there but our office is there so it's an

have to look at the use in the totality

of what they're doing not like pick it

apart because not only again does that

that I just noted but it would really

complicate just the administration of

the zoning code to look at every single

activity that might happen as part of a

the determination that we did um and

then our recommendation of denial was

based on the fact that there's nothing

um in inent to the property itself that

does not allow it to be used for any of

the industrial district and therefore

the variance is necessary to allow the

use to go forward um you know there are

tons of uh especially Auto oriented uses

like Auto Repair Auto Sales that could

be done on the property and we get

requests for those you know on a daily

or weekly basis really um and so we did

not feel that the request was justified

uh in their deliberations the Planning

sided with the applicants um agreeing

that the activities that they would have

on site would constitute an office use

distinct from um the place of worship

use that is their primary facility at

following conditions that the applicant

it in Center City here and we were going

to use the same use and someone says

well it's the you're doing it as the

church so you're a place of worship now

that creates a hardship for us to to be

able to find um property that that we

want to use for those proposed purposes

the office the counseling so I think

basically an acknowledgement that it's

the conditions it's the language of the

property um this requires only hearing

from the density regulations and

1:35:27

specific criteria per section

73073 and 7- 3092 V of the code

respectively um so this uh case is um uh

a little there's a little bit of um

ambiguity I think in in some of the um

1:35:46

history uh and information of the case

1:35:49

um it's you know I think evident that at

1:35:52

one point in the past p uh the property

1:35:54

was operating as two units I think it's

1:35:57

configured as two units um but as noted

1:35:59

in the planning bureau's case report um

1:36:02

it's been owner occupied as far back as

1:36:04

the County's records go which is the

1:36:06

2001 um so you know that's right there

1:36:09

kind of one thing we note when looking

1:36:11

at things like this is it a if it's a

1:36:13

you know investment property or

1:36:14

something like that clearly it's a

1:36:16

rental of and then you're just asking

1:36:18

how many units whereas this is uh has

1:36:20

always been under occupied since 2001 uh

1:36:23

we do have a record of um it being two

1:36:26

units back in 2001 in the city's records

1:36:29

however in the intervening 23 years or

1:36:32

so there's been no um you know rental

1:36:37

inspections done that would um confirm

1:36:39

that this is two units uh as as would be

1:36:41

required uh you would have to have um at

1:36:44

least semi-regular inspections of both

1:36:47

units to um affirm that it's still

1:36:50

maintaining Cod compliance and things of

1:36:52

that nature um and so uh the current

1:36:55

applicant um recently purchased the

1:36:57

property and um was looking to U

1:37:01

maintain those two units and it was our

1:37:04

determination that uh due to the two

1:37:07

plus Decades of at least no records of

1:37:10

there being multiple units the former uh

1:37:14

multif family dwelling use had been

1:37:16

abandoned per the zoning code and thus

1:37:19

um the applicants needed to go through

1:37:21

the necessary zoning relief uh to

1:37:24

reestablish the two units on site um and

1:37:27

the applicants have you know

1:37:28

documentation that they'll be I'm sure

1:37:30

discussing and presenting to the board

1:37:32

um uh to you know from from their

1:37:36

perspective um but the that being said

1:37:39

uh the planning Bureau is supportive of

1:37:42

the uh proposed use you know one of the

1:37:45

uh big issues um when you're talking

1:37:47

about conversion of properties is the

1:37:49

impact on parking in this case they have

1:37:52

a three Bay garage at the rear of the

1:37:54

property um it should be noted that that

1:37:56

garage doesn't actually have like a

1:37:57

formal driveway uh there's a grass strip

1:37:59

between uh what would be I guess the

1:38:01

driveway apron and and the street um and

1:38:03

it's a pretty kind of steep topography

1:38:05

there uh but it's clear that there's

1:38:07

three Bays there and I'm sure somehow

1:38:09

got into those bays in the past um so

1:38:12

they have the um you know off street

1:38:15

parking to handle this they you know

1:38:17

clearly have a um uh fire escape on off

1:38:21

the rear of the property uh and as

1:38:22

they've shown in the their um photos

1:38:25

there are you know two separate

1:38:26

entrances uh and if the previous

1:38:29

property owner it's not just the

1:38:30

previous owner Mr Clark there was

1:38:32

another one before that for 18 years or

1:38:34

so I think um had they you know

1:38:37

maintained the even semi-regular rental

1:38:41

inspections we would have just

1:38:42

determined that this was you know

1:38:44

continuing non-conforming use um so with

1:38:48

all that being said uh the Planning

1:38:51

Commission recommends that the zon

1:38:53

hearing board approved the request with

1:38:54

the following conditions if granted

1:38:56

zoning approval to move forward with the

1:38:57

project as proposed the applicant shall

1:38:59

allow the codes Bureau to perform a

1:39:00

comprehensive inspection to identify out

1:39:02

any outstanding code violations that

1:39:03

will receive approval for all necessary

1:39:05

city permits prior to receiving a

1:39:07

certificate of occupancy uh because they

1:39:09

are not requesting relief from the off

1:39:11

street parking requirements and have

1:39:12

reference the detached garage and

1:39:14

affirming the provision of the required

1:39:15

off street parking uh the applicant must

1:39:17

construct a driveway to provide access

1:39:19

to the three garage bays in the rear of

1:39:21

the property as no such access currently

1:39:23

exists um it should also this work

1:39:25

should also ensure that there's an ada8

1:39:27

compliance sidewalk uh it's maintained

1:39:29

along Edward Street there and then the

1:39:31

applicant will coordinate the Department

1:39:32

of Public Works to ensure the account

1:39:33

billing is updated to reflect the

1:39:35

proposed change in use uh the Planning

1:39:37

Commission recommended that the zon he

1:39:39

board approved the request for the

1:39:40

following reasons the zoning relief

1:39:42

requests for the proposed unit the use

1:39:44

are warranted by the history of the

1:39:45

property which is operated in the

1:39:47

pastest two units uh and the project

1:39:49

will address the primary concern of the

1:39:51

public regarding such conversions

1:39:53

specifically the impact on parking

1:39:54

available to existing residents through

1:39:57

the provision of the required parking in

1:39:58

the detached garage of the rear of the

1:40:00

dwelling uh the property is a semi

detached dwelling building it has been

dwelling for approaching 50 years the

property is located in the city's

1:44:41

residential medium density District uh

1:44:44

we had uh Jeff the planning Bureau CH

make an interpretation that the use is

1:44:49

actually a single family dwelling and

1:44:51

not a multi family dwelling unit we are

1:44:53

here seeking an appeal of the zoning

1:44:54

officer determination or in the

1:44:57

alternative a special exception coupled

1:44:59

with two dimensional variances to permit

1:45:01

the use we did receive a favorable

1:45:04

recommendation from the City Planning

1:45:05

property clearly indicated it's a two

unit property uh and the letter from the

1:55:49

prior owner indicates that he never

1:55:51

abanded the multif family use and never

1:55:53

intended to and sold the property as

1:55:55

such and in Pennsylvania to abandon a

1:55:58

use requires both uh intent and actual

1:56:01

abandonment there does appear to be some

1:56:03

confusion on the owner's history but as

1:56:05

the deed indicates Melvin Clark gained

1:56:06

half ownership of that property in 1977

1:56:09

and when the other owners died he gained

1:56:12

complete

1:56:13

ownership finally if the board does not

1:56:15

want to Grant the appeal and grants the

1:56:16

alternative relief uh just a comment

1:56:19

about the recommended driveway condition

1:56:21

the last of formal access uh we would

1:56:24

argue is likely a non-conforming

1:56:26

condition and imposing this condition

1:56:28

places another significant burden on the

1:56:30

applicant further pushes back this

1:56:32

timeline to rent the property out to

1:56:34

tenants uh you're essentially asking to

1:56:37

maintain the status quo as that has

1:56:39

continued to exist as it does today and

1:56:42

furthermore as indicated by the planning

1:56:43

Bureau there is sufficient on street

1:56:45

parking available along the property

1:56:47

including 150 on Edward Street and for

1:56:50

the reasons discussed

1:56:52

request you grant the appeal or in the

1:56:55

alternative special exception

1:56:58

guarantees that

questions I think my questions have been

area it's very important to be able to

zoning violation where it'll be marked

they're going to claim that that's an

accessible driveway or accessible garage
