the state where

25:59

at least for our each of our cases it

26:02

was um then we are also borrowing the

26:05

money to renovate this property and we

26:07

have to be able to demonstrate to these

26:09

folks that that when we renovate it they

26:11

will then cash flow to the point that I

26:13

can I can then refinance it with

26:16

long-term permanent financing which is

26:18

local here. In this particular case I

26:20

think it's now Jonestown Bank and Trust.

26:22

Um, and so that has to without without

26:25

the the additional unit, they would it

26:28

would never have we would never have

26:30

been able to get to the point to where

26:31

we could could demonstrate that cash

26:35

flow. And so we would find it quite

26:38

difficult to be able to do that. And at

26:40

90 properties, you might imagine that's

26:42

there's a lot of money that's involved

26:43

in there. It's not my money, it's

26:45

somebody else's money. I just happen to

26:47

be good at managing their money. So

26:49

that's why we were able to do that many.

26:52

Got you. Thank you for that information.

26:54

Um, just a couple other things. So, I'm

26:57

assuming that uh this is just going to

27:00

be traditional uh I guess long-term

27:02

leases for these units.

27:03

>> Yes. Yes, it's it's been functioning now

27:05

for uh eight years. I believe it is

27:07

asis. Uh they are typical one-year

27:11

leases with with uh

27:16

we will turn them over. The the leases

27:19

typically convert to a month-to-month

27:20

lease after the period of one year,

27:22

unless of course we resign, and we

27:24

always do because everybody wants to

27:26

know that they they what their budget is

27:28

like for the following year whenever

27:30

they can, and it doesn't make any

27:31

difference to us.

27:34

>> Thank you.

27:34

>> Thank you.

27:39

>> I want to follow up with you your

27:42

compliment lease.

27:44

>> So, it's initially a one-year lease.

27:46

Yes.

27:47

>> And is there language in at least that

27:50

convert automatically to uh to monthto

27:52

month at the end?

27:54

>> Correct.

27:54

>> It's inside the lease.

27:55

>> Correct.

27:57

>> Second question. Um

28:03

since these are going to be apartments,

28:04

what what's your price point on which

28:08

>> I don't know that I have those numbers

28:10

right in front of me. However, I'm going

28:11

to say that they're in the range.

28:13

They're one is a twobedroom, one bath.

28:15

The other one is a threebedroom, one

28:16

bath and and I believe that they are

28:18

$1,100 and $1,200 a month currently.

28:21

They weren't at that at that time, but

28:23

currently in in that range.

28:25

>> So fair market value. Yes.

28:29

>> Um,

28:33

forgive me. I actually went past your

28:35

places. I was up there this weekend. No

28:37

problem.

28:37

>> Tennessee doing it. Um, anything comes

28:39

from me, I I won't look at it.

28:42

>> When was those buildings last occupied?

28:45

>> They're currently occupied. Well, the

28:46

the one that we have is currently

28:48

occupied. Both.

28:50

>> We do we don't own both sides,

28:51

unfortunately. The one on the right is

28:53

in particularly bad shape. It uh it was

28:56

condemned for quite a while. Uh tried to

28:58

acquire it a few times from the past

29:00

owner. He didn't want to let it go. I'm

29:02

not sure why. I assumed that maybe he

29:03

had had some money that was placed

29:05

against this and this has been kind of a

29:08

problem uh for Harrisburg at large. I'll

29:10

go ahead and expand on that if you don't

29:11

mind. Um so that you know um often times

29:15

what happens we'll have people that are

29:17

that will invest in Harrisburg or this

29:20

type of market from outside say New York

29:22

or Baltimore etc. Uh under the lure of

29:27

it's it's an easy buy. it's only $1,000

29:29

off of the the tax sale or something

29:31

along those lines. Uh but then they're

29:34

going to go out and put a bunch of money

29:36

off off of that and use that to get as a

29:39

guarantee for some other funding from

29:41

somebody else. And so it might then sit

29:44

there and do nothing because it has no

29:45

more it's already served its purpose and

29:47

its value to them. Uh, and so it it

29:51

might it might be there for a while

29:52

until such time as the city comes back

29:55

and says or the county does and says pay

29:58

your taxes or or fix the place or lose

30:00

it.

30:03

>> Next question is you have a garage in

30:07

the back.

30:07

>> Yes.

30:08

>> That you would that use that to satisfy

30:11

any type of parking requirements

30:14

>> or is it conditional?

30:18

uh that the garage does does satisfy

30:20

parking requirements in its current

30:21

condition. That said, its current

30:24

condition as I went out there this about

30:26

two weeks ago was less than satisfactory

30:28

to me just physically. It's it's it's

30:31

not attractive. There are there there

30:34

are two windows that are missing and the

30:35

person door has been removed. uh for a

30:38

while there when we had some tenants

30:40

there that didn't have cars, it got used

30:43

for a dumping ground for anybody else

30:45

who, you know, in the neighborhood

30:46

needed something they had to get rid of.

30:48

And so we found that to be a problem.

30:50

It's vandalism has been a problem there.

30:52

>> And with those two houses there, there's

30:55

a previous size lot there, four houses

30:58

that burnt down about 14 14 15 years

31:02

ago.

31:04

That's not going to you you would not

31:06

use those slots because it was said in

31:08

one of the pres

31:10

here that you could use that to satisfy

31:13

any type of

31:14

>> uh I I wouldn't I wouldn't presume to be

31:18

parking on someone else's property. I

31:19

wouldn't allow that.

31:25

>> That's all we have. Thank you.

31:26

>> Yes, sir.

31:28

>> Okay. Uh anybody here from the public uh

31:30

with regard to this application? Um you

31:34

can go up to the uh microphone and offer

31:37

any comments.

31:40

Okay. Anything from the city, Miss

31:43

Cameron?

31:44

Okay. You guys want to take a break or

31:49

or

31:53

Okay.

32:04

Yeah,

32:05

>> there were conditions.

32:07

>> Yeah, he went through the the

32:08

conditions. So, you can just say

32:09

whatever the planning commission right

32:11

there conditions. Yep.

32:15

>> Right. I make a motion uh to approve

32:19

application 2629 with conditions set

32:22

forth by the planning commission.

32:26

Okay.

32:27

>> I second.

32:28

>> Okay. Motion made and seconded. Uh, all

32:31

in favor?

32:32

>> I.

32:33

>> Okay. So, it's approved.

32:35

>> So, Mr. Shes, I know you're here for the

32:37

next one, but that one is approved and

32:39

within 45 days, we'll get the decision

32:41

to you. Um, and then we'll move on. Uh,

32:46

also, Mr. Shokes, you were sworn in for

32:48

2629. And is it okay that we use that

32:51

that you're still sworn in for

32:52

application 2630? Yes sir.

32:55

>> Okay.

32:57

>> 2630 is 1923 State Street. Um it is uh

33:04

for variance in special exception.

33:08

Um

33:09

I would take it probably similar to this

33:12

past application that we had. Um I will

33:15

read in the exhibits and then we will uh

33:17

turn it over to Mr. Knight. So we have

33:20

B1 proof of publication for the March

33:23

meeting. B2 letter sent from uh the

33:26

planning director uh to the applicant

33:28

notifying of uh the March meeting. B3

33:32

hearing notice posted on the property.

33:34

B4 notification letter sent to the

33:36

neighbors uh and certificate of mailing.

33:39

B5

33:40

application packet with photos of the

33:42

exterior of the property and nearby

33:44

property properties and the floor plans.

33:47

B6 is the deed and realy transfer

33:49

statement establishing applicants

33:51

standing to pursue the requested zoning

33:54

relief. B7 planning bureau case report.

33:56

B8 city of Harrisburg planning

33:59

commission resolution. B9 request for

34:01

continuence to tonight's meeting. And

34:04

B10 the proof of publication for

34:06

tonight's meeting uh published March 29

34:10

and April 5 uh in the Patriot news. So

34:14

we have B1 through B10 and then with

34:17

that Mr. Knight.

34:19

>> Yep. Uh so yeah the um uh background of

34:23

2630 here uh again the same kind of

34:26

caveats apply uh in this case uh

34:28

regarding the applicant's purchase uh

34:30

when the work happened and uh the um

34:35

length of tenency of the existing

34:38

residents or the existing units on site

34:40

and uh the record of uh building permits

34:44

having been filed and rental inspections

34:46

uh having been uh uh achieved at a uh

34:50

consistent basis uh since that time. Um

34:53

in this case, the uh property itself has

34:55

um some different characteristics than

34:57

the last property. Uh the city's records

35:00

are a little bit unclear uh but it

35:02

appears that there was either one or two

35:05

units operating uh uh residential units

35:09

uh on site uh at one point in the past

35:11

and the first floor uh was a commercial

35:14

space uh Hidilia's uh place I believe.

35:17

uh not quite sure what the nature of

35:19

that business was, but if you look far

35:20

enough back in Google Streets view, you

35:22

can see uh the sign painted in the

35:24

storefront window on the first floor um

35:26

there. So, uh the property um is was not

35:30

a single family dwelling and therefore

35:32

did not require variance from that

35:34

aspect of the specific criteria in the

35:36

zoning code. Um however it does still

35:39

require the um because uh the uh

35:43

business use was v abandoned and not uh

35:46

restarted and again due to the ambiguity

35:49

regarding the exact number of units on

35:51

site uh we did treat this as though the

35:53

property had reverted back to the um

35:55

allowances of the underlying zoning

35:57

district and therefore uh the property

36:00

required uh two special exceptions. one

36:02

for the establishment of a multif family

36:05

dwelling and one for relief from the

36:06

off- street parking requirements per

36:08

section 7-305.7

36:10

and 7-327.6

36:13

the zoning code respectively and a

36:15

variance for relief from the density

36:16

regulations in section 7-307.3

36:20

of the zoning code. Um so again this uh

36:23

property was you know functioning not as

36:26

a single family dwelling of uh maybe a

36:28

mixeduse maybe multif family dwelling uh

36:30

at some point in the past but uh again

36:32

the applicants uh took over the property

36:36

um made investments uh into the building

36:38

and converted that uh former commercial

36:42

space into a residential uh unit. um and

36:47

has been renting it uh seemingly fairly

36:49

consistently uh since the initial

36:51

purchase and conversion uh and the work

36:54

that was done on site. Um the one area

36:57

where I think this uh deviates uh more

37:00

so than the uh previous application is

37:03

that the uh three units require four

37:06

off- streetet parking spaces and not uh

37:09

just two uh as in the last case with two

37:11

units. Um and so in evaluating the

37:15

context of the property within the

37:17

neighborhood against uh that regulation

37:18

of the zoning code, we do not know the

37:20

property is a corner lot uh and

37:22

therefore has uh frontage along uh both

37:25

State Street and Lind Street to the

37:28

side. Um I believe there's uh we confirm

37:31

that there is space for at least two

37:34

spaces uh maybe three along the uh Lind

37:37

Street side of the property. Um and then

37:39

we also note that the property is a uh

37:42

block north of um Reservoir Park. Uh and

37:46

if you've been to that area, of

37:46

Reservoir Park, um there are properties

37:49

just on one side, then there's the park

37:50

on the other side. And while the parking

37:53

situation is kind of a bit fluid up

37:54

there in that area, um people do park

37:56

along the Park Street side of the

37:58

street. Uh and there is definitely

38:00

sufficient uh parking along that uh

38:03

frontage of Park Street. So there is

38:04

nearby parking uh if indeed there uh is

38:08

a requirement um based on the demands of

38:10

the tenants of the building and uh any

38:12

of their guests. Um and so while that is

38:15

a more intensive relief uh request than

38:18

the last uh case, we do believe uh that

38:21

uh there is sufficient uh parking on

38:23

site or sufficient public parking in the

38:26

surrounding uh blocks uh to meet the

38:29

needs uh of tenants of the to meet the

38:31

needs of the zoning code. Um so and

38:35

again uh the property itself is a bit

38:37

different than the last one. Not a

38:39

single family conversion. It's just a uh

38:41

conversion of we'll just say a not

38:44

single family dwelling uh into uh the

38:47

three units. So uh the specific criteria

38:50

does not uh apply to this property. Uh

38:53

with that being said, the planning

38:55

commission recommends the zoning hearing

38:56

board approve uh the request with the

38:58

following condition. if granted zoning

39:01

approval to move forward with the

39:02

project as proposed, the applicant shall

39:04

allow the codes bureau to perform a

39:05

comprehensive inspection to identify any

39:07

outstanding code violations. Uh I do

39:09

note that when we did a site visit on

39:11

February 23rd, there was an eviction

39:13

notice posted to the front door. Um and

39:16

I'm I was unsure of what that eviction

39:18

was based on. Um and we'll receive

39:20

approval for all necessary city permits

39:23

prior to receiving a certificate of

39:24

occupancy. Um and as with the last case,

39:27

um we do consider uh the uh regular

39:30

rental inspections to be meeting the

39:32

spirit of that condition. Um the

39:35

planning commission recommends the

39:36

zoning hearing board approved the

39:37

request for the following reasons. While

39:39

the circumstances surrounding the

39:40

conversion indicate a significant

39:42

disconnect between the existing

39:43

conditions and presumed reuse

39:45

allowances, it appears that property the

39:47

property may have been functioning as a

39:49

two-unit multif family dwelling with a

39:51

former owner occupying one of the units

39:53

and that's proposal for expansion to

39:54

three units may have only required three

39:56

special exceptions as opposed to a

39:58

variance and two special exceptions. In

40:01

contrast to other such conversions, the

40:03

structure itself is large enough for a

40:04

buyight conversion to three units, thus

40:07

reducing the amount and intensity of

40:08

zoning relief and providing some

40:10

justification for the current request.

40:12

And finally, as a corner lot, the

40:14

property has enough frontage along both

40:15

State and Lind Streets to reasonably

40:17

accommodate the four off- streetet

40:19

parking spaces required for the use.

40:21

There is also significant on street

40:22

parking located along Reservoir Park, a

40:24

block to the south.

40:27

>> Before we go to applicant, I know Mr.

40:30

you mentioned with the

40:32

it

40:34

qualifies for a buy right to three units

40:37

>> and that and that in the specific

40:39

criteria right it mentions the size if

40:41

it was a dwelling single family dwelling

40:44

>> correct

40:45

>> it would meet that anyway yes 2500 it's

40:48

bigger than 2500 the structure

40:51

>> uh yes correct

40:53

>> all right uh Mr. Shokes,

40:57

your turn.

40:59

>> When we first acquired the property,

41:01

when I first required the property, I

41:03

like saying we, um,

41:07

my recollection is that the the first

41:09

floor was being had been used as a um a

41:13

hair salon. I I seem to recall uh

41:17

removing some hair salon sinks that that

41:20

kind of thing. uh which had a

41:21

passageway. It had uh a front front half

41:25

of it was being used for hair salon and

41:28

then the back half had a passageway that

41:30

was primarily to to another room in the

41:32

rear, another large large area in the

41:34

rear that was being used primarily for

41:36

storage and that kind of thing. It

41:38

lended itself easily for partition wall

41:41

between the front and rear uh fire

41:45

blocking, that type of thing. uh in

41:47

order to convert the front half into a a

41:49

one-bedroom, one bath apartment and the

41:52

rear into a one-bedroom, one bath

41:53

apartment. Now, the second and third

41:55

floor configuration remained unchanged

41:58

from from our standpoint. It remains

42:00

exactly the same the way we found it

42:02

with the exception of replacing all

42:04

plumbing fixtures, plumbing drainage

42:06

lines, electrical, and and that kind of

42:08

thing, and adding uh gas furnaces uh

42:12

into each unit. So with with the

42:14

exception that it it was obvious to us

42:16

that someone was operating a business

42:17

there and they were living on the second

42:18

and third floor. Uh and so we converted

42:21

the first floor to two two units instead

42:23

of just the one. Um I don't know that

42:25

that there's anything else that I can

42:28

can add to it other than um the eviction

42:31

notice you uh you mentioned was uh

42:33

simply a standard eviction notice for

42:35

non-payment and has since been leased up

42:37

again.

42:41

>> Okay. board members.

42:48

>> So,

42:49

I should have asked this the last time

42:51

since you you're the owner of both.

42:56

>> You're you want to convert this to four

42:59

units instead of three. If if you leave

43:02

it at three,

43:03

>> it's been converted to three.

43:05

>> It's an effect case like the last one

43:08

where it's already been in this

43:10

configuration for for about 10 years.

43:13

>> Okay. So, you don't have there's no

43:16

special exception for density.

43:18

>> Uh there there's a varian

43:25

and I would note that again the there's

43:27

a bit of an ambiguity about the number

43:28

of residential units that were on site

43:30

in the past and were there two units in

43:32

the past and they're placing three. uh

43:35

that might be considered a special

43:37

exception because it would be an

43:39

expansion or an increase of an existing

43:40

non-conforming aspect of the uh

43:43

property. So if there were two units, it

43:45

would be a special exception instead of

43:46

a variance for that aspect.

43:48

>> And the parking requirement, you would

43:50

use Lynch Street to satisfy that instead

43:53

street

43:55

parking is a premium. I have found I

43:58

have found that our tenants typically

44:00

will park on State Street if there's a

44:02

space available. Uh if someone's not

44:04

already there because that's the premium

44:05

get in and get out and go uh kind of

44:07

kind of spot and everyone else is right

44:09

down there down Lind Street and if it

44:11

happens to be street parking then

44:13

everyone's out either on street uh state

44:15

street or as uh Mr. Knight stated uh

44:18

down by the reservoir park.

44:21

My last myical financial question I say

44:24

why convert but um you know price over

44:28

anything else you for what you put into

44:31

it this is how you're going to recoup

44:32

your recouping your investment bank

44:34

making this a multi-unit

44:36

>> Yes sir our our intent was to acquire

44:42

basically the worst of the worst

44:43

buildings that we could find uh and

44:46

bring them back to life and then operate

44:49

that as rental properties for an

44:53

extended period of time. And so we

44:57

we approached almost every building that

45:00

way. Now we didn't we didn't get

45:02

approval from the codes department to

45:04

conver on the vast majority to convert

45:06

to uh multi-unit. In this particular

45:09

case, we did and so that's what we did.

45:13

>> Your rent your rent structure is going

45:14

to be the same fair market value.

45:16

>> Yes, sir. Absolutely.

45:21

That's all I have. Thank you.

45:25

>> I think you pretty much covered my

45:27

questions. Um, but I just want to ask so

45:29

like with the last one is just

45:30

traditional or sorry, long-term leases

45:34

um for this property.

45:35

>> Yes, sir. The same. They're all uh

45:37

Pennsylvania Association of Realtors

45:39

leases.

45:40

>> Got produced by them, not by me.

45:44

>> That's all I have. I've got one more

45:46

question

45:48

for the um

45:51

their oneyear leases with the automatic

45:53

conversion. Have you looked at not

45:54

putting conversion clause in because

45:57

again one year and if they don't they're

46:00

still there it'll be extended another

46:02

year not one month.

46:08

It's the way the Pennsylvania

46:09

Association of Realtors

46:12

presented it and we have it. We've made

46:13

no changes to it or at least minimal as

46:16

as we can. Uh I don't I don't know why

46:18

that that was a thing at some point in

46:22

time in the past. Um I have found as a

46:25

practicality

46:27

that it doesn't matter whether it's a

46:29

one-year lease or it's monthtomonth or

46:31

it's 15 months into into it. If someone

46:33

doesn't want to be there, I don't really

46:35

want to try to force them to be there.

46:38

They're not going to treat the property

46:39

properly. That it's nothing is going to

46:42

be to work out well for anyone involved

46:44

in that situation. So, any tenant that's

46:47

ever come to me and said, "I need to

46:48

go." I said, "Leave it the way you found

46:50

it. We're all good."

46:54

>> Exactly.

46:57

>> Thank you.

46:58

And how long have

47:01

uh how long has it operated as a

47:03

three-unit property? Like when did you

47:05

do the conversion? How how long ago was

47:07

that?

47:08

>> My recollection is 2015 to 2016. I

47:11

believe it started uh leasing in 2016.

47:15

So it's it's approximately 10 years,

47:16

nine years.

47:18

>> And when you purchased it, was it a

47:20

vacant property?

47:21

>> Yes, sir.

47:22

>> And had violations like that? Okay.

47:25

>> All right. Anything more for applicant?

47:30

Okay. Anybody from the public?

47:33

Feel free to come on up and introduce

47:36

yourself in and just state your name.

47:41

>> Big one.

47:42

>> The big one. Make sure that it is on.

47:47

>> I can talk loud enough.

47:49

My name is

47:50

>> Okay. Just state your name and then

47:51

we'll swear you in.

47:53

>> Okay. My name is Kathy Carmen.

47:56

Okay. And what's your address?

47:58

>> 1931 State Street and I own 401 403 Lind

48:03

Street.

48:05

>> Okay. Where you in?

48:15

>> Yes.

48:17

>> Okay. Keith, go ahead.

48:19

>> Okay. First, I wanted to know this place

48:21

has not been vacant for any time that

48:23

I've been living on State Street for

48:25

50ome years.

48:28

>> Okay.

48:28

>> And I think maybe before you purchased

48:31

it, the man snuck in four apartments

48:34

until he got caught.

48:37

So now I see you want to put in three

48:39

apartments or two?

48:44

>> What? What is it? Three?

48:47

>> No, I'm asking. Oh, the apartment the

48:49

apartment it's it's a three-unit

48:50

building has been since we renovated it.

48:53

>> I purchased it vacant.

48:58

>> Cuz the man that previously owned it

49:00

lived at 1925 State Street.

49:05

>> So he was one of the owners. So that's

49:07

how I know

49:10

I don't agree with putting in three

49:13

three floors of apartments. I worry

49:15

about fires.

49:18

people getting out of the third floor.

49:20

What do you do? Jump out a window

49:25

because I've seen these places get

49:27

converted and there's no fire escapes

49:30

until something happens to somebody.

49:36

>> That would be something that would be

49:38

part of the coach requirement if it's a

49:41

multi-unit

49:44

multiflo apartment. I don't

49:46

>> Well, I I don't want to speak for the

49:47

codes bureau. I'm not um entirely

49:50

familiar, but I do believe outside of a

49:53

um exterior fire escape, you can have

49:55

two uh stairways interior, and I'm not

49:57

sure if the property has that off the

49:58

top of my head, but you can also

50:00

sprinkler a property. That's a way uh to

50:02

provide the required uh fire safety and

50:05

meet fire code.

50:06

>> I I can address that directly. Uh two of

50:09

the units are on the first floor.

50:12

The front unit has two entrances and or

50:14

two entrance exit. The rear unit has one

50:16

in and one out. The upstairs apartment,

50:20

which is the apartment C, the third

50:22

that's uh there and was there

50:24

pre-existing, has two entrances, exits,

50:28

and it is no different than any other

50:31

three-story building. Whether you want

50:33

to call it a second and third floor

50:34

apartment or

50:37

you want to call it a single family

50:38

residence. If you're on the second

50:40

floor, you're going to go out the rear

50:41

deck and you're going to walk down the

50:42

deck stairs. Unless that's on fire, in

50:45

which case you're going to come down the

50:46

main stairs, which you come out the side

50:48

of the building. And if not, then you're

50:49

going to jump out of the window on the

50:50

second floor. You're certainly not going

50:52

to go climb up to the third floor to

50:53

jump out there any more than you would

50:55

any other residence.

50:57

>> You because the first floor used to be

50:59

just one apartment. There was a

51:02

storefront.

51:04

The gentleman from years ago, it was a

51:06

storefront. He lived in the back of

51:09

that. There was not two apartments

51:12

on the first floor.

51:13

>> Right. Okay.

51:15

>> As previously stated.

51:17

>> Okay.

51:18

>> And

51:20

then when you most renters have more

51:23

than one vehicle.

51:26

>> Most tenants.

51:27

>> Yes. Most tenants have more than one

51:29

vehicle. And State Street is a premium

51:31

to place to park. You know, if you can

51:34

get it, if you get home at a decent

51:37

hour,

51:39

they keep saying there's plenty of

51:40

parking in these spaces, but that's cuz

51:43

people are at work during the day.

51:46

It's at night when I come home and I got

51:48

to park a block away to get my groceries

51:50

in.

51:52

And then we have to deal with, okay,

51:54

Lynn Street,

51:57

there's a bar on that corner.

52:00

Yes, there's a park right there for

52:02

parking, but you've got to walk down

52:04

Lynn Street to get to State.

52:07

I don't want to be walking 10 11:00 at

52:10

night

52:12

from Reservoir Park.

52:16

So, not only do we have Jazz Land, we

52:18

have the other bar up the street.

52:20

There's two auto mechanic places

52:25

on each side, Walnut and State. They

52:28

park their vehicles out there.

52:32

So that's why I don't agree with always

52:35

saying there's plenty of parking because

52:36

there's not.

52:39

>> Okay. All right. Thank you.

52:41

>> Yeah, I think that's it.

52:42

>> Okay. Thank you. Anything from the city?

52:45

>> Okay. Um, anything else, Mr. Knight?

52:50

Response to that or

52:52

>> uh No. Um, you know, I've been out on

52:56

the weekends and there's parking. I

52:58

can't speak to week nights. I guess I

53:00

haven't been up there um at the subject

53:03

property to review that, but um, you

53:06

know, I think there are one at least it

53:09

sounds like the first floor units are

53:10

both one-bedroom. Um, so I think it's

53:13

likely that any tenant would have one

53:15

vehicle and not multiple vehicles. I

53:17

don't know about like the second and

53:18

third floor unit. Um but uh you know we

53:22

would think that they would have at most

53:23

one vehicle for a one-bedroom unit.

53:26

>> Okay, Mr. Shokes, anything else before

53:29

they uh board considers?

53:30

>> No, thank you. I think that's all. Thank

53:32

you. I appreciate your time.

53:34

>> Great. You guys want to take a short

53:35

break?

53:36

>> Yeah,

53:38

>> we will recess for a bit. We will be

53:40

right back.

53:56

She doesn't

59:26

motion with regard to application 2630.

59:34

>> Yes. Uh but before making a motion, I

59:35

just just want to make a a statement um

59:38

just for I guess transparency and um you

59:41

know, it's definitely appreciated for

59:43

any concerns that are bought from the

59:45

public when we uh go through these

59:47

hearings, but I just wanted to address a

59:49

couple of things for understanding. Uh

59:51

number one, um when it comes to

59:54

decisions that we make, there are a

59:56

number of factors that we have to

59:57

consider. And one of them is sometimes

1:00:00

based on consistency, right? So if we

1:00:01

get applications like the one we're

1:00:03

hearing now, which is very similar to

1:00:05

numerous ones that we've uh that have

1:00:08

been heard since I've been part of this

1:00:09

board is that you know unless there I

1:00:12

guess extenduating circumstances, we

1:00:14

usually will follow the same kind of

1:00:16

logic in terms of our decision-m um and

1:00:19

as I mentioned this is a very common

1:00:22

request um you know within this

1:00:24

application for the the special

1:00:25

exception and uh dimensional variance

1:00:27

that's being requested. So, it's not

1:00:29

anything that's out of the norm,

1:00:30

especially in that State Street

1:00:32

corridor, which we've seen numerous uh

1:00:35

properties go through this type of

1:00:37

conversion. And then the second thing I

1:00:38

just wanted to mention in terms of the

1:00:40

concern that came up about safety as

1:00:42

mentioned that is a specifically a uh

1:00:46

codes bureau type of issue where um and

1:00:49

this Mr. and I kind of addressed about

1:00:51

addressed about getting permits and that

1:00:53

thing that things of that nature where

1:00:56

there's safety requirements and other

1:00:58

requirements that will come up as part

1:00:59

of uh codes inspections and just uh

1:01:03

requirements for getting certain types

1:01:04

of permits for work. And there are

1:01:06

processes that if there's ever uh a

1:01:09

thought or a feeling that there is a

1:01:11

safety concern uh where that can be

1:01:13

addressed with the codes bureau if you

1:01:15

know that ever were to come up. So, just

1:01:17

wanted to mention that and then from

1:01:19

that for I want to make a motion to

1:01:21

approve application 2630

1:01:24

um with conditions set forth by the

1:01:25

planning bureau.

1:01:28

>> Okay,

1:01:29

>> I second.

1:01:30

>> Okay, we have a motion and a second. All

1:01:33

in favor?

1:01:34

>> I

1:01:35

>> Okay, so with that we the decision will

1:01:38

be then mailed within 45 days. Okay.

1:01:43

All right. Thank you.

1:01:49

Now we have

1:01:54

application 2632

1:02:00

1923

1:02:05

State Street, right?

1:02:08

>> Oh, that's

1:02:11

did sound odd that I said that.

1:02:16

that I was on. Okay.

1:02:18

>> That was actually 26.

1:02:22

>> 2630. Yeah.

1:02:23

>> 2632. Oh, right. 1637 and 1637 and a

1:02:28

half North 3rd Street.

1:02:30

>> I figured there was something wrong when

1:02:31

the applicant stopped when I mentioned

1:02:33

that like it's not our turn, but yes, it

1:02:35

is your turn. 2632 variance and special

1:02:39

exception application.

1:02:41

Um I will read in the exhibits and then

1:02:46

we'll turn it over um

1:02:50

turn it over to Mr. Knight and then

1:02:52

we'll have uh after Mr. Knight we'll

1:02:54

have the applicants uh sworn in. So

1:02:57

start uh B1 proof of publication. B2 uh

1:03:01

letter sent from the planning director

1:03:02

to the applicant notifying of the March

1:03:04

hearing. B3 hearing notice posted on the

1:03:06

property. Uh B4 notification letters.

1:03:10

B5, application packet with attached

1:03:12

narrative and floor plans. B6, deed

1:03:16

establishing applicant standing to

1:03:17

pursue the requested zoning relief. B7,

1:03:21

planning bureau case report. B8, uh,

1:03:24

city of Harrisburg planning commission

1:03:26

resolution.

1:03:27

Uh, B9 is the proof of publication for

1:03:30

tonight's meeting. Uh, it was published

1:03:33

uh, March 29 and April 5 in the Patriot

1:03:36

News. And B10 is the request uh, for the

1:03:39

continuence from the March application

1:03:42

to tonight's

1:03:44

uh meeting

1:03:45

March uh meeting to to tonight's

1:03:48

meeting. With that, we got B1 through

1:03:50

B10.

1:03:52

And with that, I'll turn it over to Mr.

1:03:54

Knight.

1:03:55

>> Uh yes. So uh the application for case

1:03:58

number 2632 involves a variance and

1:04:01

special exception uh for a proposal to

1:04:03

consolidate the existing properties into

1:04:05

a mixeduse building with three

1:04:07

apartments at top retail bakery and

1:04:10

crafts or artisan studio spaces which

1:04:12

requires zoning hearing board approval

1:04:14

of special exceptions for the proposed

1:04:16

multif family dwelling use and relief

1:04:19

from the off- streetet parking

1:04:20

requirements per section 7-305.7

1:04:23

and 7-327.6 six of the zoning code

1:04:26

respectively and variances for relief

1:04:29

from the specific from the density

1:04:31

regulations

1:04:33

um in section and specific criteria in

1:04:36

sections 7-307.3

1:04:38

and 7-309.2V

1:04:40

of the zoning code respectively. Uh so

1:04:43

the subject properties are a bit unique

1:04:45

in that um you have the main property at

1:04:48

1637 North Thirdrd Street and you have

1:04:50

uh one of those half properties uh which

1:04:52

tend to have been smaller units that uh

1:04:54

were fit in in between regularly

1:04:56

numbered uh properties in the past. Um

1:05:00

the property itself, the primary

1:05:02

property uh did once accommodate a

1:05:04

laundromat I believe on the first floor

1:05:06

of the property and uh at least one uh

1:05:09

residential unit above at uh and that

1:05:10

was at 1637

1:05:13

um uh North Third Street. Uh the

1:05:16

laundromat has been uh out of use for I

1:05:20

think uh eight seven or eight or eight

1:05:22

or nine years or so. Um and then around

1:05:25

uh 2000 or 19 or 2019 uh a a owner of

1:05:30

the property began work uh the codes

1:05:33

bureau identified the work and issued a

1:05:35

stop work order because they did not

1:05:36

have a building permit. So they came in

1:05:38

did the got the building permit uh and

1:05:41

started doing some exterior work and

1:05:43

then uh COVID happened and it kind of uh

1:05:46

all work ceased. Uh, and if you've been

1:05:48

by the property, you know they have like

1:05:50

no windows in the property. So, it the

1:05:52

windows had been taken out. Um, I think

1:05:54

some of the roofing uh was under

1:05:56

construction when everything stopped.

1:05:58

Uh, and so it's been in this condition

1:06:00

for about 6 years now. Um, with just

1:06:03

open to the elements uh and uh in a kind

1:06:07

of unfinished state due to a uh former

1:06:10

owner of the property. Um and so the

1:06:13

applicant is uh basically looking to uh

1:06:16

reestablish that mixeduse um identity,

1:06:18

but also uh again to uh add in the uh

1:06:22

unit at 1637 and a half uh North Third

1:06:26

Street for a total of three units on

1:06:28

site. Uh and those will be on the upper

1:06:31

floors uh of the uh property. Uh and

1:06:34

then on the first floors, they'll have

1:06:35

uh the uh crafts and arts studio and

1:06:38

bakery use. uh and the applicant can

1:06:40

provide a little bit more information

1:06:41

about those uh specific uh commercial

1:06:44

spaces. Um you know with respect uh to

1:06:48

the use uh the uses uh I would say it's

1:06:51

not out of character for the corridor.

1:06:53

Uh the board may remember maybe four

1:06:56

year three or four years ago uh the the

1:06:58

approval of a retail store across the

1:07:00

street at 1644 North Thirdrd Street. Um,

1:07:03

and if you uh been to the site, you'll

1:07:06

notice across the street at the corner

1:07:08

lot. There was definitely a commercial

1:07:10

use at some point in the past. Um, and

1:07:12

then just uh to the south of the subject

1:07:14

properties is the Harrisburg Improv

1:07:16

Theater. Uh, and then further south from

1:07:18

there, you get to the um, Steam Academy.

1:07:20

Uh, so the property so the property is

1:07:22

located in a mixeduse corridor. It's

1:07:24

kind of at the northern end of what I

1:07:25

would call that mixeduse corridor

1:07:27

extending from uh, kind of downtown

1:07:29

Midtown. Um and uh the id would say the

1:07:32

biggest issue is uh the request for

1:07:34

relief from off street parking. Um and

1:07:36

in considering uh what uh was a

1:07:41

reasonable um you know approach to this

1:07:44

because I believe the uh three different

1:07:47

units on site um required a total of I

1:07:50

want to say 14 uh off street parking

1:07:53

spaces. Uh I did think back to the um uh

1:07:57

proposal for the community garden that's

1:07:59

just to the south which was going to be

1:08:00

a community center and then uh 12 units

1:08:03

on the upper floors. Uh and as part of

1:08:05

that review uh the board required the

1:08:07

applicants to uh secure 10 spaces in the

1:08:11

lot at 1601 North Thirdrd Street uh a

1:08:14

long vac uh standing um surface parking

1:08:18

lot there. Uh and so uh you know we you

1:08:23

know in looking at what viable reuses

1:08:25

could there be for this? Again it was a

1:08:26

mixed use building in the past but it's

1:08:28

located in a fairly uh dense uh corridor

1:08:32

there and there's no way to provide off-

1:08:35

streetet parking on site. The rear of

1:08:37

the lots are um landlocked. Uh there's

1:08:40

no way to access those without driving

1:08:41

through other properties. So, we kind of

1:08:43

have to ask ourselves, how can we turn

1:08:46

this former mixeduse property, you know,

1:08:48

back into a productive and activated uh

1:08:51

property for the corridor uh and the

1:08:53

community. And again, the biggest issue,

1:08:55

which we presumed would probably be off

1:08:57

street parking. And so, we felt that uh

1:08:59

the approach taken for the development

1:09:01

just to the south would be appropriate

1:09:03

for uh the applicant's current proposal.

1:09:06

Um,

1:09:08

with that all being said, the planning

1:09:11

commission recommends that the zoning

1:09:14

hearing board uh approve the request

1:09:17

with the following conditions. Uh, if

1:09:19

granted approval, the applicant must

1:09:21

consolidate the two lots via submitt and

1:09:23

approval of a formal lot consolidation

1:09:24

application. uh granted zoning approval

1:09:27

to move forward with the project as

1:09:28

proposed. The applicant shall allow the

1:09:30

codes bureau to perform a comprehensive

1:09:32

inspection to identify any outstanding

1:09:34

code violations and will receive

1:09:36

approval for all necessary city permits

1:09:38

prior to receiving a certificate of

1:09:40

occupancy. Uh if any proposed signage

1:09:42

will not be in conformance with the

1:09:43

applicable zoning regulations, the

1:09:45

applicant must submit and secure

1:09:46

approval of the requisite zoning relief

1:09:48

requests. Uh, the applicant must submit

1:09:50

a certificate of appropriateness

1:09:52

application and receive approval from

1:09:54

HARB for the proposed exterior

1:09:56

alterations indicated on the floor

1:09:57

plans, including the construction of a

1:09:59

new rear balcony and potential changes

1:10:01

to the front elevation. And finally, the

1:10:03

applicant should engage the owners of

1:10:04

the surface parking lot at 1601 North

1:10:07

Third Street to ascertain whether they

1:10:08

are able to secure annual leases on site

1:10:10

for either residential tenants or

1:10:12

commercial employees.

1:10:14

Uh the Harrisburg Planning Commission

1:10:15

recommends the zoning hearing board

1:10:17

approve the request for the following

1:10:18

reasons. The properties have extended

1:10:20

have experienced extended vacancy over

1:10:22

the past five plus years with prior work

1:10:25

originally approved in November 2020

1:10:26

left unfinished creating openings in the

1:10:29

building envelope that have contributed

1:10:30

to interior deterioration. As such, the

1:10:33

properties require substantially more

1:10:34

investment than a comp comparable

1:10:36

conversion of an occupied structure. Uh

1:10:38

the project will reduce will reconstruct

1:10:40

a blighting influence and attractive

1:10:42

nuisance into new units that will

1:10:44

contribute to the housing inventory in

1:10:45

the city and neighborhood will add

1:10:47

community focused commercial businesses

1:10:49

and will rehabilitate historically

1:10:51

significant buildings. And finally, the

1:10:53

project advances the purpose of the RM

1:10:56

district zoning district provided in

1:10:57

chapter 7-305.4C 4C of the zoning code

1:11:01

as it proposes a medium-density

1:11:03

residential development along with

1:11:04

compatible neighborhood focused

1:11:06

businesses and will implement goals of

1:11:08

the comprehensive plan related to

1:11:09

mixeduse development along North Third

1:11:11

Street and the preservation of historic

1:11:13

resources.

1:11:19

>> Okay. Um and who was here for the

1:11:21

applicant?

1:11:23

>> Carla Harrison. Okay.

1:11:34

And you're with CAS Group LLC,

1:11:37

>> correct?

1:11:38

>> Okay. And what's your position there?

1:11:39

>> Uh, managing director.

1:11:52

I do.

1:11:56

>> Carla Harrison. C A R L A H A R R I S O

1:12:02

N.

1:12:05

>> Okay, Miss Harrison.

1:12:07

>> Yes. So, um, our project is an adaptive

1:12:11

reuse of, um, an existing mixeduse

1:12:14

structure, um, on a commercial corridor.

1:12:17

Our goal is to reactivate the building.

1:12:19

As Mr. Knight stated, it's been vacant

1:12:21

for, um, a number of years. Um, and to

1:12:26

serve the neighborhood with the

1:12:27

commercial use on the first floor and

1:12:29

modest uh, residential units on the

1:12:31

second and third floors. Um the ground

1:12:35

floor consists of the bakery and the

1:12:37

studio. Um and then the uh there there's

1:12:40

no expansion of the existing footprint.

1:12:43

All of our work is within um the

1:12:47

existing envelope. Uh

1:12:50

limiting it to two units um would

1:12:54

underutilize an entire floor. Um so I I

1:12:57

know that we did submit some building

1:12:59

plans. Hopefully you had time to review

1:13:02

them. Um but the way that the building

1:13:04

is currently structured um

1:13:09

the the third floor um is

1:13:15

a portion of it is is almost like an

1:13:17

attic. Um and so

1:13:21

not being able we and so we've made

1:13:23

apartment to a duplex um so that we're

1:13:27

able to maximize that that space. Um, so

1:13:30

there are three units. Uh, two of them

1:13:33

are one-bedroom apartments and then the

1:13:36

duplex is a two-bedroom apartment. Um,

1:13:39

and that we feel is the best way to

1:13:41

utilize that third floor. Um,

1:13:48

as far as the traffic and ingress and

1:13:51

egress, um, North Third Street is a

1:13:54

pedestrian or oriented corridor with

1:13:57

proximity to public transit routes. Um,

1:14:01

there's existing sidewalk access. We

1:14:03

won't be creating any new driveways um

1:14:06

or additional curb cuts. Um, and of

1:14:09

course, emergency access remains

1:14:10

unchanged there. Um, so Uh also, um as a

1:14:16

part of our plans, we have a fully

1:14:18

sprinkler code compliant um building.

1:14:21

So, that's a great upgrade there. Um

1:14:26

North Third Street is already a mixeduse

1:14:29

corridor as he mentioned. Um and we're

1:14:32

able to add modest housing there and and

1:14:35

activate a previously underutilized

1:14:37

building uh which will serve the

1:14:39

neighborhood. Um

1:14:44

there is a plan for all of our trash. So

1:14:48

with the commercial space, we have um a

1:14:50

plan to put all of the trash in the back

1:14:53

that will be fenced in and screened in

1:14:56

um and as well as the historic

1:14:58

character. So the historic character

1:15:00

will be maintained.

1:15:02

Um,

1:15:04

in addition to submitting the formal

1:15:06

application, we uh reached out to all of

1:15:09

our neighboring businesses and residents

1:15:11

to explain the project and to gather

1:15:13

their feedback. Um, we did receive a a

1:15:17

lot of positive support there. We were

1:15:20

able to explain um describe the bakery

1:15:22

and the studio as well as the

1:15:24

residential renovation and several of

1:15:27

the Midtown business owners as well as

1:15:29

the residents um signed a petition.

1:15:32

supporting the project. I did include

1:15:34

that in our application as well.

1:15:39

Um

1:15:42

there we are in a historic district so

1:15:44

there will not be any demolition of any

1:15:47

historically significant facade

1:15:49

elements. Um all of our exterior

1:15:52

exterior improvements and plans are

1:15:54

restorative. Um,

1:15:58

so our plan for parking relief, I'd like

1:16:00

to address that since that's the biggest

1:16:02

issue here. Uh, we as a part of our

1:16:04

conditions, we do have a plan to contact

1:16:07

the, uh, owner of the neighboring, I

1:16:10

believe it's a block away, the parking

1:16:13

lot there to secure long-term um, leases

1:16:18

to offer spaces for our residential

1:16:20

tenants. Um and so we do have plans to

1:16:25

do that. Uh

1:16:30

our operations plans for the bakery and

1:16:32

the studio include limited employees. Um

1:16:36

obviously daytime and early hours. um

1:16:40

there are no late night operations and

1:16:43

so we won't have the effect from the

1:16:45

commercial spaces with parking hopefully

1:16:47

in the evening when the other

1:16:49

neighboring um residents are coming home

1:16:52

uh because our our commercial spaces

1:16:54

will be closed. Um we plan for long-term

1:16:58

tenency in our residential units. So

1:17:01

there's no shortterm um tenency there,

1:17:04

no short-term rentals.

1:17:07

Um, and again, I'd like to just

1:17:10

highlight that we are our our main goal

1:17:13

here is to revitalize the the structure

1:17:16

um, knowing that it's been underutilized

1:17:18

for a long time um, and enhance the the

1:17:22

commercial corridor as well. uh also

1:17:24

supporting small business development

1:17:27

um which we believe aligns with the

1:17:30

city's comprehensive plan uh for

1:17:32

adaptive reuse and housing diversity as

1:17:35

well as small business activation.

1:17:39

So that's everything. Thank you for your

1:17:41

time.

1:17:46

>> Any questions?

1:17:52

Good evening. Thank you for coming out.

1:17:56

your presentation there basically

1:17:58

covered 90% of my class questions and

1:18:01

that's a that's a rarity always a

1:18:04

question but um but I've got one your

1:18:08

your baker you're proposing

1:18:12

um I see their planning I mean the

1:18:15

planning

1:18:17

board basically said that um

1:18:20

whatever sign you put has to conform

1:18:25

How do you how do you go about

1:18:26

advertise?

1:18:28

>> Um

1:18:30

we will I so

1:18:34

we have a plan for a tenant there. Um

1:18:37

and that will be discussed with them. Uh

1:18:40

signage

1:18:42

I believe we would just have to conform

1:18:44

and use uh social media is a great

1:18:47

marketing tool these days. Um, and there

1:18:50

are just other ways I believe that we'll

1:18:52

have to to get that job done. I don't I

1:18:55

don't think that the sign would would

1:18:57

hinder um our business activity there.

1:19:01

>> One of the conditions or

1:19:03

>> the planning commission bought up they

1:19:06

assign wouldn't be for that area. Yeah.

1:19:09

And and one of the things the planning

1:19:11

bureau usually does in uh the case of

1:19:13

you know small businesses looking to

1:19:15

establish themselves in our existing

1:19:17

spaces and especially when they're in a

1:19:18

historic district is to use window signs

1:19:21

uh because you do have all that

1:19:23

especially for a project like this you

1:19:25

have those big storefront windows um and

1:19:27

that is not subject to harbor view. So,

1:19:29

it allows uh applicants to quickly and

1:19:32

easily identify themselves without

1:19:34

having to go through um the additional

1:19:37

review of the historic uh board. And if

1:19:40

later on the applicants choose to put up

1:19:42

a wall sign or a projecting sign,

1:19:43

they're certainly welcome to do that.

1:19:45

But uh we want to help them, you know,

1:19:47

get on get up and get started on their

1:19:49

feet as soon as possible. So, we usually

1:19:51

advise them to use window signage to

1:19:53

start.

1:19:55

>> Second concern was parking.

1:19:59

I'm always parker. I've actually been at

1:20:01

your place a few times. Okay. Um

1:20:05

the park your parking work out some

1:20:08

arrangement with there. I think was

1:20:10

you're right off Hamilton going between

1:20:12

Hamilton and uh Harris Street. I'm just

1:20:16

trying to think behind what's right

1:20:18

behind that little street back there.

1:20:20

There some whoever that whoever owns

1:20:23

that area work some type of agreement

1:20:25

out for

1:20:28

Okay. For for parking,

1:20:30

>> correct? Yep.

1:20:32

>> It'll be all street parking because it's

1:20:34

behind it will be actually behind the

1:20:36

building behind where the uh dumpsters

1:20:39

are going to be.

1:20:41

So when people as they park back they're

1:20:44

going to have to go around Hamilton

1:20:46

Street and down Third Street to come

1:20:47

back into the building or you're going

1:20:49

to build some type of

1:20:51

egress or entry type of point from the

1:20:55

rear.

1:20:55

>> So I apologize. It's not the uh it's not

1:20:58

in the rear the the lot. It's the lot.

1:21:01

Um I don't have the street here.

1:21:05

>> Yeah. So, we we did reach out to the

1:21:08

owner of that lot and he mentioned that

1:21:10

um it's not zoned as a parking lot. Um

1:21:14

so, the lot that I'm referring to, it

1:21:17

was uh owned by Hack. Um yeah. So, I

1:21:21

parking in the rear is not an option. I

1:21:23

don't I don't think I don't know, Mr. N.

1:21:25

I don't think it's zoned as a parking

1:21:26

lot. That's what I was told.

1:21:27

>> No, there's that little lot on the back

1:21:29

is not technically a legal parking lot.

1:21:32

>> Yeah, people park there, but it's not.

1:21:34

It's just one of those things that, you

1:21:35

know, it's there and everybody asks how

1:21:37

it got there, but uh and I don't know

1:21:38

the answer to that, but

1:21:40

>> I guess I'll drive my car

1:21:42

over. Okay. But okay. Um

1:21:47

that's all questions I have. But you

1:21:50

said there's a little lot a little there

1:21:52

used to be a little house in an empty

1:21:54

lot on Third Street. Um you said that's

1:21:57

an empty lot, but you tried to reach out

1:21:59

to the owner.

1:22:00

want to do with that or

1:22:02

>> um Yeah, I'm not sure. He he did mention

1:22:05

he was looking to uh to Yeah, correct.

1:22:09

>> Well, thank you. Thank you very much.

1:22:11

>> Yes. Thank you.

1:22:15

>> Right. Um first, Mr. Knight, can you

1:22:17

confirm? You said it's technically 14

1:22:20

parking spaces that are required for

1:22:23

this.

1:22:23

>> Uh yeah, hold on. Let me let me check

1:22:27

here.

1:22:29

>> Okay.

1:22:31

Um,

1:22:34

>> oh, sorry. Uh, nine. Yeah, nine off

1:22:37

street. Sorry, it was nine off street.

1:22:39

>> I was uh miscalculating. Yeah, nine.

1:22:42

>> Okay,

1:22:43

>> so nine. Um, yeah, just to kind of

1:22:45

reiterate, um, it would have been great

1:22:47

actually if there was already some type

1:22:48

of agreement that we could reference as

1:22:52

part of the application at this point.

1:22:54

Um, but I did hear that you are planning

1:22:56

to reach out to um, that property owner

1:22:58

to using that space. Um the other thing

1:23:02

that I did have a question about

1:23:06

um Miss Harrison is so for this

1:23:10

specifically looking at the part of the

1:23:12

dimensional variance um we talked about

1:23:16

having I guess instead of two

1:23:19

residential units having a third, right?

1:23:21

It sounded like it was more so of

1:23:25

just how you would like to use the

1:23:27

property as opposed to there actually

1:23:28

being in need. Um, you know, that would

1:23:32

require

1:23:33

um that variance or that you know makes

1:23:36

it I guess that provides the foundation

1:23:39

in terms of a hardship for that

1:23:41

particular variance. So I just wanted to

1:23:44

see do you have any other I guess

1:23:46

insights or explanation regarding that

1:23:50

request or that desire you know for

1:23:53

there to be three units as opposed to

1:23:55

just two.

1:23:57

>> Absolutely. So similar to Mr. uh Shoks I

1:24:01

believe his name was uh when we go in to

1:24:04

develop these uh poorly conditioned

1:24:08

properties that like as he mentioned

1:24:10

it's been exposed to the elements for a

1:24:12

number of years um we've brought in

1:24:14

structural engineers and then once you

1:24:17

realize the actual cost of the

1:24:20

renovation and renovating the building

1:24:23

um maximizing the potential for income

1:24:25

is the only way to make it make sense.

1:24:28

Um, obviously we will be spending

1:24:31

hundreds of thousands of dollars to to

1:24:33

to get this property co-compliant. Um,

1:24:37

just the sprinkler system alone uh is a

1:24:40

a huge cost. And so um that's the

1:24:45

financial aspect is one of the biggest

1:24:48

hardships. Um,

1:24:52

and I I personally believe that just

1:24:54

adding one additional unit um is not

1:24:58

such a big ask uh here in this

1:25:02

particular property. Um

1:25:06

because so he mentioned that there was

1:25:08

one apartment but when we went there

1:25:10

there were two. So, there are actually

1:25:12

uh four existing electrical panels,

1:25:15

which is how we can tell there were four

1:25:16

meters there at the property already.

1:25:19

Um, and so we're just requesting the the

1:25:22

one additional unit there. But financial

1:25:25

hardship is is the biggest one.

1:25:27

>> Okay. Thank you for that explanation.

1:25:30

Um, and uh, no, it it definitely is good

1:25:33

to see that there's interest in doing

1:25:34

something with that building because I

1:25:36

kind of cringe every time I pass it with

1:25:38

those missing windows.

1:25:40

Um yeah so no it's that's good to hear

1:25:43

that there is some interest um in that

1:25:44

particular location.

1:25:46

>> Yes. Um but I think those are the only

1:25:48

questions I have

1:25:52

>> for you

1:25:55

and your part will be for market value

1:25:58

or

1:26:01

>> yes

1:26:02

>> how would you basically recoup your your

1:26:06

your revenue or

1:26:07

>> um I can't give you an exact number but

1:26:10

um absolutely fair market value nothing

1:26:12

nothing um above that Um,

1:26:16

personally, we always like to work with

1:26:20

uh programs. So, I'm a programming type

1:26:24

of person. Um, you know, section 8 fair

1:26:27

housing is is all open um and up for

1:26:33

for discussion there. But, um, and and

1:26:35

it would allow us even those rates that

1:26:38

that they offer would allow us to recoup

1:26:41

our costs. Yes. So,

1:26:44

And you currently own it, but you

1:26:45

aren't.

1:26:46

>> Correct.

1:26:47

>> Okay. Thank you.

1:26:49

>> Um, the apartments, how are they?

1:26:53

Because I know there's a 1637 and a 1637

1:26:57

and a half. So, where are the units as

1:27:00

compared to those structures and all

1:27:03

that?

1:27:04

>> So, um, at the front of the building

1:27:06

there are three entrances. So, the two

1:27:09

entrances on the outside lead to the

1:27:11

commercial spaces. Uh the door in the

1:27:13

middle would lead to a set of stairs

1:27:15

that go up to the uh three separate

1:27:19

entrances to three different apartments.

1:27:22

Uh and so all of the apartments are

1:27:24

located on the second uh and third

1:27:26

floor. So uh the one-bedroom apartments

1:27:29

are on the second floor and the

1:27:32

two-bedroom apartment is a two-level

1:27:34

apartment. So, it is the kitchen and

1:27:38

living area is on the second floor and

1:27:40

then all of the bedroom um and bathrooms

1:27:43

are on the third floor.

1:27:44

>> Okay. And that one that's 1637 and a

1:27:47

half that smaller

1:27:50

unit or whatever structure there. Um

1:27:54

does that have not quite a whole unit

1:27:56

over that one like

1:27:58

>> but is that right? It's not like quite

1:28:01

one unit over that one. The other two

1:28:03

are over 1637. Right. It's kind of like

1:28:06

part of one unit.

1:28:08

>> Starts over 1637 and a half and then it

1:28:11

goes into 1637 where the other two units

1:28:14

are.

1:28:14

>> Correct. So technically the half side

1:28:17

only consists of the studio on the

1:28:20

bottom floor. Um and then there's uh

1:28:24

just the bathroom or one of the bedrooms

1:28:27

of the second unit. So it's it's very

1:28:31

small. Um but yeah, you're correct.

1:28:34

>> Okay. And and Mr. Knight, just trying to

1:28:36

then also confirm because we got the

1:28:38

variance uh uh requests and the one is

1:28:43

for the uh specific criteria kind of

1:28:45

handling I know how you right looked at

1:28:48

just kind of handling them separately to

1:28:51

just to be I don't know safer just to be

1:28:55

>> you know thorough you know. Yeah, it was

1:28:57

it was I mean it's neither is was really

1:29:00

a existing single family. So I I don't

1:29:02

even know that the specific the

1:29:04

revariance for relief from the specific

1:29:05

criteria was required and I may have

1:29:09

been there may have been like a

1:29:11

difference in how I was reviewing at the

1:29:12

beginning when I started writing the

1:29:14

agenda and the case report and once I

1:29:16

got through all the documentation I

1:29:18

realized it was something different and

1:29:19

I didn't remove that because as I was

1:29:21

reading uh the case report here I was

1:29:23

kind of wondering why I had had that uh

1:29:24

variance in there. I think it's just the

1:29:26

variance for the density and not for the

1:29:28

specific criteria.

1:29:30

>> Okay.

1:29:31

>> Because the because again those were not

1:29:34

um uh single family dwelling,

1:29:36

>> right? They weren't before they weren't

1:29:38

and and that's what I was just wondering

1:29:39

is even though I knew the upper ones

1:29:41

were it's not the same right with

1:29:44

conversion. So okay. So then it'll just

1:29:46

be the density. Okay. We'll just uh

1:29:49

write the density the parking

1:29:51

>> and all the 10 spaces. Uh yeah, the

1:29:54

density parking

1:29:56

>> nine nine.

1:29:57

>> Yeah. And then and then the multif

1:29:59

family dwelling too. So that's the other

1:30:01

special exception. Yep.

1:30:03

>> Okay.

1:30:06

>> Okay. Anybody here uh wants to provide

1:30:10

comment on this application?

1:30:14

City. Anything from the city?

1:30:15

>> I just had more of a question just

1:30:17

because your question kind of confused

1:30:19

me and I haven't been over there. So the

1:30:22

address of the apartments is 1637 like

1:30:26

A, B and C and then the business is 1637

1:30:30

and a half or how do the addresses break

1:30:33

down?

1:30:33

>> Well, I think that a part of our

1:30:35

conditions since it includes the lot

1:30:37

consolidation, would that mean that we

1:30:39

would just have one address then at that

1:30:41

point?

1:30:41

>> I forgot about So you're going to

1:30:44

>> are you going to use one of the current

1:30:45

addresses for all three or

1:30:48

>> correct? So I think that it would just

1:30:50

be apartment like you said a

1:30:51

>> like a B and C.

1:30:53

>> Yeah.

1:31:07

>> Okay.

1:38:59

to secure a parking agreement to satisfy

1:39:02

the off streetet parking requirements.

1:39:04

Um that is suitable by the city

1:39:07

solicitor.

1:39:12

You or me?

1:39:13

>> No, you.

1:39:14

>> Well, as long as she's in agreeance,

1:39:16

>> right? That's what I say.

1:39:17

>> Yes.

1:39:18

>> That's what I Yeah.

1:39:21

>> Yes. I agree.

1:39:23

>> Okay.

1:39:25

Is there a second?

1:39:26

>> I second.

1:39:28

>> Okay. We have a motion and a second. All

1:39:31

in favor?

1:39:32

>> I

1:39:33

>> Okay.

1:39:35

It's approved. So, we will send a

1:39:37

decision to you. Okay. Okay.

1:39:39

>> Uh within 45 days um

1:39:43

the approval with the conditions. Okay.

1:39:45

>> All right. Thank you.

1:39:47

>> Great.

1:40:12

Yeah.

1:40:15

>> Are you guys going to be taking action

1:40:16

on the continuences?

1:40:19

We had those.

1:40:20

>> Yes. Oh, the well the

1:40:24

continuences to tonight. All All the

1:40:27

because the other ones wait.

1:40:29

>> I think there were continuences to the

1:40:31

April meetings. Uh oh, the mar the wait

1:40:34

a second though. Wait, wait, wait.

1:40:36

>> Those one

1:40:38

several of them right though requested

1:40:40

directly a continuence of the March

1:40:42

meeting to the April meeting, right?

1:40:44

>> Yes. Yes.

1:40:45

>> The ones for tonight requested a

1:40:48

continuence to tonight.

1:40:50

>> Yes. The the other ones for 40 North

1:40:53

17th Street, uh 1840 to 1860.

1:40:56

>> I get it.

1:40:57

>> Uh 923 North 18th Street and 1301 Berry

1:41:01

Hill Street. just requested from the

1:41:04

March planning commission to the April,

1:41:06

>> but we would have voted on those.

1:41:08

>> Last one's meeting, which we didn't get

1:41:09

to do. Yeah.

1:41:10

>> Let Hold on. Let me make sure I got

1:41:14

to do it. Okay, hold on. So, first of

1:41:17

all, we're going to have continuence

1:41:19

requests for applications 2625,

1:41:26

2629, 2630, and 2632.

1:41:30

uh the continuence request uh from the

1:41:33

March meeting till tonight's meeting. Is

1:41:36

there a motion to approve those

1:41:37

requests?

1:41:40

>> I made a motion.

1:41:41

>> Okay. Seconded.

1:41:42

>> So move.

1:41:43

>> Okay. All in favor?

1:41:44

>> I

1:41:45

>> Okay. Now the uh applications

1:41:50

uh 26 26 26 27 26 28 2631

1:41:57

and 2633.

1:42:00

um that filed um requests

1:42:04

uh of the March meeting to the regularly

1:42:07

scheduled meeting of April 20, 2026. Are

1:42:12

those requests for continuences uh

1:42:15

approved? Is there a motion for that?

1:42:16

>> Motion.

1:42:18

>> Second.

1:42:20

>> Second.

1:42:21

>> Okay. All in favor?

1:42:23

>> I

1:42:24

>> Okay, motion's passed. Thank you. wanted

1:42:27

to make sure he got both though that to

1:42:28

to cover

1:42:30

>> uh cover that. So,

1:42:33

>> so the April 13.

1:42:37

>> Well, one more. I just want to uh I just

1:42:39

want to uh take the opportunity uh to

1:42:41

formally introduce uh Steph uh Thompson,

1:42:45

a new deputy director, started last

1:42:46

Monday. Uh so, uh throwing it right into

1:42:50

the mix here with two back-to-back

1:42:51

zoning hearing board meetings. Um, but I

1:42:55

promise her it's not like this every

1:42:56

month. Um, but uh, you know, I think

1:42:59

I'll still be handling things for the

1:43:01

1:43:08

her feet away here.

1:43:09

>> Welcome.

1:43:11

>> She'll be I

1:43:14

come up, I'll come to I'll ask

1:43:18

1:43:25

>> next week is

1:43:28

five from

1:43:29

>> Yeah. And then

1:43:31

>> four although one requested.

1:43:33

>> Yeah. One requested uh actually two. So

1:43:36

the Walnut Street one and the um the two

1:43:39

Wall Street ones, the 1854 and 1860 and

1:43:42

the 1257 and 1259 both requested till

1:43:45

May. So we'll still have

1:43:49
